432-42 ORDINANCE NO..~ AN E~IERGENCY ORDINAte'CE OF T~ CiTY OF DELRAY BEACH, FLORIDA, PROHIBITING THE DISTRIBUTION 0F A~4~f ADVERTISING I',~.AT~ER AI~D/ OR LITERATURE ON CERTAIN oTR_:~ET:~ IN .SAID CITY AI?D ~ROVIDING FOR PENALTY FOR THE VIOL,~_I0~ OF ~AID ~RDI?~AlfCE. ~'~ERE~2~, an emergency exists in the City of Delray Be~'~ch, Florida, due to the fact.that there is no ordinsnce prohibiting the distribution of advertising and/or~ literature upon the main thoroughfares of said city, and ~tEREAS, the distribution of such ~dvertising and/~or literature upon ~O~'~e ~ain thoroughfares of said city constitutes a traffic hazard and endangers the citizens of this co~nnunity and other persons w~o m~y be traveling by car through s~id city, and ;'~',mKEREJbS, it is necessary for the immediate preservation of ~U~lic peace, property, health and safety that such distri- b6tion of advertising and/or literature be prohibited, NOJ, THV~REFORE, BE IT ORDAINED By the City Council of the City of Delray Be,?~ch, Florida, as follows: SECTION L. No person shall ~istribute any advertising and/or literature on Sixth Avenue, also known as the Federal Highway, Fifth Avenue, also knovm as the old Dixie Highway, Atlantic Avenue, and/or the Ocean Boulevard within the City c~ Delray Beach, Florida. ~' ~ ~ECTION 2. Any person violating the provisions of this ordinance shall be punished by a fine of not exceeding $500.00 or by imprisonment in the city jail for a period not e×ceeding 90 days or by 0otb such £ine and imprisonment in the discretion of the i~[unicipal Court. ~ SECTION 3. All ordinances or parts of ordinances in so far as the same are in conflict herewith are hereby repealed. ~ SECTION 4. This is an emergency ordinance and shall take effect upon its passage upon first reading. PASSED on first and final reading on this the 19th day of January, A.
