FLORIDA, LIMITI~G ~E NUMBER OF LICENSES FOR ~ SALE 0F
HEFERAGES CONTAINING ALCOHOL OF MOEE THAN 15% BY WEIGHT,
ACCORDING TO THE POPULATION OF THE CITY OF DELRAY BEAOH
ACCORDING TO THE LATEST STATE OR FEDERAL CENSUS."
WHEEEAS, an emergency exists in the City of Delray Beach,
Florida, due to the fact that certain officials of this City
have heretofore misinterpreted Ordinaaoe No. ~21 of this City
entitled #An 0rdinanoe Of ?he City Council Of The City Of
Delray Beach, Florida, Limiting ~he Number Of Licenses For
The Sale Of Beverages Containing Alcohol Of More Than 15%
By Weight, According To ~he Population Of The City Of Delta y
Beach, According To The Latest State Or Federal Census' and
there have been issued more licenses for'tho sale of beverages
containing alcohol of more than 15% by weight than allowed by
said Ordinance, and
~, it has been the intention of this Council to
allow all places of business which were on November 10, 19~1
licensed to sell beverages containing alcohol of more than
15% by weight, to obtain new licenses from year to year as long
as the persons applying for said licenses were found to be
qualified and proper persons to receive said license, and
1V~~, it is necessary for tho immediate preservation
of public peace, property, health or safety of this City that
this ordinance be passed as an emergency ordinance, and
NOW ~Ol~E BE IT ORDAINED by the City Council of the
City of Delray Beach as follows:
1. That paragraph 2 of Ordinance ~21 of the City of
Delray Beach, Florida, entitled uAn Ordinance Of The City
Council Of The City Of Delray Beach, Florida, Limiting The
Number Of Licenses For Tho Salo Of Beverages Containing Alcohol
Of More Than 15% ~Y Weight, Aacorting To The Population Of The
City Of Delray Beach According To ~he Latest ~tate Or Federal
Census.', be and the sane is hereby amended so as to read as
follows, to-wit:
'2. Any person, firm or corporation applying for a
license to sell beverages containing alcohol of moro than
1~% by weight in an establishment for which a
license to sell said beverages of said alcoholic
content was in effect on November 10, 19~1, may
obtain such license for the fiscal year 19~3-19~,
provided the applicant therefor has been approved
by the City Council and may thereafter, on or before
the date of the expiration of any license so held,
have such license renewed from year to year
irrespective of the provisions of paragraph 1 of
this ordinance so long as the applicant therefor shall
be approved by the City Council and so long as
such applicant c~aplies with the other county, municipal
and state regulations in regard to the issuance of
such license. '
2, This is an emergency ordinance and shall take
effect i~anediately upon its passage upon first reading.
