Delray Bead. ch, Florida, as follows:
.~CTION 1
That Ordinance No. 390 of the City Council of the City of Oelray
Be.~ch, Florida, entitled "~ emergency ordinance of the City Oou~cil
of the City of Detray Bead.ch, Florida, regulatin~ fungus a~d/or insect
control, pro~iding for permit to conduct s~ch occupation or 0usiness
in said City, providing for license fee therefor a~d other regulations
in reference thereto" be and the same is hereby araended so that the
following designated sections thereof will read as follows, to-wit:
"Section 1. No person, firm or corporation shall engage in fungus
and/or insect con0roi in or upon any svructure used in whole or in part
for hu~n occupancy in tad Oi~y of Deiray Beach, ~'lorida, without first
obtaini~ a license from sa~d City of Delray Beach, Flori0a. The
annual license fop such occupation and/or profession is hereby fixed
at $25.00 per year."
"Section 2. (a) Obtain a certificate from an %nvestigating Board
which sh~il consist of the Building Inspector, the Fire Chief and the
acting City Engineer of this city certifying to the proficiency of the
applicant in making alterations and repairs to structures".
the Mayor shall be, and he is hereby authorized, empowered and
directed to prescribe such orders, requirements and regulations
as may be necessary to insure the success of blackouts and to
protect life and property during said period.
Section 2. There is hereby created and established
a Reserve Police Force for the City of Delray Beach, Florida.
Applications for membership in said Reserve Police Force shall be
made to the Chief of Police of this city, and the applicant shall
have such qualifications and shall stand such examinations as to
their physical and menDal fitness as may be prescribed~by, the~Chief
of Police who shall also investigate the character and reputation
of applicants for membership in said Reserve Police Force. The
number of men in the Reserve Police Force shall not exceed 25 in
number. They shall be subject to call at any time by the Chief
of Police of this city and will be fully armed and equipped by the

City of Delray Beach. While on duty they shall be paid by the City
of Delray Beach on a basis to be determined by the City Council
of this city. When on active duty said Reserve Police Officers
are hereby required to wear such identifying emblem as may be
prescribed by the Chief of Police, and they shall possess all of
the powers, and perform all of the duties of regular patrolmen
in the standing police force of said city. Before entering on his
duties as a Reserve Police Officer of said city, such officer shall
make oath before the City Clerk ~hat he will uphold and defend the
Constitution of the United States and of the State of Florida, and
will enforce the ordinances of said city, and all lawful orders,
rules or regulations promulgated under authority of the charter
and ordinances of said city.
Section 3. There is hereby created and established
an Auxiliary Police Force for the City of Delray Beach, Florida,
which Force shall not exceed 100 in number. Such Auxiliary Police-
man shall have police authority only during emergencies and when
called into service by the Chief of Police. While in service they
shall have full police authority and shall wear an auxiliary police
arm band which will identify them ~s Auxiliary Policemen. It
shall be unlawful for any of said Auxiliary Officers to attempt
out
to enforce any ordinance or to carry/any order, rule or regulation
of said city while such Auxiliary Police~Officer is not wearing such
identification emblem. Auxiliary Police Officers s~all have such
qualifications and shall stand such examinations as to their
physical and mental fitness as may be prescribed by the Chief of
Police. They shall take the same oath as provided for Reserve
Police Officers. They will receive no compensation from the city
for their services.
Section ~. The City of Delray Beach, Florida, shall
not be liable for any damage sustained to person or p~operty during,
or as the result of, an authorized blackout.
Section 5. ~hen necessary, in order Do protect life
· or property during a 01ackout, the police, the Reserve Police
' Officers and/or the Auxiliary Police herein authorized, are hereby
authorized, empowered and directed to enter upon any premises
within t~e City of Delray Beach in Palm Beach County, Florida, and
to extinguish lights or ~ake other necessary action to make effective
any order, rule or regulation promulgated under ~he authority con-
ferred by this ordinance.
Section 6. Any person who violates any of the pro-
visions of this ordinance, or any order, rule or regulation issued
under the provisions of this ordinance shall be deemed guilty of
, a misdemeanor, and upon conviction thereof, shall be punishable by
a fine of not exceeding Five Hundred Dollars ($500.00), or imprison-
ment in the city jail, for not more than sixty (60) days, or by
both said fine and imprisonment, in the discretion of the municipal
Judge.
Section 7. This is an emergency ordinance and shall
take effect upon its passage upon first reading.
