affected by certain deleterious practices, on account
~ve been mulote~ by excessive so-called service oha~ges for t]~
procurement of transportation an~, in s~e i~tances, depttve~ of
passage o~ stea~¢hi~s, airplanes, railroa~ tr~ns, motor busses and
other for~ of public transportation bM an artificially oreate~
shortage of passenger space, seats or acoom:r~da%ions;

transportation services to bo operated afficiant!M and without intar-
~ raud
feranoe, and to protect the ~ublic against ¢ , extortion, exorbit~t
service c~rges and similar abuses;

~ ECT~ON 1. That it shall be u~aw~l for a~ p~rson to
require, chahge or receive a f~e or service charge in excess of
dollar for th6 procurement on behalf of another bM purc~se or other-
wise, of any ticket, reservation or passe~ar accommodation issued
by any co~Ron carrier inclu~i~ a railroad, sleeping car ~upany,
steamship company, air lin~ or c~rtificate~ bus line.
o~CTION~°. It s~.l be u~aw~l for any ~rson~ to sell,
resell, or cause to be r~sol~, ~y ticket, reservation or ~ss~ng~r
acco~o~ation issue~ by any co, on carrier includ~g a railroad,
sleeping car c~psny, ste~ship company, air line or c~rtificatad
b~ lin~, at a pric~ in excess of one dollar over an~ above the
established tariff charge for such ticket, ~e:~ervation or pas~
acco.mmodation as ~ubllsn:d an~~, filed by any coP~on carrier, including
a railroad, s!eepin~ car co,any, steamship corapany, air line or
certificate~ bus line.
SECTION 3. Any person violating the provisions of this
Ordinance shall be guilty of a misdeme.~nor and s"aail, upon conviction,
be punished bM a fine not exceeding one hundred dollars, or by
prisonmemt not exceeding ten (10) days, or in the discretion of the
~unici'oal gudge of the fl. il,~. of Delrav~ Beach,. Florida, may be pnnished
by both such fine and imprisonment, and each prohibited transaction
shall be deemed a separate offense and shall be punishable accordingly.
o,.~CTION 4] The term "oerson" as used in this Ordinance includes
an officer or employee of a corporation or a member or employee of a
partnership who, as such officer, emvloyee or member, is r~sponsible
for the ac% in respect of ,a~hich the violation occ~ms.
SECTION 5. The person responsible for' the management of each
travel a~ency or hoetl operating v~ithin the corporate limits of the
City of De~?ay Beach, Florida, shal~
= cause a copy of this Ordinance
to be posted in a conspicuous place upon the premises of the agency
or hotel for the information of patrons, gmests and r~mbers of the
public at large. The City Clerk shall, upon demand, furnish copies
of the 0rdinmnce for such purpc~es.
o~C~ION 6. If any section, paragraph, clause or provision
of this Ordinance shall for any reason be declared invalid or ~ncon-
stitution~ml, nevertheless the re~ining ,vortions of this Ordinance
shall remain in full force and effect.
