AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
DELRAY BEACH, FLORIDA, PROVIDING FOR THE CERTIFICATION
AND ADOPTION OF THE ASSESSMENT ROLL FOR THE BANKER'S
ROW ASSESSMENT DISTRICT; PROVIDING FOR RECORDING OF
SPECIAL ASSESSMENT LIENS; AUTHORIZING THE FINANCE
DIRECTOR TO COLLECT THE SPECIAL ASSESSMENT; AUTHORIZING
THE ENFORCEMENT OF UNSATISFIED LIENS; PROVIDING A
GENERAL REPEALER CLAUSE, A SAVING CLAUSE, AND AN
EFFECTIVE DATE.
WHEREAS, the City Commission for the City of Delray Beach,
Florida, is authorized to impose special assessments pursuant to
Article 8.4 of the Land Development Regulations of the City of Delray
Beach; and
WHEREAS, pursuant to Article 8.4 of the Land Development
Regulations, the City Commission did adopt, on February 22, 1994,
Resolution No. 13-94 and Resolution No. 14-94, which declared the
necessity for certain public improvements on N.E. let Avenue, between
N.E. 2nd Street and N.E. 3rd Street; and
Resolution No. 13-94 declared for
WHEREAS,
a
necessity
public improvements to include improved sidewalks and associated
landscaping along N.E. let Avenue between N.E. 2nd Street and N.E. 3rd
Street in Delray Beach, Florida, and established a Special Assessment
District known as the Banker's Row Assessment District ("B.R.A.D.")
for this area; and
WHEREAS, Resolution No. 14-94 declared a necessity for
public improvements to include street paving, street-side parking and
street lighting along N.E. let Avenue between N.E. 2nd Street and N.E.
3rd Street in Delray Beach, Florida, and established a Special
Assessment District known as the Banker's Row Assessment District
("B.R.A.D.") for this area; and
WHEREAS, pursuant to the Tri-Partite Agreement entered into
by the Banker's Row Homeowners Association ("B.R.H.A."), the City of
Delray Beach Community Redevelopment Agency and the City of Delray
Beach, Florida, B.R.H.A. agreed to pay twenty-five percent (25%) of
the construction of the improvements, not to exceed a total of
$32,500; and
WHEREAS, the aforesaid Resolution Nos. 13-94 and 14-94
imposed a special assessment on properties within B.R.A.D. in order to
pay twenty-five percent (25%) of the public improvements which are
part of the Banker's ROw NeighbOrhoOd Plan; and
WHEREAS, pursuant to Resolution Nos. 13-94 and 14-94, the
property owners subject to this special assessment shall each pay nine
(9) annual assessments in the total annual amount of $212.42; and
WHEREAS, the public improvements along N.E. 1st Avenue,
between N.E. 2nd Street and N.E. 3rd Street, were substantially
complete as of June 1, 1994; and
WHEREAS, the City Commission shall examine and approve the
assessment roll for the Banker's Row Assessment District and, subject
to required publication of the roll and notice, shall meet on a
certain date and hour for the purpose of hearing objections to the
assessment roll. If no objections are made by persons affected by the
assessment roll at the time and place specified in the required
notice, or if objections having been made are deemed insufficient by
the City Commission, the Commission shall thereupon adopt an ordinance
levying the assessments as shown by the assessment roll; and
WHEREAS, the owner of each parcel within the Banker's Row
Assessment District for which an assessment is levied shall thereafter
be responsible for payment thereof.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the City Commission of the City of Delray
Beach, Florida, does hereby adopt the aforementioned preamble in its
entirety.
Section 2 ..... That the City Commission of the ~--~ of Delray
Beach, Florida, hereby adopts and certifies the assessment roll for
the Banker's Row Assessment District, as set forth in Exhibit "A"
hereto which is incorporated herein.
Section 3. That the City Clerk is hereby directed to record
a lien in the Public Records of Palm Beach County, Florida, for each
of the properties listed on the assessment roll attached hereto as
Exhibit "A" in an amount equal to the "Total Assessment Amount"
indicated on the assessment roll. The lien shall be enforceable
pursuant to Article 8.4 of the Land Development Regulations of the
City of Delray Beach, Florida, including the collection of attorneys
fees in the event the lien remains unsatisfied at the conclusion of
the assessment period.

Section 4. That the Finance Director is hereby directed to
collect, on an annual basis, from each of the properties listed on the
assessment roll the amount indicated as the "Annual Assessment
Amount" At the time when the assessment is paid in full, the Finance
Director shall notify the City Clerk who shall record a Satisfaction
of Lien in the Public Records of Palm Beach County, Florida.
Section 5. That all ordinances or parts of ordinances in
conflict herewith be, and the same are hereby repealed.
Section 6. That should any section or provision of this
ordinance or any portion thereof, any paragraph, sentence, or word be
declared by a court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remainder hereof as a
whole or part thereof other than the part declared to be invalid.
Section 7. That this ordinance shall become effective
immediately upon passage on second and final reading.

improvements which are part of the Banker's Row Neighborhood Plan
"Banker's Row Obligation."
It is understood that the Banker's Row Obligation creates a
liability for the property owners of Banker's Row to the Community
Redevelopment Agency ("CRA") in an amount not to exceed $32.500
(thirty-two thousand and five hundred dollars). The figure
$32,500 is to be divided amongst the 17 (seventeen) property
owners in Banker's Row, paid out over a period o~ 9 (nine) years.
Consequently, the requisite contribution ~rom each property owner
to pay back the debt to the C~ shall be in the amount o~ $212.42
(two hundred twelve and 42/100 dollars) annually. The guidelines

** FINAL AOREEMENT FOR TAX ASSESSMENT **
We, the property owners of Banker's Row, located on Northeast First
Avenue and bounded by Northeast Second Street and Northeast Third
Street, by and through the majority of signatures appearing below,
hereby agree to incur a previously approved tax assessment in order
to pay 25% (twenty-five percent) of the proposed public
improvements which are part of the Banker's Row Neighborhood Plan
"Banker's R2ow Obligation."
It is understood that the Banker's Row Obligation creates a
liability for the property owners of Banker's Row to the Co~nunity
Redevelopment Agency ("CRA") in an amount not to exceed $32,500
(thirty-two thousand and five hundred dollars). The figure of
$32,500 is to be divided amongst the 17 (seventeen) property
owners in Banker's Row, paid out over a period of 9 (nine) years.
Consequently, the requisite contribution from each property owner
to pay back the debt to the CRA shall be in the amount of $212.42
(two hundred twelve and 42/100 dollars) annually. The guidelines
for exact handling of these monies between the Co~nunity
Redevelopment Agency and the City o~ Delray Beach were outlined in
the previous Statement of Intent and Majority Approval (attached
hereto) and will stand as agreed upon unless otherwise stated
herein.
By signing this Final Agreement for Tax Assessment, I am agreeing
to pay an annual assessment of $212.42 and further, I agree to pay
this amount to the City of Delray Beach Taxing Authority so that
this agreement may be rightfully enforced.

This is public hearing for Ordinance No. 54-94 which certifies

ments along N.E. 1st Avenue between NoE. 2nd Street and N.E. 3rd

street paving, side-street parking and street lighting, as well
as sidewalks and associated landscaping. These resolutions
imposed a special assessment on properties within B.R.A.D. to pay
25 percent of the cost of the improvements at the rate of $212.42
per year for nine annual payments. This is in accordance with
the Tri-Partite Agreement between the Banker's Row Homeowners
Association, the CRA and the City.
The Banker's Row public improvements project was substantially
complete on June 1, 1994. The next step is to formally adopt the
assessment roll through Ordinance No. 54-94. Pursuant to Section
8.4.7 of the LDR, second reading for the purpose of hearing
objections to the assessment roll has been scheduled for this
time. It was passed on first reading on June 7, 1994.
Recommend approval of Ordinance No. 54-94 on second and final
reading.

This is first reading for Ordinance No. 54-94 which certifies and

NOTICE IS HEREBY GIVEN that the Assessment Roll for Banker's
Row Assessment District, as hereinafter set forth, has been
examined and approved by the City Commission of the City of
Delray Beach, Florida. A hearing will be held by the City
Commission for the purpose of hearing objections to the

Mrs. Smith moved to accept the Visions 2005 Policy
Statement in concept, with the understanding that specific issues
requiring Commission direction or approval would be brought back
to the Commission on an individual basis, seconded by Dr.
Alperin. Upon roll call the Commission voted as follows: Mr.

Mayor Lynch expressed the Commission's appreciation to
the Steering Committee for the many hours of hard work and was
optimistic that Visions 2005 will be as successful as the imple-

Assistant City Attorney Tolces read the caption of the
ordinance. A public hearing was held having been legally adver-
tised in compliance with the laws of the State of Florida and the
Charter of the City of Delray Beach, Florida.
Tom Haenlon, 301 N.E. 6th Avenue, pointed out that the
total cost of the entire project was $333,000, which was $41,000
over the projected budget. The cost of the property was $35,000
and the cost of the parking lot alone was $180,000, thereby
bringing the total cost of the entire Banker's Row project to
$548,000. Mr. Haenlon felt that the City should exercise more

oversight over projected expenses of projects which involve the
Community Redevelopment Agency.
The public hearing was closed.
Dr. Alperin moved for the adoption of Ordinance No.
54-94 on Second and FINAL Reading, seconded by Mr. Randolph.

Prior to roll call Mayor Lynch agreed that the Banker's
Row improvement project exceeded the cost originally anticipated
by both the City and the CRA.
10.B. REQUEST FOR WAIVER/DELRAY BEACH YACHT CLUB CONDOMINIUM:
Consider a request to waive the provisions of LDR Section
4.3.4(J) (a) to allow a base grade of seven (7) feet above mean
sea level to be used for determining the height limitation of the
Delray Beach Yacht Club Condominium project located at the north-
west corner of MacFarlane Drive and Ingraham Avenue.
Matt Gracey, representing the Delray Beach Yacht Club
Condominium, stated that the request for the waiver to LDR Sec-
tion 4.3.4(J) (a) is necessary to accommodate the height of the
four-story building so that the roof will not be flat, but will
be aesthetically pleasing and not out of character with the
surrounding neighborhood. He added that allowing a base grade of
seven feet above mean sea level also greatly affects the cost of
flood insurance.
A public hearing was held having been legally adver-
tised in compliance with the laws of the State of Florida and the
Charter of the City of Delray Beach, Florida.
Bill Mudqett, President of the Bar Harbour Association,
supported the request, noting that the units of his condominium
building would be looking down on a flat, unattractive roof if
the waiver is not granted.
The public hearing was closed.
Mayor Lynch announced that he would abstain from the
vote.
Mr. Ellingsworth moved to approve the waiver request to
the provisions of LDR Section 4.3.4(J) (a) to allow a base grade

after the Commission's last workshop meeting the document was
amended to reflect some editorial comments and is before the
Commission for consideration of approval and direction to staff
to forward the document to the School Board and VISIONS 2000.
Mayor Lynch noted that the three groups will hold a
joint meeting with a tentative date of March 23rd, 2:00 - 4:00
P.M..
Mr. Randolph moved for adoption of the Sharing for
Excellence in Schools 1994 Plan, seconded by Mrs. Smith. Upon

WHEREAS, the residents of B.R.A.D., which includes the
residences along N.E. 1st Avenue between N.E. 2nd Street and N.E. 3rd
Street, have petitioned the City Commission to impose a special assess-
ment in order to pay 25% of the proposed public improvements which are
part of the Banker's Row Neighborhood Plan; and
WHEREAS, the estimates cost for the improvements is listed on
Exhibit "A" which is attached hereto and incorporated herein; and
WHEREAS, the Commission directs City staff and the Community
Redevelopment Agency place on file in the City Manager's Office, the
plans, specifications, and estimates of the cost of those improvements;
and
WHEREAS, pursuant to the Tri-Partite Agreement entered into by
the Banker's Row Homeowners Association ("B.R.H.A."), the City of Delray
Beach Community Redevelopment Agency and the City of Delray Beach,
B.R.H.A. agreed to pay 25% of the construction of the improvements, not
to exceed a total of $3.2,500; and
WHEREAS, the property owners, subject to this special assess-
ment, shall each pay nine (9) annual assessments in the amount of
$106.21; and
WHEREAS, after completion of the improvements, the City
Manager shall prepare and present to the Commission a report of cost of
the improvement and an assessment roll showing the lots and lands
assessed and the amount of the assessments.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. The City Commission hereby declares a need for
public improvements along Banker's Row in conformance with the above-
stated recitations and for the imposition of a special assessment in
conformance with this resolution.
Section 2. This resolution shall take effect immediately upon
passage.
