BEACH, FLORIDA, URGING THE PALM BEACH COUNTY BOARD OF COUNTY

UNITS (MSTU) STUDY, TO DETERMINE COSTS OF SERVICES FOR
UNINCORPORATED AREAS; THAT A TAX EQUALIZATION STUDY GROUP BE

COUNTY LEAGUE OF CITIES, INC. FOR REFINEMENT OF THE DATA;

(MSTU) study to determine costs of services for unincorporated areas, and that a
Tax ~qualization Study Group be jointly appointed by Palm Beach County and the Palm
Beach County League of Cities, Inc. for refinement and analysis of the data
received.
~ That the City Clerk is hereby directed to distribute copies of
this resolution to each member of the Palm Beach County Board of County
Commissioners and the Palm Beach County League of Cities, Inc.

This is a resolution urging the Board of County Commissioners to proceed with a Municipal
Service Taxing Units (MSTU) study for the purpose of determining whether the costs of services
in unincorporated Palm Beach County are being subsidized by residents within the various
municipalities. It also requests that a Tax Equalization Study Group be jointly appointed by the
County and the PBC League of Cities for refinement and analysis of the data received.
With the vast amount of growth that has taken place in the unincorporated areas over the years, the
demand for services comparable to those provided within municipalities has likewise grown. The
County has tried to use revenues received only from unincorporated areas to offset the cost of
some of these services, but there may be a significant shortfall that must come from the
incorporated areas. The most glaring example is the Palm Beach County Sheriff's Office road
patrol.
In February, I reported to the City Commission that the PBC League of Cities' officers had been
working on this issue for a number of months and had proposed a joint MSTU study with Palm
Beach County. I noted there are five counties in the state that have an MSTU arrangement with
their Sheriff, with the result being that the unincorporated area picks up most of the cost for the
Sheriff's road patrol and reduces the County millage inside cities. The County Commission
authorized the joint study, but later cancelled the project.
Attached is a letter, memorandum and a copy of the resolution recently adopted by the Boca Raton
City Council which provides some additional information on this issue.
I recommend adoption of Resolution No. 32-99 urging the County to proceed with a Municipal
Service Taxing Units (MSTU) study and that a Tax Equalization Study Group be jointly appointed
by Palm Beach County and the PBC League of Cities to then refine and analyze the various data
collected.

RECOMMENDATION: Attached for adoption is a Resolution urging Palm Beach County to
proceed with a Municipal Service Taxing Units Study to determine the costs of services for the
unincorporated areas; and that Tax Equalization Study group be jointly appointed by Palm
Beach County and Palm Beach County League of Cities, Inc.
BACKGROUND: Palm Beach County has experienced dramatic growth in the last 15 years. A
considerable amount of this growth has been experienced in the unincorporated areas of Palm
Beach County. This has forced the County to provide a level of service that is comparable to
that found wdhin municipalities of Palm Beach County Unfortunately, to provide this level of
service, residents within municipalities are directly subsidizing the unincorporated areas Palm
Beach County has recognized this injustice and has tried to utilize revenues received only flora
unincorporated areas to offset the cost cf some of these services. However, there is a substantial
shortfall that must come from the incorporated areas
Those services that can be directly identifiable and are primarily used by unincorporated areas
should be broken down into their own Municipal Service Taxing Units. The most glaring
example of this is the Palm Beach County Sheriff's Office function The Sheriff's Departrnent
is broken down into three functioning components: Law Enforcement, Corrections and Bailiff.
All residents of Palm Beach County directly benefit from the Corrections and Bailiff's
Components. A portion of the Sheriff's Law Enforcement function performs countywide
functions due to economies of scale and the smaller size of municipal police departments. The
tax reduction for municipal taxpayers is estimated over $30 million with Boca Raton taxpayers
reduction to be over $6 million
Earlier this year, the Palm Beach County League of Cities, Inc. proposed that thc County
participate in a joint study, with League and County representation, to examine the possibility
cfa Municipal Service Taxing Units Study. The County Commission authorized the joint
study, but later cancelled the study

Boca Raton City Council approved the attached Resolution on Tuesday, May 11" urging
the County Commission to re-consider the study for a MSTU District. I urge you to
consider bringing this forward to your Council. 1 understand some municipalities (Lake
Wm~ah, Boynton Beach, South Bay) have already approved a similg resolution
