Ord 455-42 AN EMERGENCY ORDINANCE OF THE CITY OOUNCIL OF THE GITY OF
DELRAY BEACH, FLORIDA, PROVIDING FOR THE INOOUIJ~TION AGAINST
RABIES AND LICENSING OF ALL DOGS; PROHIBITING DOGS FROM BEING
ON THE MUNICIPAL BEACH AND BEING IN ANY PLACE OF BUSINESS;
PROVIDING FOR TME~- MUZZLING OF VICIOUS DOGS; AND PROVIDING FOR
A PENALTY FOR VIOLATION OF THIS ORDINANCE.
WEEREAS, an emergency exists in the City of Delray Beach,
Florida, due to the fact that there is no ordinance providing for
the inoculation against Rabies of dogs kept within the City Limits
of this City; and whereas it is necessary for the public safety
and the preservation of public peace that such an ordinance be
passed, now, therefore,
BE IT ORDAINED By the City Council of the Oity of Delray
Florida, as follows:
S~e.ct...ion 1. No dog shall be allowed upon the public streets,
sidewalks, thoroughfares, or other public places, in the City of
Delray Beach, Florida, after October 15, 1952, unless said dog has
been licensed by the City of Delray Beach, Florida, and has an
unexpired City dog license tag affixed to its collar or harness.
The license tax for ~ogs shall be one dollar ($1.00) per year
for each dog and such license shall expire om the first day of
June following its issuance, except that any license issued between
~ 1st amd June 1st of any year shall be valid until June 1st of
the following year.
Section. 2. No licemse shall be issued for any dog kept in
the City of Delray Beach, Florida, unless t~e applicant for such
license shall exhibit to the City Clerk a certificate of a veterin-
arian showing that said dog has been lmoculated against Rabies at
a date later than the first day of ~ay next preceding the time of
such application for license.
S_eotio~ ~. No dog shall be allowed in any public building
in the City of Delray Beach, Florida. No dog shall be allowed in
any place of business in the City of Delray Beach, Florida,
without the permission of the owner or manager of said place of
bus iness.
Sectio. n ~. No dog shall be allowed on the municipal beach
of the City of Delray Beach, Florida.
Sec.t£on ~. AL]. vicious dogs kept in the City of Delray
.Beach, Florida, shall be adequately muzzled iff they appear on
the public streets, thoroughfares, or other public places in this
City. A dog shall be oomsidered a vicious dog if said dog has
attacked or attempted to attack a person on a public street,
thoroughfare, or other public place in thls City, and a complaint
has been made to the Police Department of this City concerning
the same, and the owner of said dog has been notified in writing
by the Police Department of this City of such attack or attempted
attack.
3ect..ion ~.o Any dog found up.on the public streets or
thoroughfares or other public places in this City in violation of
any of the provisions of this ordinance shall be impounded by the
Police Depart~nent of this City. Such animal shall remain impounded
for a period of five (5) days during which time the owner may
secure the release of said animal by paying to the Police Department
of this City a fee of two dollars ($2°00), and twenty-five cents
(256) per day for each day or ~raction thereof said animal has
been impounded. Tn addition thereto, if said animal has not been
inoculated against Rabies and licensed by this City, the owner
must have said an/mai inoculated and must purchase a City license
for said animal before it can be released by the Police Department.
If any animal remains in the custody of the City ~br more than five
(5) days, the owner thereof shall lose all right to said animal
and the City shall proceed to dispose of same, either by sale to
pay the charges against said animal, by turning said animal over
to the Ant~al Rescue League, or by having said animal killed.
Se. ctiqn ? ":'~y person who shall know/ngly allow or
intentionally cause any dog belonging to said person or in the cus-
tody and control of said person to violate any of the provisions
of this ordinance, or any person who shall violate any of the
provisions of this ordinance shall, upon conviction thereof, be
fined not more than fifty dollars ($50.00) or be imprisoned in
the City Jail for not more than thirty {30) days.
