Ord G-181(28-53) ORDINANCE NO. AN ORDINANCE GOVERNING THE INSTALLATION, REPAIR AND MAINTENANCE OF OUTSIDE TELEVISION ANTENNA AND, OR T~ER INSTALT~TIONS WITHIN THE CITY LIMITS OF DELRAY BEACH, FLORIDA. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, as follows: ~SE~I~ .1.~.: That for the protection of life and property and in the best interest of public safety, the following rules shall be adopted. SECTION 2: These specifications shall apply to aL1 Television and Radio installations: A. Nmsts and Tower shall be of corrosion resistant material and approved type. When a mast or antenna is installed on a roof, it must be supported on its own platform and securely anchored with guy wires. B. Guy Wires shall be of corrosion resistant material and when anchored in to masonry shall be mounted with lead anchors or lead expansion shields. C. Transmission lines must be of approved type, and must be kept at all times free from electric and telephone wires and must be so secured that they cannot swing closer than 2~ to power lines carrying 250 volts or less, or closer than 10t to lines carrying over 250 volts. D. Guy wires shall be placed at intervals close enough to guarantee support sufficient to withstand hurricane winds. E. ~inimum spacing for guy wires shall be as follows: 2" pipe every 20, in 3 directions; 1~~ pipe every 15' in 3 directions; 1" pipe every 10t in 3 directions. F. Every mast or antenna shall be permanently grounded by approved methods. G. The current issue of the National Electric Code is hereby adopted and approved as a part of this Ordinance as a minimum standard for any item not specifically covered herein. H. No mast for the support of antennas shall be erected within the distance of its height plus 6~ of any wires operating in excess of 600 volts, unless the antenna is lower than the wires operative in excess of 600 volts or by written consent of the Inspection Department. (1) SECTI~ON 3: PEHM~ITS _& FEES: Permits shall be obtained from the office of the Electrical Inspector. Ail installations shall be inspected by the Electrical Inspector. The fee for each installation shall be $2.00, EXCEPT that re-inspections caused by: (a) Wrong address on application; (b) Installation found faulty upon first eF~m~nation; (c) Corrections not made when re-inspection is requested; shall each be subject to a further inspection fee of $1.00. ~ Inspection ~f existing, antenna. All outside antenna for television receiving apparatus or equipment now maintained and in use within the City of Delray Beach shall be inspected by the Electrical Inspector within a reasonable time hereafter, and when the installation of such antenna is found to be in a dangerous or unsafe condition, the person, firm or corporation ow~g, using or operating the same shall be notified in writing and shall make the necessary repairs or changes required to place such installation in safe condition and have such work completed within thirty days or any longer period specified by the Electrical Inspector in said notice. After completion of repairs, if the installation of such antenna is found to comply with the provisions of this ordinance, the Electrical Inspector shall issue a certificate of approval to the ~ner, and no fee shall be charged for such inspection or certificate. However, in the event subsequent inspections are required, the re-inspection fee hereinabove specified shall be paid. ~ _PE~ALT~S~: Any person, firm or corporation who shall violate any of the provisions of this ordinance, shall be guilty of a mis- demeanor and upon conviction thereof shall be punished by a fine of not more than ONE HUNDRED ($100.00) DOLLARS for each offense, together with costs of the prosecution, and in default of payment thereof, by imprisonment for not more than FIFTY (50) DAYS, or by both such fine and imprisonment, in the dis- cretion of the Court. SECTION 6: UNCONS.TITUTI~ONAL CLAUSE: In the event any section, paragraph, sentence, clause or portion of this ordinance shall for any reason be held unconstitutional, invalid or ineffective, the same shall not repeal, nulify, or in any mmnner affect any other section, paragraph, sentence, clause or portion of this ordinance.
