332-39 ORDINANCE N0.~ AN EMERG~NCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH AMENDING AN ORDINANCE PROVIDING FOR THE POSTING OF A BOND TO SECURE PAY~ENT OF PERSONAL PROPERTY TAX BY ALL P~RSONS, FIRMS OR CORPORATIONS APPLYING FOR A CITY LICENSE UNDER THE LICENSE LAWS OF THIS CITY UNLESS SAID PERSON, FIRM OR CORPORATION HAS BEEN IN BUSINESS CONTINUOUSLY FOR A PERIOD OF T~h~ MONTHS PRIOR TO THE ISSUANCE OF SUCH LICENSE OR HAS PAID ALL PERSONAL PROPERTY TAXES ASSESSED AGAINST SAID ~PPLICANT FOR THE IMMEDIATELY PRECEDING YEAR. WHEREAS, an emergency exists in the City of Delray Beach due to the fact that city licenses are now due and payable, and under an ordinance of the City of Delray Beach it is required under certain conditions that before a license shall be issued a bond in a sum equal to five times the amount of such license be posted by the licensee, and whereas, in the opinion of the City Council, such ordinance works an undue hardship upon such persons as may be subject thereto, and whereas it is necessary for the immediate preservation of public peace, public health or safety, or for the daily operation of a municipal department that this amending ordi- nance be passed, now, therefore, BE IT ORDAINED By the City Council of the City of Delray Beach that Section 1 of that certain ordinance being "An Ordinance providing for the posting of a bond to secure the payment of personal property tax by all persons, firms or corporations applying for a city license under the license laws of this city unless said ~erson, firm or corporation has been in business continuously for a per~od of twelve months prior to the issuance of such license or has paid all personal property taxes assessed against said applicant for the iw~nediately preceding year" be and the same is hereby amended so as to read as follows: "Section 1. 'No license shall be issued to any person, firm or corporation to engage in or manage any business, profession or occupation for which a City license may be issued by the City of Delray Beach, Florida, unless said person, firm or corporation has maintained a regular office or place of business within the City of Delray Beach, Florida, continuously for a perio~ of twelve (12) ~LU-~months immediately prior to the application for the issuance of such license, or unless said person, firm or corporation shall have Oi~Paid to the City of Delray Beach, Florida, all personal property taxes due to the said City of Delray Beach, Florida, from said person, firm or corporation applying for such a license for the year immediately preceding the year for which said license is applied for, or, unless said person, firm or corporation shall post a cash bond in a sum equal to twice the amount of the annual license to be paid by said licensee, which said bond will guarantee the payment of any and all personal property taxes which may be assessed against the party to whom such license is issued during the period covered by said license."
