~ AN EMERGENCY ORDINANCE OF THE CITY OF DELRAY BEACH, IN
PALM BEACH COUNTY, ~LORIDA, AMENDING THAT CERTAIN 0RDI-
NANCE N0. 193, DULY ENACTED SEPTEMBER 13, 1937, RE~_~TING
TO THE SALE OF INTOXICATING LIQUORS AND BEV~ERAGES WITHIN
THE CITY OF DELRAY BEACH, AND PARTICULARLY RE~;~TING TO
LICENSES FOR WHOLESALE AND RETAIL VENDORS OF INTOXICATING
LIQUORS.
~HER~AS an emergency exists in the City of Delray Beach
due to the fact that the latest official census report shows
the population of Palm Beach County to have increased suf-
ficiently to allow an increased license fee to be charged for
the sale of certain intoxicating beverages, and
WHEREAS suffic~nt time does not exist before the com-
mencement of the license year of the City of Delray Beach for
such an ordinance to become effective upon regular passage, and
WHEREAS it is necessary for the immediate preservation of
public peace, property, health or safety, or for the daily
operation of a municipal department that this ordinance be
passed as an emergency ordinance,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
SECTION I
That Ordinance No. 19a duly and regularly passed by the
City Council of the City of Delray Beach on September la, 19~?,
relating to the sale of intoxicating beverages within the City
of Delray Beach, be and the same is hereby amended insofar as
the licenses to be charged and to be paid by persons, firms
and corporations engaged in the manufacture and sale of in-
toxicating beverages is concerned, shall be amended to read
as fo llows:
No person, firm or corporation shall
engage in or manage, carry on or con-
duct the business of retail or whole-
sale vendor, or club, as herein de-
fined, without first obtaining a license
as herein provided, for each location in
the City of Delray Beach; the amount of
such license is hereby fixed as follows:
Wholesale vendor selling liquor, wine,
or beer, regardless of alcoholic con-
tent . . . ....... . . ..... . . . $1,250.00
Wholesale vendor selling bevera~ges con-
raining alcohol of more than 1~ by weight,
and not more than 1~% by weight, and wine,
regardless of alcoholic content . . .... $ ~00.00
Retail vendors, selling beverages con-
sumed on the premises, regardless of
alcoholic content . . . . . . . . . . $ 600.00
Retail vendors selling beverages, re-
gardless of alcoholic content, where the
beverages are sold only in sealed con-
tainers, for aonsumption off the premises $ 450.00
Clubs, as defined herein · ....... $ 125.00
Retail ~ndors selling bevera~?s con-
taining alcohol of more than ~ by weight,
and not more than 14% by weight, and wines,
regardless of alcoholic content . .... $ 15.00
SECTION II
All ordinances, or parts of~ordinances, insofar as the
same are in conflict herewith, are hereby repealed.
SECTION III.
This is an emergency ordinance and shall take effect
upon its adoption upon second and final reading.
PASSED on second and final reading on the llth day
of September, A. D. 1940, at regular adjourned meeting.

THE VARIOUS PERSONS, FIR~B OR CORPORATIONS ENGAGED IN OR

OF DELY~AY BEACH, FLORIDA.

BEACH AS FOT,T.OWS:
Section 1. That Section 62 of Ordinance 243, being an
ordinance of the City Council of the City of Delray Beach,
Florida, fixing occupational taxes and licenses to be charged
the various persons, firms or corporations engaged in or
managing any business, profession, or occupation in the City
of Delray Beach, Florida, be amended so as to read as follows:
"Section 62. BOTTLING PLAI~I'S- Owners or managers
of bottling plants producing soft drinks or bev-
erages of any character whatever, and said plant
operating a machine for capping or sealing bottles
of any style or character, shall pay a license
tax of .................... $ 20.00
Section 2. This amendment shall be retroactive and shall
take effect as of October l, 19~9.
Section 3. All ordinances, or parts of ordinances, inso-
far as the sane are in conflict herewith are hereby repealed.
