376-40ORDINANCE N0.~ AN ORDINANCE OF THE CITY OF DELRAY B~CH, FLORIDA, DESIGNATING CERTAIN DISTRICTS AS DEFI~D BY THE CITY ZONING 10PdPINANCE, AND REPEALING ALL 0RDIEA~CES, OR PARTS OF 0RDINAh~CES, INSOFAR AS THE SAL~ ARE IN COk~FLICT i-~/%E¥~TH. V~tEREAS the City Council of the City of Delray Beach, Florida, desires to have the boundaries of various zoning districts in said city definitely located, and WHER~S said Council also desires to avoid any possi- bility of further errors occuring upon the zoning map of said city, and ~EAS the City Council is of the opinion that the best method of maintaining the correctness of said zoning districts and zoning map is to designate the property em- braced in the various zoning districts of the City of Delray Beach, Florida, now therefore, BE IT ORDAINED by the City Council of the City of Del- ray Beach, Florida, as follows: Section 1. The following property situate in the City of Delray Beach, Florida, and lying East of the Florida intra- Coastal Canal, is hereby designated ~s being in the following districts: (A) S~ecial Residence A. District. Blocks 146, 154, 162; all of Delray Beach Esplanade; all of Ocean Breeze Estates (ex- cept lots l, 2, 3, 4, 38, 39, 40, 41, 30 and 3l); all of block 140 East of Canal (except the South 135 ft.); all of Block 148 (except the South 135 ft.); all of Seabreeze Park (except lots 1, 2, 3, 4, 5 and 6); all of Cowan's Addition; all of Vista Del N~r; all of Beach Lots 1, 2, 3, 4, 7, 8 and 9 (except the West 135 ft. of lots 7, 8 and 9); all property in the City of Delray Beach lying East of the Intra-Coastal Canal and North of N.E. Fourth Street (Market Street); all of Williamson-Diebel Subdi- vision (except lots l, 2, 3 and 18); Beach lots 22 to 26, inc.; all of Nassau Park; all of Wheatley's Subdivision; the South 100 ft. of beach lot 28; all of beach lots 2S, 30, 31 and 32; that property bounded by S. E. Fourth Street on the North, Gleason Street on the West, the city limit-on the South, and the Atlantic Ocean on the East, being the 100 ft. South of S. E. West of the p~operty line of said South Federal Highway is hereby designated as being in Local Business District. ~(F) Manufacturing and Industrial District: All property West of S. E. Second Avenue and East of the Florida East Coast Railway, between S. E. Third Street and S. E. Tenth Street; the West half of block 88; the West half of block 87; all property between S. E. Fourth Street and S. E. Tenth Street lying West of the Florida East Coast Railway and East of a line 150 ft. East of and parallel to South Swinton 'Avenue, is hereby designated as being in Manufacturing and Industrial District. (G) Special Business District: All property adjoining the North Federal Highway between N. E. First Street and N. E. Fourth Street, and extending a distance of 135 ft. East and 135 ft. West of the property line of said North Federal High- v~y, is hereby designated as being in Special Business District. (H) All property in the City of Delray Beach not desig- nated as being in any of the districts heretofore mentioned is hereby designated as being in Residence C District. ~ ~Section 3. All ordinances, or parts of ordinances, in- sofar as the same are in conflict herev~ith, are hereby re- pealed. Ordinance No. 347, passed on January 22, 1940, and Ordinance No. 352, passed on April 8, 1940, are hereby specifi- cally repealed by this ordinance. Section 4. The city building inspector is hereby auth- orized and directed to preserve the city zoning map so that the same will show all property in this city to be in such respective district as is designated by this ordinance, and said city building inspector is directed not to allow any fur- t~her changes to be made in said map unless said changes are properly authorized by ordinance. The city building inspector is, however, authorized to have the zoning map re-copied in case the same has become so worn as to be unfit for use.
