Ord G-276(34-57) ORDINANCE OF THE CITY OF DELRAY BEACH, FLORIDA, ~ELATINO TO FEDERAL OLD A~E AND SURVIVORS INSURANCE. ORDINANCE .N_0.' C-~..76 An ordinance declaring the policy and purpose of the City of Delray Beach, Florida, to extend to employees and officials of said City in the position of fireman and not ex- cluded by law, nor hereinafter excepted, the benefits of the system of Federal Old Age and Survivors Insurance, as authorized by the Federal Sogial Security Act, and amendments thereto, upon the basis of applicable State and Federal laws or regulations; authorizing and directing %he ~ayor (or other chief executive officer) to execute agreements and amendments thereto with the State Agency authorimed to enter into such agreements, subject to employee referendum, for coverage of said employees and offi- cials, and to request such referendum; providing for withholdings from salaries and wages of employees and officials of said City so covered to be made and paid over as provided by applicable State or Federal laws or regulations; providing that said City shall appropriate and pay over employer's contributions, assess- ments, and referendum costs, as provided by applicable State or Federal laws or regulations; providing that said City shall keep records and make reports as required by applicable State or Federal laws or regulations; and providing that the effect of this ordinance shall cease if a majority of the eligible employees do not vote in favor of such coverage at such employee referendum; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DEIRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. It is hereby declared to be the policy and purpose of the ~it¥ of..Delra¥ Beach. ~!o.rida, to extend effective as of Januarv 1St 1958, to employees and officials thereof in the position of fireman and not excluded by law nor excepted herein, the benefits of the system of Old Age and Survivors In- surance as authorized by the Federal Social Security Act and amendments thereto, and by Chapter 650, Florida Statutes, as amended; and to cover by such plan all of their services which -2- constitute employment as defined in Section 650.02, Florida Statutes, performed in the employ of said City, except: "NONE" Section 2. The Mayor (or other chief executive officer) is hereby authorized and directed to execute all necessary agree- ments and amendments thereto with the State Agency, and to request the Governor to authorize an employee referendum, for the purpose of extending the benefits provided by said system of Old Age and Survivors Insurance to the employees and officials of said City as specified in Section i hereof, which agreement shall provide for such methods of administration of the plan by said City as are found by the State Agency to be necessary and proper, and, subject to employee referendum, shall be effective with respect to services in employment covered by such agreement performed on and after the ls~ day of January, A.D., 195__8. Section 8. Withholdings from salaries, wages, or other compensation of employees and officials for the purpose provided in Section i hereof are hereby authorized to be made, and shall be made, in the amounts and at such times as may be required by applicable State or Federal laws or regulations, and shall be paid over to the State Agency designated by said laws or regula- tions to receive such amounts. Section 4. There shall be appropriated from available funds, derived from the ~eneral Fund, such amounts, at such time, as may be required to pay promptly the contributions, assessments, and referendum costs required of the City as applicant or employer by State or Federal laws or regulations, which shall be paid over to the lawfully designated State Agency at the time and in the manner provided By law and regulation. Section S. The City shall keep such records and make such reports as may be reGuired by applicable State or Federal laws or regulations, and shall adhere to the regulations of the State Agency. Section 6. The City does hereby adopt the terms, con- ditions, requirements, reservations, benefits, privileges, and other conditions thereunto appeztainlng, of Title II of the Social Security Act as amended, for and on behalf of all its officers and employees to be covered under the agreement. Section 7. The Ci~j.T.reasurer of the City is hereby designated the custodia~ of all sums withheld from the compensa- tion of officers and employees and of the appropriated funds for the contribution of the City, and the City Treasurer of said City is hereby made the withholding and reporting agent and charged with the duty of maintaining personnel records for the purposes of this ordinance. Section 8. In the event that a majority of the eligible employees, as the term "eligible employee" is defined in Section 218(d)(3) of the Social Security Act, at a referendum held pur- suant to the authority of this ordinance, do not vote in favor of making applicable the coverage authorized herein, then the effect of this ordinance shall immediately cease and determine, and moneys withheld, if any, pursuant to Section 3 hereof, shall be refunded.
