439-42AN ORDINANCE CONFIRMING AND EQUALIZING ASSESSMENTS FOR THE GRADING AND PAVING OF THAT PORTION OF N. W. 3rd AVENUE FROM ATLANTIC AVENUE TO N. W. 2nd STREET AND N. W. 1st STREET FROM N. W. 3rd AVENUE TO N. W. 5th AVENUE , AND T.I~VYING SPECIAL IMPROVEMENT ASSESSMENTS AS SHOWN BY TEE ASSESSMENT ROLL FOR SAID SPECIAL IMPRO~S; PROVIDING THE METHOD SAID SPECIAL ASSESSMENTS SHALL BE MADE; THE TIME WHEN THE SAME SHALL BECOME PAYABLE; THAT SAID ASSESSMENTS TO BE LEVIED SH~LL BE A LIEN FROM THE DATE OF THE ASSESSMENT UPON THE RES- PEOTIVE LOTS DESORIBED IN SAID ASSESSMENT ROT. T. AND SET FORTH HEREIN; TMI~ MANNER IN WHICH SAID ASSESSMENTS ARE TO BE COLLECTED AND PROVIDING FOR THE ISSUANOE OF SPECIAL CERTIFICATES OF INDEBTEDNESS FOR THE AMOUNT SO ASSESSED AGAINST THE ASSESS- ABLE PROPERTY. WHEREAS, an assessment roll covering the cost of certain street improvements was duly prepared by the City E~gineer in accordance with a resolution adopted by the City 0euncil of the City of Delray Beach, Florida, aggregating Omc Thousand Seven Hundred Seventy-~r%S and 20/100tbs ($1,77~. 20 ), amd said assessment roll was duly publishe~ in the Delray Beach News, a newspaper published and circulated in the City of Delray Beach, Florida, on January $0 and February 6 and 13, 1942, and attached to said assessment roll was a notice reciting that the City Council would sit to hear complaints and as a Board of Equalization on February 23, 1942, at 8:00 P. M., and whereas, the City Council met at the time mentioned in said notice, ts-wit, on the 23rd day of FeBruary, 1942, at the City Hall at 8:00 o'clock P. M., and whereas, no person or persons appeared te object, complain or protest against any of the assessments as published for the street improvements on that portion of N. W. 3rd Agenue from Atlantic Avenue to N. W. 2nd Street and N. W. 1st Street from N. W. 3rd Avenue to N. W. 5th Avenue, and the said assessment roll for said street improvements, as published, was feumd to be correct and the assessments equal and Just and in the aggregate amount of $1,77~.20, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA: S~ect.iqn 1. That the aforesaid assessments, as set forth in the Engineer's report and the assessment roll, an~ published in the Delray Be~Lch News on ~anuary 30, February 6 and 13, 1942, a copy of said assessment ~11, together with the proof of publication being on file in the City Clerk's office, be a~d the same are hereby ratified, approved and confirmed, · nd that said assessments shall be and remain legal, valid and binding liens upon the property against which said assess- monte are made until paid in accordance with the charter of the City of Delray Beach, Florida, and the laws of the State of Florida thereto appertaining. Section 2. That the cost of grading and paving that p~tiem of N. W. 3rd Avenue from Atlantic Avenue ~e~ N. W. 2nd Street and N. W. 1st Street from N. W. 3rd Avenue to N. W. 5th Avenue be and the same is assessed against the property abutting thereon, and the City of Delray Beach have a lien against the following lots or parcels of land for the grading and paving of said N. W. 3rd Avenue from Atlantic Avenue to N. W. 2nd Street and N. W. 1st Street from N. W. 3rd Avenue to N. W. 5th Awenue, as above described. That each of said assessments he payable in ten (10) equal annual installments payable on the 1st day of March in each and every year from the 1st day of March, 1953, te the 1st day of March, 1952, both inclusive, together with interest at the rate of eight percent (8%) per annum from date, provided, however, that the owner of any property assessed shall have the right to pay said assessment in full, together with accrued interest, at any time. .S.~eq.ti.on ~. That said special assessments shall be a lien from the 23rd day of February, 19~2, the date of assessment, upon the respective lots and parcels of land described herein and shall be of the same nature and to the same extent as the lien for city taxes and shall be collected in the same manner and with the same promptness and under the same provisions as to sale and ~erfeiture as City taxes are collectible, provided said assessments may be collected in any other manner and by any other method as may be provided by the charter of the City of Delray Beach, Florida. .S. eCtion 6. The City Council is hereby authorized to issue certificates of indebtedness for the amounts so assessed against the assessable property and separate certificates shall be issued against each tract of land assessed containing a des- cription of the land and the amount of the assessment, together with the general nature of the improvement for which the said assessment is made.
