Ord 539-45AD~ ORDINANCE OF T~E. CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, CREATING CERTAIN NEW BUILDING ZONES, AND PROVIDING FOR DEPTH OF LOTS ~dVD TYPE OF CONSTRUCTION PERMITTED THEREIN ~D FOR FRONT A~D SIDE YARD REQUIRF,~,~NTE. BE IT ORDAI~ED by the City Council of the City of Delray Beach, Florida, as follows: SE~IOI~ 1: That the following zones are hereby created which shall be in addition to the zones already created and designated by Zoning Ordinance No. 216 of the City of Delray Beach, Florida, to-wit: Residence 1 Zone, Residence 2 Zone and Business 1 Zone. SECTION 2: Residence 1 Zone shall conform to the require- ments of Residence A District as provided in Zoning Ordinance No. 216 of the City of Delray Beach, Florida, with the follow- ing exceptions: (a) The minimum floor area of a one-story building shall be 650 square feet and the minimum floor area of the first floor of a two-story building shall be 480 square feet. SECTION 3: Residence 2 Zone shall conform to Apartment House District with the following exceptions: (a} The floor area of buildings shall not be restricted. (b) 0nly two buildings, inclusive of garages, out- houses, etc., shall '0e allowed on any one minimum size lot. (c) Where more than two such houses occur or are planned for any one lot, the regular "Cottage Court" require- ments of Zoning Ordinance No. 216 ~hall ap.ply as to ground area. (d) No two h-.~uses shall be built closer than 20 feet, but projections such as chimneys, roof eaves, and open platforms not over 15 inches above ground shall Oe permitted, provided they provided they do not encroach more than three feet into the said 20 foot space. SECTION 4: Business Zone No. 1 shall conform to Local Business Zone as set out in Zoning Ordinance No. 216, but this zone shall be limited to Residence 1 requirements, except that buildings meeting the Local Business Zone requirements and approved by the Zoning Committee will be permitted. SECTION 5: The front yard requirements for the zones created by this ordinance shall be as follows: (a) Residence i shall have a minimum front yard requirement of 35 feet. (b) Residence 2 shall have a minimum front yard requirement of 25 feet. (c) Business Zone I shall have a minimum front yard requirement of 40 feet for residences on Atlantic Avenue; and 25 feet for residences on West 5th Avenue; and 20 feet for business houses on Atlantic Avenue and West 5th Avenue. (d) Where a street is less than 40 feet in width, the front yard requirements of abutting lots shall be increased by one-half the difference of the actual width of the street and 40 feet. Where an adjoining building exists with a set back less than the above, a new building adjoining the existing building shall be required to set back only one-half the additional set back called for by this subsection of this ordinance. SECTION 6: In Residence Z.~ne i and Residence Zone 2, a minimum side yard set back of 20 feet shall be ob- served except that a portecochere may project 5 feet into such side yard set back. No building shall be con- structed within 15 feet of any existing building, part of building, porch, garage, or portecochere situated on an adjoining lot. SECTION 7: A minimum lot shall be 50 feet wide and 100 feet deep, or if it is of irregular shape, the aver- age depth and width shall equal that amount. All lots must have a frontage on a public street of not less than 33 feet; existing lots smaller than the minimum lot pro- vided by this Section may be allowed for this purpose, provided it meets the requirements of Zoning Ordinance No.~ . No lot shall hereafter be divided into smaller lots than the minimum required above, nor to a size less than 5000 square feet in area. SECTION 8: The following territory in the City of Delray Beach, Florida, shall be included in the zones created by this ordinance: (a) Zone i includes all property in the City of Delray Beach, Florida, facing N. W. 2nd Street from N. W. 2nd Avenue to the Right-of-Way of the Seaboard Air- ~ line Railway; all of Blocks ~1, ~2, and ~3; Lots 1 to 6, inclusive, of Block 4~; all of Blocks 3~, 3~, 39 and the ~ East half of Block 32; East half of Block ~, Tourist Nook ~ ~bdivision; the West half of Blocks i a~d 2, and the West half of the South half GA~ ~,~..~ 5, Section S, Township 46 S, Range 43, E. (b) The following territory in the City of Delray Beach, Florida, shall be included in Residence 2 Zone, to-wit: All such property lying between Blocks 37, 3~, 39, 41, 42, 43, West one-half of Block 44, East one-half of Block 32 and the Right-of-Way of the Seaboard Airline Railroad, except such territory as is specially designated as being in Residence Zone l, and all of Bus- iness Zone 1. (cD Business Zone i shall include all property in the City of Delray Beach, Florida, lying on both sides of Atlantic Avenue from W. 3rd Avenue west to the Right- of-Way of the Seaboard Airline Railway to a depth of 140 feet north and south of Atlantic Avenue and also the East one-half of Blocks 19, 20, 21 and 22 and the West one-half of Blocks 27, 28, 29 and 30.
