Ord 561-45 ORDINANCE N0. ~ AN ORDINANCE OF THE CITY COUNCIL OF TH~ CITY OF DELRAY BEACH, FLORIDA, CREATING A SPECI3tL HOTEL DISTRICT AND REGULATING, CONTROLLING AND GOVERN' ING THE ERECTION, CONSTRUCTION, SIZE AND USE OF BUILDINGS ERECTED THEREIN. BE IT ORDAINED BY THE CITY COUNCIL of the City of Delray Beach, Florida, as follows: SECTION 1. That there is hereby created in the City of Delray Beach, Florida, a special hotel district which shall be in addition to the other districts created by Section 6 of Ordin- ance 216 of the City of Delray Beach, Florida and the amendments thereto. SECTION 2. Within the special hotel district no building or premises shall be used in whole or in part for any other use than a use permitted in Residence A District, with the exception that apartments and hotels may be erected and maintained therein, provi~®d that such apartments and hotels shall comply with the qualifications set forth in the following Section of this Ordinance. SECTION 3. All apartments and hotels constructed within the special hotel district shall comply with the following restric- tions: (a) No apartment or hotel shall contain therein any place of business which will display merchandise in windows facing the Ocean Boulevard, i.e. State Road No. l&0. (b) All hotels and apartments to be constructed in the special hotel district shall be required to have two side yard set-~$ks of a combined width of 25% of the width of the lot, with a minimum side yard set-back of ten feet on each side and a maximum side yard set-back of twenty feet oR each sides (o). Adequate garage or parking space on owner's property shall be provided for the automobiles of tenants of all hotels and apartment buildings. Apartment buildings shall provide a minimum of one garage or parring space for each apartment in said building, and hotels shall provide garages or park- ing space for 75% of the guest rooms in the hotel. (d) Ail hotels and apartments shall have a minimum height of ~ feet. ~The-maXimum height hotels and apartment buildings shall not exceed {e) Ail hotel and apartment buildings shall have a mimimum front yard set back of 25 feet from the established front building line. (f) Ail hotels and apartment buildings shall have a minimumrea~ yard set-back of 20 feet. (g) Adequ~.te enclosures shall be provided for all service entrances so as to protect the adjoining property. SECTION ~. Ail applications for permits to construct apartments or hotels in the special hotel district shall be accompanied with a scale of the lot or plot plan disclosing the location of the proposed building in regards to the side lot lines, front lot lines and the rear lot lines, and a copy of the plans and specifications of said proposed building drawn and verified by a registered architect or engineer; no building permit for the erection of an apartment or hotel in the special hotel district shall be issued by the Building Inspector until it has been approved by the City Council and by the Hotel Com- missioner of the State of Florida. SECTION 5. If any Section of this Ordinance or if any sub- section of Section 3 of this Ordinance is declared unconstitutional or void, such facts shall not in any way affect the validity of the remaining Sections or portions of this Ordinance. SECTION 6. This Ordinance shall take effect 30 days after. its passage upon second and final reading.
