WHE WREAS an emergency exists in the City of Delray Beach, Florida,
due to the fact that the present zoning regulations of the City of
Delray Beach does not allow the repairing of buildings in certain
districts without the relocation of such buildings to conform to the
setback requirements of such regulations, and
V~tEREAS it is necessary for the preservation of public safety
that such r~pairs be allowed without the change ir the setbsck of such
buildings.
NOW, T[~F~EFORE, BE IT OP~DAI~D by the City Co~cil of the City of
Delre. y Eeech, Florida, as follows:
SECTION 1. That sub-paragraph ~ of Paragraph b of Section 5 of
Chapter ~ of the City Code of Delray Beach, Florida, be snd the same
is hereby amended to read as follows, to-wit:
"(4) In modification to the setback requirements specified
above, the setback requirements of any ~rticular lot in any
business, industrial, or manufacturing districts shall main-
rain the minim~ setback requirements as specified above,-
but with the following exceptions; if the setback of the
existing build~ng, on t~e directly adjoining lot, is less
than 5 feet, then the said setbsck may be reduced, providing
it is at least 5 feet greater than the existing adjoining
building.,. ~ further modification of the setback requirements
heretofore specified, on that portion of Atlantic Avenue .from
the Florida Intracoastal Canal to Swinton Avenue, a mini~
front lot line setbsck of 5 feet shall be msintained. Any
existing building may be repaired without changing the front
lot line or side street setback but if the buildi~:~.~
e~-tended, converted, reconstructed and/or remodele~ so as to
change the location of, or alter, any besring wall and/or
increase the cubic content of the building, then such building
shall be set back a minim~ of 5 feet from the front lot line
an5 5 feet from the side street line.'"
