AN E~RG['!!NCY ORDINANCE OF THeE CITY OF DELRAY BEACH, FLORIDA, Ai;~,PfDING
ORD]R~ANCE ~L~ER 2&3 IN HEG~D TO TAXES AND LICenSES,
VfHER~S an emergency ordinance exists in the City of Delray
Beach, Florida due to the fact that no provision is made in t~e
License Ordinance for an occupational license for the rental of beech
equipment and delivery of same to the public beach on the Atlantic
Ocean in Delray Beach, Florida, and
V~I{~S it is necessary for the i~nediate preservatio,~ of
public peace, property, health or safety or for the daily operation of
a l;~unioipal Department that this Ordinance be passed as sn Emergency
Ordinance.
NO~? Ti~REFORE BE IT ORDAinED by the City Council of the City
of Delray Beach, Florida, as follows:
That Ordinance ~o. 243 of the City of Delray Beach, Florida
be amended by adding Subsection 35-A i~mediately following Subsection
35 of Section 3 of said Ordinance, w~ich said Subsection 35-A shall
be as follows, to-wit:

The rental of beach equipment where no delivery of the
equipment is made, shall be conducted under a regular merchants
license as provided elsewhere in this Or0inance. Where in
ammition to renting the b~ach equipment, the person renting
same shall aeliver said equipment to t~e public beach on the
Y~tlantic Ocear~, Delray [~each, Florida. He s~all pay an
annual licensee tax of~1500.00.
This is an Emergency Ordinance and shall take ~fect upon its
passage on first reading.
