AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH,
FLORIDA,REQUIRING ALL BUILDINGS IN ALL BUSINESS ZONES TO BE SET
BACK A MINIMUN OF TEN FEET FROM THE RIGHT OF WAY LINE OF ABUTTING
AND IMNEDIATELY ADJACENT STREETS; PROVIDED, HOWEVER, THAT SUCH
SETBACK REQUIREMENTS SHALL NOT APPLY TO ATLANTIC AVEN~JE, SIXTH
AVENUE (U. S. HIGHWAY NO. 1), BRONSON AVENUE, SALINA AVENUE, PALM
AVENUE AND PALM STREET.
BE IT ORDAINED by the City Council of the City of
Delray Beach, Florida, as follows:
SECTION l~~ That any building constructed or erected
i in any business zone in the City of Delray Beach, Florida, shsll
~be set back a minimum of ten feet from the right of way line of
~labutting and immediately adjacent streets; provided, however, that
~such setback requirements shall not apply to Atlantic Avenue,
Sixth Avenue (U. S. Highway No. l), Bronson Avenue, Sslina Avenue,
Palm Avenue and Palm Street.
SECTION o~. In interpreting and applying the provi-
!'slons of this ordinance, they shall be held to the minimum require-
!merits adopted for the promotion of health, safety, morals, comfort,
ti convenience or general welfare. The lot or yard areas required
~by this Ordinance for a particular building shall not be diminished
..and shall not be included as a part of the required lot or yard
i areas of any other building. This ordinance shall repeal ~ny
!ordinance or ordinances or part or parts thereof in conflict here-
with.l
SECTION 3. Any person violating any of the provisions
of this Ordinance shall, upon conviction thereof, be punished by a
ilfine not exceeding $000.00 or by imprisonment for a period not
exceeding ninety days, or by both such fine and imprisonment, in
the discretion of the Municipal Court.
