Res 45-99RESOLUTION NO. 45-99 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, PROVIDING FOR THE CERTIFICATION AND ADOPTION OF THE PRELIMINARY ASSESSMENT ROLL FOR THE PINEAPPLE GROVE ENTRANCE SPECIAL ASSESSMENT DISTRICT TO INCLUDE THOSE PROPERTIES BORDERING ON N.E. 2ND AVENUE FROM ATLANTIC AVENUE NORTH TO THE FIRST ALLEY INTERSECTION, AS MORE FULLY DESCRIBED HEREIN; PROVIDING FOR THE ASSESSMENT AMOUNT AS TO EACH PROPERTY; PROVIDING FOR THE METHOD OF PAYMENT OF THE SPECIAL ASSESSMENT; PROVIDING AN EFFECTIVE DATE. WHEREAS, on June 1, 1999, the City Commission adopted Resolution 31-99 which declared the necessity for establisl~.g the Pineapple Grove Entrance Special Assessment District ("District") in order to defray a portion of the street beautification improvements within the District; and WHEREAS, on June 15, 1999, the City Commission adopted Resolution 38-99 which set the date and time for the public hearing at which the City Commission would consider the approval of the District; and WHEREAS, the City Clerk has advertised the public hearing and mailed notices to the property owners to be included in the District; and WHEREAS, the District will include all those properties listed on the assessment roll which is attached hereto as Exhibit "A", and as shown on the map attached hereto as Exhibit "B"; and WHEREAS, the total estimated cost of the beautification improvements is $154,000.00, of which the City has budgeted $43,600.00, the CRA has budgeted $50,000.00, Pineapple Grove Main,street has budgeted $36,000.00 and the property owners will contribute $25,000.00; and WHEREAS, each property owner shall be assessed on foot frontage of the property abutting N.E. 2nd Avenue indicated on the assessment roll, see Exhibit "A"; and WHEREAS, each property owner may pay their assessment in one lump sum no later than sixty (60) days following certification that construction is complete; and WI4~REAS, each property owner rosy pay the sssessm~ in ten (I0) ammal installments st an interest rate of ¢~ght percent (8%), tls indicsted on the amorti~,ntloll tables aU. ached hereto ss Exhibit "C"; WHEREAS, the owner of property within the District for which an sssessment is levied shall thereafter by responsible for payment thereof. That the City Commission of the City of Delray Beach, Florida, following a duly noticed public hearing, does hereby adopt the above recitals as if fully set forth herein. Section 2. The District is being established in order to provide that certain property owners shall contribute to the beautification of the entrance to N.E. 2nd Avenue. Only those property owners abutting N.E. 2nd Avenue shall be specially assessed. The total cost of the project is estimated at $154,000.00, of which the City, CRA and Pineapple Grove Mainstreet shall pay for the majority of the cost. The property owners shall contribute $25,000.00 for this project. At the conclusion of the construction, the City Commission will consider a resolution adopting the construction as complete and confirming the final assessment. The property owners will then have 60 days to pay the assessment in one lump sum. The property owners may also pay the assessment in ten annual installments at an interest rate of 8 %.
