AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, PROHIBITING THE KEEPING OR HARBORING OF
A BARKING, WHINING AND/OR HOWLING DOG OR DOGS WITHIN THE
CITY LIMITS OF THE CITY OF DELRAY BEACH, FLORIDA, PROVID-
ING FOR THE FILING OF Wl~ITTEN OBJECTIONS THERETO BY THREE
OR MORE RI~IDENTS LIVING W~[THIN ~00 FEET OF PLACE WHERE
SUOH DOG OR DOGS ARE ~T OR HARBORED, PROVIDING FOR TEE
DUTIES OF THE CHIEF OF POLICE IN NOTIFYING VIOLATORS OF
THIS ORDINNNCE AND OBTAINING WARRANT FOR ARREST, AND
PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE.
BE IT ORDAINED By the City Council of the City of
Delray Beach, Florida, as follows:
SECTION 1.
No person shall keep or harbor, within the City
Limits of the City of Delray Beach, Florida, any barking, whining
and/or howling dog or dogs, which cause serious annoyance to
neighboring residents, and interfere with the reasonable use and
enjoyment of their property.

/ ~ Upon the filing with the Chief of Police of this
City of written statements under oath, by three or more persons
residlng in separate households in the City of Delray Beach, Florida,
within ~00 feet of the place where such dog or dogs are kept or
harbored, that the barking, whining and/or howling of such dog or
dogs constitutes a nuisance, it shall be t~e duty of the Chief of
Police to deliver to such person, Keeping or harboring such dog~
or dogs, a written statement of the fact that such complaints nave
been m~de and that the keeping or harboring of such dog or dogs is
deemed a nuisance, and that said nuisance must be abated within ten
(10) days. If said nuisance is not abated within said ten (10) days
it shall be the duty of the Chief of Police to make an affidavit
charging the person or persons, keeping or harboring such dog or dogs,
with maintaining a nuisance, and have a warrant issued for the arrest
of suSh person or persons.
SECTION 3
Any person violating any of the provisions of
this Ordinance shell be punished by a fine of not exceeding
One Hundred Dollars ($100.) or by imprisonment in the City Jail
for not exceeding thirty (30) days or by both such fine end
imprisonment, in the discretion of the Municipal Judge.
SECTION 4
All ordinances or parts of ordinances in
conflict herewith are hereby repealed insofar as they are in
conflict with this ordinance.
