E. ~tlR~~ ST~ET, DELL PA~ S~DIVISION, A~ L~G SPECIAL ASSESSL~I~S AS SH0~ BY ~E ASSESSI,~ ROLL FOR SAID SPECL~L ~R0~E~TS; PROVIDING ~ I~THOD SAID ~EC~L ASS~SI,~TS S~ BE ~,~DE; ~ TI~ ~'~{EN THE SA~E S~ BEC0~ PAYAB~; ~T ~ID ASS~S~I~S T0 BE L~D S~ BE A LI~N FR0~I THE DATE 0F THE ASSESS~ ~0N THE RESPECT~ LOTS DESCRIBED IN SAID ASSESS~T R0~ A~ SET FOR~ HE~; ~ ~R IN ¥~-IICH SAID ASo~SS~S ARE T0 BE COLLECTED Z~ND PROVID~G FOR Tt~ ISSUANCE 0F SPEC~L CERTIFI- CATES 0F INDEBTEDN~S ~0R T~ ~0~T S0 ASSESS~ AGAINST ~ ASSESSABLE PROPER~, Ah~ PR0~DING T~T THE CI~ i~L~Y T~NSF~ A~ DELVER A PORTION 0F SAD CERTIFICAT~ 0F I~DEBTED~SS T0 ~ ~I~T~CTOR IN PA~T 0F SAID SPEC~L ~ROV~TS. ~wo~ ~ WHEREAS, an assessment roll covering the cost of certain improvements was duly prepared by the City Engineer in accordance with a resolution adopted by the City Council of the City of Delray Beach, Florida, aggregating Seven Thousand.Five Hundred and 82/100 Dollars ($7500.82), and said assessment roll was duly published in the Delray Beach News, a newspaper published and circulated in the City of Delray Beach, Florida, on ~,~arch 29, April 5, 1£ and 19, 1940, and attached to said assessment roll was a' notice re'citing that the City Council would sit to hear complaints and as a Board of Equalization on April ~B, 1940, at 7:30 P.~i., and whereas, the City Council met at the time mentioned in said notice, to-v~it: on the ~.End day of April, 1940, at the City Hall, at 7:30 o'clock P.~., and whereas, no person or persons appeared to object, complain, or protest against any of the assessments as published for said improvements, and the said assessment roll for said improvements, as published, ~as found to be correct and the assessments equal and just and in the aggregate amount of $7500.8B, NOW, THEREFORE, BE IT ORDAINED By the City Council of the City of Delray Beach, Florida: Section 1. That the aforesaid assessments, as set forth in the engineer's report and the assessment roll, as published in the Delray Beach News on ~iarch 29, April 5, 12 and 19, 1940, a copy of said assessment roll, together with the proof of publi- cation being on file in the City Clerk's office, be and the sa~e are hereby ratified, approved, and confir~aed, and that said assess- ments shall be and remain legal, valid and binding liens upon the property against which said assessments are made until paid in accordance with the charter of the City of Delray Beach, Florida, and the laws of the State of Florida thereto appertaining. Section 2. That the cost of said street repairs be and the same is assessed against the property abutting thereon, and the City of Delra y Beach have a lien against the following lots or parcels of land for such street repairs, as above described. Section 3. That each of said assessments be payable in ten (10) equal annual installments payable on the 12th day of June in each and every year from the 12th day of June, 1941, to the 12th day of June, 1950, both inclusive, together with interest at the rate of eight (8%) per cent per annum from date, provided, however, that the owner of any property assessed shall have the right to pay said assessment in full, together with accrued interest, at any time. Section 5. That said special assessments shall be a lien from the date of the assessment upon the respective lots and parcels of land described herein and shall be of the same nature and to the same extent as the lien for city taxes and shall be collected in the same manner and with the same promptness and under the same provisions as to sale and forfeiture as city taxes are collectible, provided said assessments may be collected in any other manner and by any other method as may be p~ovided by the charter of the City of Delray Beach, Florida. Section 6. The City Council is hereby authorized to issue certificates of indebtedness for the amounts so assessed against the assessable property and separate certificates shall be issued against each tract of land assessed containing a description of the land and the amount of the assessment, together with the general nature of the improvement for which the said assess- ment is made.
