A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DELRAY
BEACH, FLORIDA, DECLARING THE NECESSITY FOR PUBLIC
IMPROVEMENTS FOR THAT SEGMENT OF N.E. 2~D AVENUE FROM
ATLANTIC AVENUE NORTH TO THE FIRST ALLEY INTERSECTION,
AND DIRECTING THE ESTABLISHMENT OF A SPECIAL ASSESSMENT
DISTRICT TO DEFRAY A PART OF THE EXPENSE FOR PUBLIC
IMPROVEMENTS TO THAT SEGMENT OF N.E. 2~D AVENUE DESCRIBED
HEREIN; PROVIDING FOR THE ESTIMATED COST OF THE
IMPROVEMENTS; PROVIDING FOR THE PREPARATION OF THE
ASSESSMENT ROLL.
WHEREAS, the City Commission of the City of Delray Beach is
authorized to impose special assessments pursuant to Article 8.4 of the City of
Delray Beach Land Development Regulations and Chapter 170 of the Florida
Statutes; and
~WrIERFA$, the City Commission finds that there is a need for the
improvement of the existing segment of N.E. 2nd Avenue; and
N~-IEREAS, the proposed improvements include the beautification of
that segment of N.E. 2nd Avenue north to the first alley intersection by
narrowing the street, installing paver brick in the sidewalks, and adding trees
and street lights; and
WHEREAS, the special assessment district will begin at the
intersection of Atlantic Avenue and N.E. 2nd Avenue and proceed north on N.E. 2nd
Avenue to the first alley intersection, a distance of approximately 140 feet;
and
WHEREAS, the owners abutting N.E. 2nd Avenue within the special
assessment district shall be assessed, based on front footage, collectively, a
charge of twenty-five thousand ($25,000.00) dollars; and
~HEREAS, the total cost of the improvement is estimated to be
$154,000.00; and
~WHEREAS, the City Commission directs City staff to place on file in
the City Clerk's Office specifications and cost estimates for the improvements;
and
~I-IEREAS, the abutting property owners may pay the special
assessment in one lump sum no later than thirty (30) days following final
consideration of the special assessment after construction is completed or the
property owners may pay the assessment in ten (10) annual installments at an
interest rate of eight percent (8%); and
~HEREAS, the lands upon which the special assessment shall be
levied are abutting upon the street improvements and specifically benefited
thereby by increased property values and further designated by the map and
legal descriptions attached hereto as Exhibit ~A"; and
~VHE~EAS, the City Manager shall prepare and present to the
Commission an assessment roll showing the lots and lands to be assessed and the
amount of the assessment as to each.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the City Commission hereby declares a need for the
public improvements within the special assessment district in conformance with
the above recitals and for the imposition of a special assessment in
conformance with this resolution.

NOTICE IF HEREBY GIVEN that the City Commission of the
City of Delray Beach will hold a public hearing regarding the
establishment of the Pineapple Grove Entrance Special Assessment
District on Tuesday, July 20, 1999, at 7:00 p.m. at the Delray
Beach City Hall, City Commission Chambers, 100 N.W. 1st Avenue,
Delray Beach, Florida.
The Special Assessment District is being established to pay a
portion of the cost of public improvements for that segment of
N.E. 2nd Avenue (Pineapple Grove Way) from Atlantic Avenue north
to the first alley intersection. Ail persons interested are
advised that the description of each property to be assessed and
the amount to be assessed to each piece or parcel of property
may be ascertained at the City Clerk's Office, City of Delray
Beach, 100 N.W. 1st Avenue, Delray Beach, Florida 33444.

Pineapple Grove Entrance Special Assessment District-
Resolution of Necessity
The attached resolution, if approved, will authorize City staff to prepare the assessment
roll, mail notices, and advertise a public hearing for the Pineapple Grove Entrance
Special Assessment District. The total projected cost of the street beautification is
$154,000.00. The property owners will contribute $25,000.00 through the special
assessment process. The City shall contribute $43,600.00, the CRA shall contribute
$50,000.00 and Pineapple Grove Mainstreet shall contribute $36,000.00.
The City Commission must approve the resolution of necessity in order for City staff to
prepare the assessment roll. The City will publish the resolution for two consecutive
weeks after adoption by the Commission.
