AN EHERGENCY ORDINANCE OF THE CI~f C01/KISSION OF
THE CI~f OF DELRA¥ BEACH, FLOKIDA, REQUIRING THAT
ALL APPLICATIONS FOR BUILDING PEBHITS INVOLVING
IHPltO~TS FACING OCEAN BOULEVABD, EFFECTING
PHOPEH~ IN ANY HULTIPLF, FAKILY DWELLING DISTRICT,
ZONE R 3 BE REFERI~ TO THE CITY COHHISSION FOR
ITS APPROVAL BEFOP, E SUCH PERHITS SIt~LL BE GHANTED;
PROVIDING A REPEALING CIAUSE AND FURTHER PROYIDING
A SAVINGS CLAUSE.
WHE~AS, Ocean Boulevard is one of the main therou~ares in
the City of Delray Beach, Florida, and the preservation of the
public health and public safety ape directly concerned with any
buildin~s erected thereon, and
WHEHEAS, the immediate preservation of the public health and
public safety are dependant upon the buildings erected on Ocean
Boulevard,
NOW THEHEF0.HE, BE IT ORDAINED by the City Commission of the
City of Delray Beach, Florida, as follows:
1o That after the 9th day of April~ A.D. 1956~ any application
for a building permit involving /mprovements to be erected facing
Ocean Boulevard within the HULTIPLE FAHILY DWi.LING DISTKICT being
ZONE R 3, shall be referred to the Uity Commission for its approval
~before such permit shall be granted.
2o All ordinances or parts of ordinances insofar as they may
be inconsistent or /n conflict with the provisions of this ordin-
ance are hereby repealed.
3. That if any section, sub-section, paragraph, sentence,
clause or phrase of th~s ordinance or the application of same to
any particular set of persons or circumstances shall for any reaso~
be invalid, such invalidity shall in no wise effect the remaining
portions of this ordinance as to such and the various provisions
of th~s ordinance are declared to be severable.
