AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DEI~RA¥ BEACH, FLORIDA, ANNEXING TO ~HE CITY THE FOLLOWING DESCRIBED TRACT OR PARCEL OF LA~D LOCA- TED IN PALM BEACH COUNTY, FLORIDA, AND LYING CON- TI~UOUS TO THE EXISTING MUNICIPAL LIMITS OF SAID CI~ OF DELRAY BEACH. SAID LANDS BEI~G AND CON- STITUTING Tt~iAT CERTAIN PROPOSED SUBDIVISION KNOWN AS "TROPIC ISLES TRADING CENTER," ACCOP~ING TO A PROPOSED PLAT THEREOF TO BE RECORDED IN THE OFFICE OF THE CLERK OF THE CIRCUIT COURT IN AND ~VOR PALM BEACH COUNTY, FLORIDA; AND PROVIDING FOR THE ZONING AND TAXATION OF SAID LANDS. WHEREAS, the City Council of the City of Delray Beach, Florida, has, by Resolution No. 1046 determined that the herein- after described land is contiguous to the existing municipal boundary lines of the City of Delray Beach, Palm Beach County, Florida; and WHEREAS, Tropic Isles Trading Center, Inc., a Florida Corpor- ation, is the sole fee simple title holder of the property described herein, and said Corporation has heretofore by its Petition for Annexation, as amended, consented and given perraission for the annex- ation of saiC property by the City of Delray Beach; and WHEREAS, the City of Delray Beach, Florida, has heretofore been authorized to annex lands in accordance with its charter granted it by the S~ate of Florida. NOW, ~EREFORE, BE IT ORDAINED BY THE CI~I~ COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, as follows: SECTION 1. That the City Council of the City of Delray Beach, Palm Beach County, Florida, does hereby annex to said city the follow- ing described tract or parcel of land located in Palm Beach County, Florida, which lies contiguous to the existing boundaries of said city, to-wit: BEGINNING at a point in the West right-of-way line of State Road No. ~ (U.S. Highway No. l) as shown on the right-of-way Map of said State Road No. ~ recorded in State and County Road Plat Book 2, pages 73, 74 and 7~, public records of Palm Beach County, Florida, which point of beginning is 140.08 feet North of the South line of Tract 6-A of the Revised Plat of Portions of Sections 28-29, Township 46 South, Range 4~ East, according to plat thereof recorded in Plat Book 18, page ~3, public records of Palm Beach County, Florida; thence run West 130.~0 feet to a point; thence run South (at right angles to preceding course) a distance of 140 feet, more or less, to the South line of said Tract 6-A; thence run West along the South line of said Tract 6-A a distance of 14~.6~ feet, more or less, to the section line running between said Sections 28 and 29; thence continue West along the South line of Tract 7 of said Revised Plat of Portions of Sections 28-29, Township 46 South, Range 43 East, a distance of 436.10 feet, more or less, to a point where the said South line of said Tract 7 intersects with the Easterly right-of-way line of the Old Dixie Highway; thence run Northerly along the East right- of-way line of said 01d Dixie Highway 698.16 feet, More or Less, to the North line of said Tract 7; thence run East Along the north line of said Tract 7, a distance of 301.0 feet to the section line running between said Sections 28 and 29; thence continue East along the North line of Tract %-A of said Revised Plat of Portions of Sections 28-29, Township 46 South, Range 43 East, a distance of 291.92 feet, more or less, to the West right-of-way line of State Road ~to. 5; thence run South along the West right-of-way line of said State Road tQO. 5 (U.S. Highway No. l) as shown on the right-of-way Map thereof recorded in State and County Road Plat Book 2, pages 73, 74 and 75, public records of Palm Beach County, Florida, a distance of 546.[~9 feet, more or less, to the point of beginning. SECTION 2~ That the boundaries ~of the City of Delray Beach are hereby redefined so as to include therein the above described tract of land, and said lands are hereby declared to be in the corporate limits of the City of Delray Beach, Florida. SECTION 3. The property hereinabove described and herein annexed to the City of Delray Beach, Florida, shall not be taxed, for ad-valorem taxes in excess of an annual tax of $10.00 per business lot as shown on said proposed plat of "Tropic Isles Trading Center" for ten years from the date of the enactment of this ordinance. In the event, however, any such lot is sold, transferred or otherwise disposed of by Tropic Islas Trading Center, Inc., or in the event any building is constructed on any lot, then such lot shall be subject to normal taxation of the City of Delray Beach, i~'lorida. SECTION 4- The property hereinabove described and herein annexed to the City of Delray Beach, Florida, is taken into said City under the following zoning regulations and conditions: (a) Business "C-l" District shall be applicable to all lots and blocks; which shall include agencies, such as employment, insurance and real estate; auditoriums, banks, bakeries, serving retail trade; bars; barber shops; beauty parlors; bicycle shops; blue-printing; photostats and the like; business colleges; cafeterias; department stores; dress-making~ shops; drug stores; dry-cleaning, pressing, block- ing and dyeing establishments; electric light and power companies, express companies, florists; grocery stores~ retail only, hospitals; hotels; ice-cream parlors; jewelry shops; music stores; night clubs; office buildings; package stores; photo shops and art galleries; post- office sub-stations; private clubs; professional offices; public steno- graphers; radio salesroom; restaurants; retail shops and stores; sales and show rooms; schools, private or public; stationery and office equipment, retail; telegraph station, telephone office; theatres; and watch repairing. Such shall be the zoning classifications notwith- standing the fact that the sa~ue may diffe~~ or deviat~ fro~ the business classifications now permitted in a "C-l" district by the Zoniug Ordin- ances of Delray Beach. (b) No off-street parking shall be required to be provided on any of the numbe~,ed lots or blocks shown on the plat so long as tt~e non-dedicated parki~ areas are available for use for parkinj~ and drives and construction of commercial buildings shall be permitted within the entire area of the numbered lots and blocks shown on the plat (except in the areas reserved as parking and utility easements) during the effective period of the proposed Reservations, Restrictions and Covenants to be filed of record. (c) The water mains to be installed in said area (but not the service connections to private property) shall forthwith on installation become the property of the C mt~ of Delray Beach, ~lorida, and said City shall furnish water to the inhabitants of said property ~t the same rates charged to other water consumers in the City of Delray Beach, ~loridae (d) That the City c~ Delray Beach shall pay to Tropical Isles Development Company, one hundred per cent (100%) of the water revenues received by the City from the lands shown on the plat of Tropic Isles Trading Center in accordance with and under the limit- ations provided in the "Petition for Annexation by the City of Delray Beach, Florida" submitted by Tropical Isles Development Company, as amended by "Amendment to Petition for Annexation by the City of Delray Beach, Florida" dated July 9, 1956; approved by the City Council by Resolution No. 1018 adopted July 14, 1956. SECTION 5. That, if any word, phrase, clause, sentence or part of this Ordinance shall be declared illegal by a court of competent jurisdiction, such record of illegality shall in no way affect the remaining portion. This Ordinance was placed on first reading by the City Commission at a regular meeting held on April 8t~ , 1957, and said City Commission will sit in the COmmission Chambers at the City Hall on the 22nd day of April . . , 1957 at 7:30 P.M., at which time the above OrdinanCe will be read in full, and all persons interested shall be given ma opportunity to be heard.
