437-42 AN EMERGENCY ORDINANCE OF THE CITY OF DELRAY BEACH, FLORIDA,
PROHIBITLNG THE TAKING INTO THE POSSESSION OF ANY PERSON ANY
AUTOMOBILE, TRUCK AND/OR TRAOTOR TIRE AND/OR TUBE WITHOUT TEE
CONSENT OF THE OWNER, DEFINING THE SAME AS LAROENI~.~.~;AND PRO-
VIDING A PENALTY THEREFOR.
WHEREAS, an emergency exists ia the City of Delray
Beach, Florida, due to the fact that there is no ordinance
prohibiting the larcemy of automobile, truck ama/or tractor
tires and/or tubes, and
WHEREAS, due to the national rationing of such commodi-
ties, the likelihood of such larceny has been greatly increased,
and
WHEREAS, it is necessary for the preservation of
public peace that the larceny of such commodities be prohi-
bited by city ordinance,
NOW, THEREFORE, BE IT ORDAINED By the City Council
! of the Oity of Delray Beach, Florida, as follows:
· ~ SECTION 1~ From and after this date no person shall,
in the city limits of the City of Delray Beach~ Florida, take
into his possession any~utomobile tire and/or tube, truck tire
and/or tube, and/or tractor tire and/or tube, which is the
property of some other person or corporation, without the con-
sent of the owner thereof.
sECTION ..2... Any person violating the provisions of
this ordinance shall be deemed guilty of larceny of such
article, and upon conviction thereof shall be punished by a
fine of not less than $100.00 nor more than $500.00 or by
impriso-_ment in the City' Jail for not less than 30 days nor
more than 90 days in the discretion of the Municipal Court,
for each such offense. Tha taking of each separate article
shall constitute a separate and distinct offense and may be
so considered by the court in fixing the penalty.
SECTION 3, Ail ordinances or parts of ordinances in
so far as the same are in conflict herewith are hereby repealed.
S. EC. TIO,N 4.. This is an emergency ordinance and shall
~ take effect upon its passage on first reading.
