~HER~S an emergency exists in the City of Delray Beach,
Florida, due to the fact that motor buses are traveling upon certain
streets of this City which are not constructed to withstand such
heavy traffic, and which streets are thereby rapidly becoming broken
and otherv~ise deteriorating, and
WHERw~AS, it is necessary for the inm~ediate preservation of
public property that this ordinsnce be passed as an emergency ordinance.
N0¥~, T~EREFORE, BE IT Oi~DAII~ED by the City Council of the City
of Delray Beach, Florida, as follows: -
· Section 1: No motor bus (as defined by Section ~17.01 Florida
Statutes 19~1) shall ooerate or travel on any public street, alley or
other thoroughfare in the City of Delray Beach, Florida, except the
following designated streets, to-wit: - The Ocean Boulevard; the
Federal Highway (also known as 6th Avenue); the Old Dixie Highway
(also known as Sth Avenue); Swinton Avenue; Atlantic Avenue; ~nd the
Germantown Road and South 10th Street.
~ Section ~: Any person violating this ordinance shall be
~unished by a fine of not exceeding ~lO0., or by imprisonment in the
City Jsil for not exceeding thirty (~0) days, or by both such fine and
imprisornuent v~ithin the discretion of the ~Unicipal Court.
Section $: All ordinsnces or parts of ordinances in so far as
the same are in conflict herewith are hereby repealed.
Section ~: This is an emergency ordinance and shall take
effect on its passage upon first reading.
