'¢~S an emergency exists in the City of Delray Beach, Florida, due to the fact that no primary election ordinance for the cominM pri~mry election has been adopted, and the adoption of same is necessary for the preservation of public safety, and W[-{~EAS, The City Charter of the City of Delray Beach provides t~at a primary election shall be held in said City two weeks before the first Tuesday in December of every year, and it is f~ther provided by said charter of the City of Delray Beach that the ~ ty Council shall pre- scribe by ordinance the metaod and manner of holding all elections in said city. T~>~0RE, BE IT 0RDAII~ BY T;-~ CI~f C0~C~ of The City of Delray Beach, as follows: ~' . ~ 1st. That a primary election, to nominate candidates for the office of City Councilman shall be held two weeks before the first Tuesday in December of this year and each year hereafter. Such primary election shall be held at such place in the City of Delrsy Beach, Florida as may be designated by the proclamation of the :¢%ayor, calling said election on the date specified between sunrise and sunset. 2nd. Ail qualified electors of the City of Delray Beach, Florida, shall be qualified to vote in said. elections. 3rd. In order to qualify as a candidate in said primary election, the canaidate must file with the City Clerk of the City of Delray~eacn,"'~ ' Florida, at least three weeks before sai~ primary election, a statement in writing under oath that such candidate is a qualified elector of the City of Delray Beach, Florida, is the o~er of improved real estate within the limits of Delray Beach, Florida, ~n8 has owne6 the same for one year prior to tt~e date of announcing his candidacy for the office of City Councilman, that the instrument by v;hich title to real estate is held has been of record in the OYfice of the Clerk of the Circuit, Court of Palm Beach County, Florida, for one year prior to his announcinf¢ his candidacy for the office of City Councillmn aud that he has pal8 city taxes on improves r~;ai estate within the city limit':; of the ~3ity of Delray Beach, Florida, for the preceedina~ year. The candidate must also at such time exhibit to the City Clerk either the original deed or other instrument by which he claims title to real property or a certified copy of the record of t~e same. The City Council shall at its first regular ~eeting after the expiration of the time for qualifying, pass upon the qualifications of the candidates for the o['fice of ~ ty Councilman. Each candidate shall pay to the City of Delray Beach a fee of ~10.00, which sum shall be paid at the time of filing said statement. When this statement hes been filed and the said sum of 310.00 has been paid and the Council has found the candidate qualified under the charter of t~e City of Delray Beach., the candidate shall then be entitled to have his name printed on the primary election ballot. ~th. FO~ COUNC (Vote for ) 5th. The City Council shall aopoint the Clerk and inspectors of saia elections at the sa~e meeting at which the qualifications of candidates are decided. 6th. Such elections shall be conducted substantially on the principles adopted for state elections insofar as the same do not conflict with the charter of the 9ity of Delray Beach, and shall be conducted substantially in the same manner as general~ ..... elections in said city. In the odd numbered years when three councilmen are to be elected, if not more than six candidates qualify for the primary election, then the three candidates receiving the highest number of votes cast in said primary election shall be declared the nominees and entitled to have their names printed on the general.election ballot. If, in such odd numbered years, more than six candidates qualify for the primary election, the six candidates receiving the highest n~muber of votes cast in said primary election shall be declared the nominees and entitled to have their names placed on the general election ballot. In the even numbered years, when two councilmen are to be elected, if not more than four candidates qualify for the primary election, then the two candidates receiving the highest number of votes cast in said primary election, shall be declared the nominees and entitled to have their names printed on the general election ballot. If, in said even numbered years, more than four candidates qualify for such primary election, the four candidates receiving the highest number of votes cast in said primary election shall be declared the nominees and entitled to have their nsumes printed on the general election ballot. 7th. The result of the voting in said primary elections when ascertained, shell be certified by return in duplicate, signed by the clerk and the majority of the~ inspectors of said election, one copy to be delivered to the ?~,~yor and the other to the City Clerk, both of whom shall transmit such returns to the City Council at a called meeting to be held not later than three days after such election. At such meeting the City Council shall canvass~the returns, and in the absence of a declaration of a contest by any of the candidates in such election~ shall declaz~e the result of t.he election by the returns mede by the clerk ~nd inspectors for said election. 8th. The Mayor of the City of Delray Beach shall call all primary elections by proclamation published in s newspaper of general circulation published in the City of Delray Beach, for two consecutive weeks prior to suca election. , 9th.
