AN ORDINANCE OF THE CITX OP ~Y
BEACH, ~0RIDA, PROHIBIT~MG THE
PARKING OF TRUCKS OVERNIGHT IN
RESID~ITIAr. AREAS, AND PROVIDING
PENALTIES.
WHEREAS, it has been found and determined by the City
Council of the City of Delray Beach, Florida, to be detrimental
to the safety, health and welfare of the citizens of this com-
munity to permit the parking of trucks upon the public streets
and upon private property in the residential smeas of the City
of Delray Beach, unless such tx~Acks are parked in a garage, port-
cochere, ca~port or other covered structure, and that parking of
such tx-acks overnight in all residential areas greatly reduces
the value of surrounding properties and generally injures and
Jeopardizes the health and general welfare of the City of De]may
Beach,
NOW, TEEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF DEL~AY BEACH, FLORIDA:
SECTION 1. It shall be unlawful to park any truck, trailer, or
semi-trailer upon any street in a residential area
within the City of De]may Beach, between the hours
of ll:O0 o'clock P.M. and 6:00 o'clock A.M.
BECTI0~ 2e It shall be unlawful to park any truck, trailer, or
semi-trailer upon private property in a residential
area within the City of Delray Beach between the
hours of ll:00 o'clock P.M. and 6:00 o'clock A.M.,
unless such truck is parked within a cevered garage,
port-cochere, carport or other covered buildinge
SECTION 3. (a) This ordinance shall not apply to commercial
vehicles o~ regular delivery or service calls.
(b) Any area zoned for single, two-family or multiple
family dwellings or apartments shall be considered
re sidential.
SECTION 4. Any person, firm or corporation violating any of the
provisions of this ordinance shall be deemed guilty
of a misdemeanor, and upon conviction thereof shall
be fined in an ~ount not exceeding $ ..... , or
be imprisoned for a period not exceeding days.
SECTION 5. If any section, subsection, sentence, clause, phrase
or portion of this ordinance is held invalid or un-
constitutional by any court of competent jurisdiction,
such portion shall be deemed a separate, distinct and
independent provision such holding shall not affect
the validity of the remaining portions hereof.
SECTION 6. All ordinances and parts of ordinances in conflict
herewith be and the same are hereby repealed.
