AN ORDINANCE OF THE OITY COUNOIL OF THE CITY OF D~LRA¥ BEACH, FLORIDA, REGULATING TH~ CHARGES TO BE MADE BY TAXI-CABS A3ID FOR-HIRE ~ ~f0T'OR VF~qICLES, PROVIDING FOR INSURANCE OR BONDING OF SAID VEHICLES FOR THE PROTECTION OF THE PUBLIC, AND PROVIDI~G A PENALTY FOR MIOI~TION OF THIS ORDINAHCE. BE IT ORDAI~PED By the City Council of the City of Delray Beach, Florida, as follows: Section 1. No Saxi-cabs or other motor vehicles transporting passengers for compensation within the city limits of the City of Delray Beach, Florida, except motor buses or other motor vehicles operated on regular schedule routes under or pursuant to certificates of public convenience and necessity, issued by the Railroad Commission of the State of Florida, shall charge not in excess of the following amounts for transportation services. 1. For carrying one or two passengers between the hours of 7 A. ~. and 12 o'clock midnight, the following 8mounts: First mile or fraction thereof from the starting poln~, $.50 Second mile or f~action thereof from the starting point, $. 30 Third mile or fr~ction thereof and all nuiles in excess of three miles from the starting point $.20 2. For carrying one or two passengers between the hours of 12 o'clock midnight and 7 A. M., the following amounts: First mile or fraction thereof from the starting point $. 75 Second mile or fraction thereof from the starting point $. 45 Third mile or fraction thereof from the starting point and each additional mile $.30 3. For each additional passenger over two passengers $.25 4. For each extra stop other than the destination of the person or persons being transported $.25 5. For each depot trip the same charges shall be made as charges for transportation provided in paragraph two above, for transportation between the hours of midnight and 7 A. ~. Additional passengers shall be charged for at the rate of ~35 per passenger and extra stops shall be ch~Pged for at the rate of $.35 per stop. Each passenger shall be allowed one item of ~luggage without extra charge ~but each item in excess of one item per passenger shall be charged for at the rate of $.25 per item. S,.ection 2~. ~No '{axi-cabs or other motor vehicles transporting passengers for compensation withiu the city limits of the City of Delray Beach, Florida, except motor buses or other motor vehicles operated on regular schedule routes under or pursuant to certificates of public convenience and necessity, issued by the Railroad Commission of the State of Florida, shall cherge net less than seventy per-cent (70%) of the char~es set forth in Section I of this ordinance, for the transportation of persons within the city limits of the City of Delray Beach, Florida. ,S. ection 3' The foregoing schedule of charges shall at all times be posted in a conspicuous position in every taxi-cab or motor vehicle being operated for hire in the City of Delray-Beach, Florida. Section 4,,...All taxi-cabs or motor vehicles which are regulated by Sections 1 and 2 of this ordinance shall be insured in a responsible insurance company to be approved by the City Clerk of this city, which insurance shall cover up to the sum of $5000.00 for any one individual; $10,000.00 for total liability to all individuals involved; and $5000.00 for property damage which may incur from the operation of such vehicles. Each such vehicle so operated in the ~City of Delray Beach, shall be insured for not less than said amount ~ in lieu thereof the owner or operator of said vehicle may post a bond with the City of Delray Beach, Florida, in the amount of $15,000.00 for each taxi-cab so operated conditioned to indemnify passengers for injury sustained in operat ion of said vehicle, which bond shall be approved by the City Clerk of the City of Delray Beach, Florida. ,~ection ~. Any person~ wiolating any provision of this ordinance shall be punished by a fine not exceeding $100.00 or imprisonment not exceeding ~0 days, or by both such fine and imprisonment in the discretion of the Municipal Court. ~mOtion 6. All ordinance or parts of ordinances in so far as the same are in conflict herein are hereby repealed. PASSED in regular session on second and final reading on this the ~ day of ~ay, 19&3.
