AN F~V'~RGENCY ORDINANCE OF THE. CITY COUNCIL OF THE CITY OF DELRAY BE~iCH,
FLORIDA, REGULATING AND CONTROLLL~G THE USE OF THE CITY DOCKS IN THE
CITY OF DELRAY B~¢CH, FLORIDA 0N THE FLORIDA INTRACOASTAL CANAL.
BE IT ORDAIneD by the City Council of the City of Delray Beach,
Florida, as follows:
SECTION 1. That the City of Delray Beach hereby adopts the
following rates for charges for the use of City docks located on the
Florida Intracoastal Waterway between S. E. First Street and S. E. Second
Street:
CHARGES:
Dock No. i .......... ~.~inimu~ charge of 20 feet
Docks No. 2 to 7, i~clusive . . ~inimu~ charge of ~0 feet.
Docks No. 8 to 19, inclusive . .~nimum charge of 50 feet.
· R~TES:
Rates per week or fraction
thereof .......... .45~ per day per foot
Per month ........... 3$~per day per foot.
The above rates shall include free City ~ater and free garbage
collection, but shall not include electric service for which an additional
charge of 1½¢ per foot per day shall be made.
SECTIOH 2. That the City ~nager be and he is hereby authorized
to appoint a dock master subject to ~he approval of the City Council
at a monthly salary of $60.00. The dock master shall be responsible for the
proper operation and maintenance of the City Docks and shall be given
special police power for the City dock area only. He shall formulate
proper rules and regulations for the opera~ion of City docks which shall
be approved by the City Council, and the failure of any user of the City
dock 'to abide by such rul~ and regulations shall constitute a misdemeanor
snd the violator~ thereof shall be subject to a fine of not exceeding
$50.00 or imprisonment in ~he
~y jail not exceeding 30 days or by both
fine and imprisonment in ~e discretion of the municipal court.
SECTION 3. The City Clerk is hereby directed to furnish the deck
master with proper forms for the registration of each boat using dockage
space at ~he City docks. Such forn~ shall show the ~ame of the boat, the
name of the owner, the dock space a~signed, length of boat, the date and
time of arrival end the dockage fee paid. Al~ fees sh~ll be paid in
advance for the period of occupancy, but no payment shall be required
in advance for more than one month Bt a time. The form to be used by
the dock m~ster will have a clause therein releasing the City from ~ny
liability for any damage caused by the condition of the docks or the
use thereof by the boat owner.
$~CTION 4. The dock master is hereby directed to give preference
in the reservation of dock space to property owners of the City of
Delray Be~ch and to turn over weekly to the City Treasurer all sums
oollected by him for dock rental.
This is an emergency ordinance and its passage is necessary for
the preservation of public property and the proper operation of
municipal docks and it shall become effective upon its passage on first
~nd final reading on this the 6th day of ~anuary, 1947.
