A RESOLUTION OF T~E CITY COMMISSION OF THE CITY OF
DEL~AY BEACH~ FLORIDA, RATIFYING RESOLUTION NO.
47-87, DECLARING CERTAIN AREAS AS BLIGHTED OR SLUM
AREAS AS DEFINED IN CHAPTER 163, PART III, FLORIDA
STATUTES OR AREAS IN WHICH THERE IS A SHORTAGE OF
HOUSING AFFORDABLE TO RESIDENTS OF LOW OR MODERATE
INCOME INCLUDING THE ELDERLY, OR A COMBINATION
THEREOF; DECLARING A NEED FOR REHABILITATION OF SUCH
AREAS; AMENDING T~E BOUNDARIES OF T~E COMMUNITY
REDEVELOPMENT AREA; PROVIDING FOR A}l EFFECTIVE DATE.
WHERF2%S, the City Commission of the City of Delray Beach,
Florida, did, on May 14, 1985, adopt Resolution No. 32-85 finding that
one or more slum and blighted areas as defined in Florida Statutes
Section 163.340 or areas in which there is a shortage of housing afford-
able to residents of low or moderate income, including the elderly, or a
combination thereof, exists in the City of Delray Beach; and,
WHEREAS, the City Commission' of the City of Delray Beach,
Florida, has found and declared in Resolution No. 32-85 that a need for
rehabilitation, conservation or redevelopment, or a combination thereof,
%s necessary in such areas ~n the interest of the public health, safety,
morals, or welfare of the residents of the Cit~ of Delray Beach; and,
WHEREAS, the City Commission of the City of Delray Beach,
Florida, has found and declared in Resolution No. 32-85 that there is a
need for a Community Redevelopment Agency to function in the City of
Dulray Beach to carry out the Community Redevelo~ent purposes of
Chapter 163, Part III of the Florida Statutes; and,
WHF_REAS, the City Commission of the City of Delray Beach,
Florida, by Ordinance No. 46-85, adopted June 18, 1985, did create a
Community Redevelopment Agency as provided in Florida Statutes Section
163.356; and,
WHEREAS, on December 23, 1986 the Board of County Commis-
sioners of Palm Beach County passed and adopted Resolution No. R-86-2003
delegating the exercise of the powers conferred upon ~he County by
Chapter 163, Part III, Florida Statutes, within the boundaries of the
City of Delray Beach to the governing body of the City of Delray Beach
completely and without limitation; and,
WHEREAS, the City Commission of the City of Delray Beach,
Florida, hereby passed Resolution No. 47-87 finding that one or more
slum and blighted areas, as defined in Florida Statutes Section 163.340,
or areas in which there is a shortage of housing affordable to zesidents
of low or moderate income including the elderly, or a combination
thereof, exists in the 103 acre area within the City of Delray Beach as
described more' fully in Appendix A of this resolution and that a need
for rehabilitation, conservation, or redevelopment, or a combination
thereof, is necessary in such areas in the interest o~ the public
health, safety, morals, or welfare of the residents of the City of
Delray Beach; and,
W~IEREAS, certain properties located in the 103 acre area
within the City of Delray Beach as described more fully in Append/x "A"
of this resolution were county Dockets not within the jurisdiction of
the City of Delray Beach; and,
WHEREAS, pursuant to the Delra¥ Beach Enclave Act (Chapter
B6.447, Laws of Florida) and voluntary annexations, many of the county
pockets within the area described in Appendix "A" hereto have been
annexed into the City of Delray Beach and are now subject to the City's
jurisdiction.
WHKREAS, the City Commission of the City of Delray Beach finds
that the area delineated in Resolution No. 47-87 zemains in the substan-
tially same condition as it existed at the time Resolution No. 47-87 was
proposed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section i. That the area of the Cit~ of Delray Beach more
fully described in Appendix A is hereby found and declared to be a slum
and blighted area, aa defined by and within the purposes and intent of
Florida Statutes, Chapter 163, Part III.
Section 2. That the rehabilitation, conservation, and rede-
velopment, or a combination thereof, of such area is necessary in the
interest of the public health, safety, morals, and welfare of the
residents of the City of Delray Beach.
Section 3. That the Delray Beach community Redevelopment
Agency as constituted by Ordinance No. 46-85 is authorized to carry out
the comunity redevelopment purposes of Chapter 163, Part III of the
Florida Statutes in the area described in Appendix A.
Section 4. That the boundaries of the conmm/nity redevelopment
area as established in Resolution 32-85 as amended by Resolution 9-86 be
further amended to include the area described in Appendix A of thiu
resolution.
Section 5. That Resolution No. 47-87 is hereby ratified and
all properties lying within the area described in Appendix A are subject
to exercise of rights, powers, and privileges granted by Chapter 163,
Part III of the Florida Statutes upon the latter date of the passage of
Resolution No. 47-87 or the properties annexation into the City.
Section 6. That as to any properties lying within the area
described in Appendix A which are annexed into the City subsequent to
the date of passage of this resolution that said properties shall be
subject to the exercise of the rights, powers and privileges granted by
Chapter 163, Part III of the Florida Statutes at the time of their
annexation if the . City Cormmission determines that slum and blighted
conditions remain.
Section 7. That the City Clerk be directed to forward a
certified cody of this resolution to the Palm Beach County Tax
Appraisers Office.
Section 8. ~lat this resolution shall become effective
immediately upon passage.
