Ord G-144(14-52) EMERGENCY ORDR~ANCE NO. G-11~ AN EMERGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY REACH, FLORIDA, AMENDING PARAGHAPH (b), AS AMENIED, OF SECTION 5 of CHAPTER XX OF THE CITY CODE OF THE CITY OF DELRAY BEACH, FLORIDA, DEFINING THE SET BACK ON ATLANTIC AVENUE, EAST OF U.S. HIGHWAY NO. 1 TO HIGHWAY A-1-A. WHEREAS, an emergency exists in the City of Delray Beach, Florida, in that, within the business district east of U.S. Highway No. 1 to Highway A-I-A, along Atlantic Avenue, the said right of way of Atlantic Avenue varies in width, being fifty-eight (58) feet in some instances and siXty-six (66) feet, seventy (70) feet, and eighty (80) feet in other instances; and WHEREAS, prior to the present widening effort, a sixty-six (66) foot width prevailed throughout 94% of the said right-of-way, which, being thirty-three (33) feet either side of the center line of said right-of-~-my, established, under the terms of Paragraph (b), as amended, of said Section 5, Chapter XX of the City Code, a building set-back line ten (10) feet back from the right-of-way line which is to say, forty-three (43) feet from the center line; and WHEREAS, it is deemed necessary for the preservation of the public health, property, safety and welfare, that a uniform set back line be redefined along the said Atlantic Avenue in order to assure property owners thereof that the widening of the street, as now contemplated, to the width of eighty-(80) feet will not effect the previously established building line; NO~, THEP~EFOF~, BE IT ORDAINED by the City Council of the City of Delray Beach, Florida, as follows: SECTION 1. That paragraph (h) of Section 5 of Chapter XX, as amended, of the City Code of the City of Delray Beach, Florida, be and the same is hereby amended by adding the following provision, to wit: "~ithin the business district along Atlantic Avenue, east from U.S. Highway No. 1 to Highway A-I~, all commercial buildings shall be set back forty-three (43) feet from the center line of the said Atlantic Avenue." SECTION 2. All Ordinances and parts of Ordinances in conflict herewith are hereby repealed. SECTION 3. This is an emergency ordinance and shall take effect upon its passage on first and final reading. PASSED in regular session on first and final reading on this the 8th day of September, 1952.
