Ord G-170(17-53) OEDINANCE NO.. ~l?O _ ~ERGENCY ORDINANCE OF THE CITY COUNCIL OF T~ CITY OF DELSEY BEACH, FLORIDA, PROHIBITING ABAh~1)O~T OF ICE BOXES Ah~ EEFRIGERATORS ACCESSIBIE TO CHIIDHEN. WHERF~S, an emergency exists in the City of Delray Beach, in that instances trove been reported in other cities of death due to suffocation of children in abandoned, unattended ice boxes, refrigerators and other containers having air-tight doors which when closed cannot be opened from the inside~ ~ERF~S, these abandoned, unattended or discarded ice bo~s, refrig- erators and other containers are a constant menace to the health, welfare and safety of children in the City of Delray Beach; N~.~, TP~REFO~, BE IT ORDAI~ED B~!~ THE CITY COUNCIL OF THE CITY OF DML~Y BEACH, FLORIDA: Section l~.' It shall be unlawful for any person, firm or corporation to leave outside of any building or dwelling in a place accessible to children any abandoned, unattended or discarded ice box, refrigerator or any other container of any kind which has an air-tight door, or lock which may not be released for opening from the inside of said ice box, refrigera- tor or container. Section 2~:~ It shall be unlawful for any person, firm or corporation to leave outside of any building or dwelling in a place accessible to children any abandoned, unattended or discarded ice box, refrigerator or any other container of any kind which has an air-tight snap-lock or other devise thereon without first removing the ~id-~ 1~1~ ~.~ door~ from said ice box, refrigerator or container. Section ~: Any person, firn~ or corporation violating any of the pro- visions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof sh~ll be fined not exceed $500.00 or by imprisonment for not in excess of 90 days. Each day such violation is committed or permitte~ to continue, sh~ll constitute a separate offense and shall be punishable as such hereunder.
