tion as a Condition to Any Person P~acticing Barbering or Any Person
Attempting to Manage or Operate a Barber Shop and Prescribing the
Terms and Conditions, Upon Which the Licenses or Certificates of
Registration May Be Issued to Any Person to Practice B~rbering or
to Manage or Operate a Barber Shop in the City of Delray Beach,
State of Florida. Creating a City Board of Barber Examiners and
Defining and Declaring Its Powers and Duties; Regulating the Prac-
tice of Barbering and Management of Barber Shops by Those Licensed
Hereunder; Imposing Certain Fees Upon Person Applying for License;
or Certificates of Registration to Practice Barbering or Operate or
Manage a Barber Shop of this City and Appropriating the Proceeds
Thereof to Accomplish the Purposes of This Ordinance; and Pre-
scribing Penalties for Violations of the Provision of ~his Ordi-
nance and Regulations Hereunder.

Section 1. It shall be unlawful for any person to engage in the
practice or attempt to practice barbering without a certificate of
registration as a registered Journeymen Barber or a registered
Master Barber issued pursuant to the provisions of this Ordinance
by the Board of Barber Examiners hereinafter established.
It shall be unlawful for any person, firm or corporation
to hire or employ any person to engage in the practice of Barbering
or to manage or operate a Barber Shop as hereinafter defined, unless
such person then holds a valid, unexpired and un~evoked certificate
of registration to practice barbering as a Journeyman Barber or as
a Master Barber issued under the provisions of the Ordinance.

An applicant for a certificate of registration to p~actiee
Barbering in this City who fails to pass_ a satisfactory examination
conducted by the Board must .wait nix months before he is again
entitled to take the e~_nm~uation for a registered barber.
SECTION 4. Any person in qualified to receive a certificate aa
master barber for the operation and management of a barber shop,
(a) Who has p~acticed at least three years an a registered
bs~ber, and
(b) Who has panned a satisfactory examination an ~anter Barber
conducted by the Board to determine his fitness to manage, operate
or act as proprietor for of barbershops, and
(e) Who has complied with the other requirements of Section

SECTION 14. The Boemd shall be authorized to issue three types of
certificate of registration for barbers, as follows:
1. Master bsmber, as defined in Section 2 above.
2. Joumneyman barber, as defined in Section 2 above.
3. Barber apprentice, as defined in Section 5 above.
Such certificates shall be issued for the fiscal year for
which issued unless renewed. Any certificate which is not renewed
for two successive years shall become void, and can only be
issued after re-application and successful re-examination.
No certificate of registration shall be issued by the Bosmd
unless the applicant holds a certificate of registration from the
State of Florida Barbers Sanitax.y Commission, and unless such
applicant shalI have successfully passed a reasonable written exam-
Ination prescribed by the Board as to his fitness and qualifications
to practice the occupation of barbering within the city. In the
case of an application for a master barber certificate, the appli-
cant must have, prior to the date of such application, worked two
years continuous as a Joua~ne~ barber in an area or community
having requirements similar to the provisions of this chapter. All
applications shall be accompsnied by an examination fee of

first certificate of registration issued as a result of any appli-
cation and examination hereunder, and a yearly renewal fee of $1.00.

SECTION 15. Each of the following shall constitute a misdemeanor
and be punishable upon conviction by imprisonment in the City Jail,
for not more than Two months or by fine not exceeding Fifty Dollars
($50.00), or by both such fine and imprisonment in the discretion
of the City Co~t.
(a) The violation of any of the provisions of section 1. of this
Ordinance.
(b) Permitting any person in one's employ, supervision or control
to practice as an apprentice unless thet person has a certificate
of registration as a registered apprentice.
(c) Obtaining or attempting to obtain a certificate of registration
for money other than the rec~ired fee, or any other thing of value
ox. by fraudulent ~lsrepresentatton.

SECTION 19. The board of barber examiners shall remit all fees
collected by them, as provided in this article, to the general fund
of the treasux~ of the city. Such board shall regularly, on the
first day of each calendam month, file with the city treasurer of the
city a statement of all fees~remitted,~~a,'
REGULATIONS. INSPECTIONS ETC.,
SECTION 20. It shall be unlawful:
(a) For any barber or apprentice to knowingly continue the practice
of barbering while such person has an infectious contagious or
communicable disease.
(b) To own, operate or control any barber shop unless continuously
hot and cold running water be provided therein.
(c) To use upon one patron a towel that has been used upon another
unless and until the towel that has been re-laundered.
(d) Not to provide each chair with a fresh and clean paper o~ each
head-rest for each person.
(e) To use in the practice of barbering as hereinafter defined,
any steptic pencil, finger bowl, sponge, lump alum or powder puffs.
(f) Possession of a steptic pencil, finger bowl, sponge, lump alum
or powder puff in a barber shop is prima facie evidence that the
same is being used there in the practice of barbering.
(g) Not to place around the patrons neck a clean and sanitary neck
band so that the hair-cloth does not come in contact with the neck
or skin of the patrons, body.
(h) To use on any patron any tool or inatx-ument that has not been
properly sterilized before each such use.
(1) All sterilizing solutions shall be two per cent carbolic acid
or its equivalente
(J) The lack of proper sterilizing equipment in ar~ barber shop
shall be prima facie evidence that sterilization is not being
practiced therein.
(k) For any person to operate or attempt to operate any barber shop
in any room that does not contain at least MOO cubic feet
space for one chair and eight hundred al cubic feet for each addi-

Sec. 2J- Conditions P~ecedent to Issuance of Occu ational Licenselons'
(a) No occupational license shall be issued to any barbershop,
nor to the manageror owner of any ba~bex'shop within the city where
"barbering" as defined hex'sin is practiced c~ eax~ied on, unless such
shop has complied with and meets the requirements of the regulations
of this ax'title and of the laws of the State of Florida regulating
ventilation, sanitation and surroundings, nor until such barbershop
shall have been approved by the city health officer and the board
as to compliance with health and sanitary regulations of this ax'ticle,
including the follceing:
1. ~uch shop shall be px'ovided with continuous hot and cold
watex'.
2. Ail shops shall have a dix'ect outside entx'anee, either on
the six'est, on a hotel lobby, or public hallway, or ax'~ade·
3, Ail shops s~all be not less than ~welve feet wide, and with
ceilings of not less than eight feet, and shall ~ave non-pox'ous floors.
4. Ail shops z~mst be e~uipped wi~ at least one toilet fox. the
use of customers, and such toilet must be maintained in sanitax.y
condition, a~d directly connected or readily accessible to the exclusive
use of the customers of such shop.
5. Mobile or portable barbershops, ox. barbershops located in

(b) Compliance with the provisions of th~s seot~on shall be
evidenced by a sanitary per~L~t to be issued by tho boo~d, end before
an occupational license shall be issued to any barbershop in any
year, there must be in existence and exhibited to the ~x collector
a current sanitary pexmit as to such shop issued by the beard
showing that such shop complies with the p~evisions of this article,
and of Section 2 (a) 1. through 5. above. Such permit shall issue
yearly without cha~ge, and shall be displayed in a prom~mant place
in such shop. Non-comglianee with any of the provisions ~f this
a~tiole shall be grounds for canceling such permit. It shall be
unlawful for any person to operate a barber shop unless there shall
be in existence a currently effective sanitsmy pex-s~t therefor.
(c) Ail master bambers owning or operating shops in the city
shall comply with the following sanitary regulations:
1. No shop shall per~ait a towel that bas been used upon one
customer to be used upon another customer prior to such towel being
re-laundered.
2. No hair cloth shall be used upon any patron having a
haircut unless there has been placed about the neck of the patron a
strip of cotton, towel or neckband preventing such haircloth from
coming ~_nto direct contact with the skin of the patron.
3. No shop shall use any giner bowls, sponges, lump alum
or powder puff upon any pat~on.
4- Fo shop shall use on any patron any razors, scissors,
tweezers, combs, rubber discs or parts of vibrators, or any other
equipment after the same shall have been used, or may have come in
contact with another patron, unless the same sb_-_ll have first been
kept in a closed compartment and immersed in boiling water or a
solution of csmbolic acid, or its equivalents
5. No person shall be employed in any barbershop in any
capacity who has any contagious, infectious, or communicable
disease, nor unless such person has in his possession a certificate
from some physician that, 'as of a date not less recent than 90 days,
he is free of all such diseases.
6. No person engaged in camrying on or practicing barbering
shall shave any person, or d~ any barber work of any kind upon any

Except as provided in Section 5 hereof, no person shall
engage in, cm~y on or practice the business of 'barberinge in the
city unless and until such person shall have obtained a certificate
of registration to be issued by the board of barber examiners as
provided in Section 6.[~ of this Code.
Except as provided in Section 5 hereof, no owner or operator
of a barbershop within the co~-porate limits of the city shall employ
any person, or permit any person to work or practice the business
of Nbarbering" within any shop conducted by such owner or operator,
unless and until such person shall have obtained a certificate of
registration to be issued by the board of barber examiners as pro-
vided in Section [~ of this Code.
Sec.~ - Tempor.ax-y Wo.~.k~...ng Pe .r~ita: One. onl~ per Shop.
(a) ~h~re any Jou~neym._~_~ barber or apprentice who holds a
currently effective certificate of registration f~om the Barbers
Sanitar~ Commission under the laws of the State of Florida, and who
has made written application to the board for a certificate of
registration under this a~ticle, the board shall be authorized to
issue a temporary working per,Lit to such person good for 30 calendar
days or until the results of the examination to be taken by the
applicant are available, whichever period be aborter. Such temporax-y
working permit shall be denominated either a Journeyman or apprentice
permit, as the case may be, and the fee to be paid tho board there-
for shall be $1%.00 for a Journe2man, and $10.00 for an apprentice.
Each such permit shall describo the shop in the c~ ty whore the person
named thereon is to be employed, and its use at any other shop shall
be void, unless such change is approved in writing by the board.
(b) No shop in the city shall at any time have in its employ
more tlmn one person with a temporar2 working pex~uit,

examine and ir~pect, from time to time, all barbershops operating

in the city and for this puA'pose the board shall have and is hereby
given authority to e~ter and inspect any barbershop at any time when it
is open for the transaction of business.

It shall be the duty of the board of barber examiners to
report to the chief of police of the city _~y violation by any bar-
bet or barbershop of any of the provisions of this ax-tiele.
Sec. ~$- R~e~al' .xnd Revo,cat.ion of Certifica.tes of ~egistra_tion.
It shall be the duty of the board of barber examiners to refuse
to issue any certificate of registration and to revoke any such certi-
ficate previously issued for any of the g~ounds described in Section
476.14 Florida Statubs 1949. No such certificate of registration,
however, shall be revoked unless written charges under oath shall be
filed with the secretary of the board against the holder of such
certificate, and unless the holder of such certificate shall be given
at least (10) days notice in w~iting that a hearing will be held by
the board upon such charges. In any such hearing the boax~ may ad-
minister oaths, and may procure by its subpoena attendance of wit-
nesses or production of relative books and papers, and the person
whose certificate is involved shall likewise have the right to
quest attendnace of witnesses and to produce any testimony, or to
cross-examine the beard, s witnesses. If, within ninety (~0) days
after the revocation of any certificate of registration, the person
involved shall by application and proof disclose to the satisfaction
of the board that the disqualification or fault fc~ which such certi-
ficate of registration shall have been revoked has been removed, the
board shall be authorized to renew such certificate of registration,
with or without examination, as it shall deem proper, but subject
to the payment of fees as hereinp~ovided. ~,/~
