IN PAYNEI~T OF SAID SPECI~L I~PRO~E~ENTS.
WHEREAS, an assessment roll covering the cost of certain
filling and grading was duly prepared by the City Engineer in
accordance with a resolution adopted by t~e City Council of the
Ci~y of Delray Beach, Florida, aggregating One Hundred Eighty-
eight and 08/100 Dollars ($1~.OS), and said assessmenm roll was
duly published in the Delray Beach News, a newspaper publisaed
and circulated in t~e City of Delray Beach, Florida, on FeOruary
17th and 24th, and March 3rd, 1939, and a~tacned to said assessment
roll was a no~ice reciting that t~e Ci~y Council would sit to
hear complaints and as a Board of Equalization on March lSth,
1989, at ?~80 o'clock P. M., and, whereas, t~e City Council met
at the ~ime mentioned in said notice, to-wit; on the lJth day
of March, 19~9 at the City Hall at ?:~0 o~clock P. M. and,
whereas, no person or persons appeared to object, complain or
protest agaznst any of the assessments as puolisned for
said filling and grading on Atlantic Avenue and the said
assessment roll for said street improvements, as published, was
~ound to Oe correct and the assessment equal and just and in
the aggregate amount of One Hundred Eighty-eight and 08/100
Dollars ($1~@.08).
~OW, T~EREFORE, BE iT ORDAINED By t~e City Council of the
City of Delray Beach, Florida:
SECTION 1. That the aforesazd assessments, as set forth
in tae Engineer's report and the assessmenz roll, and published
in the Delray Beach News on February 17th and 24th and March 3rd,
1939, a copy of said assessment roll, together with the proof
of puOlication being on file in the City Clerkts ozfice, be and
same are hereby ratified, approved and confirmed, and that said
assessmen~ shall be and remain legal, valid and binding liens
upon the property against wl~ich said assessments are made until
paid in accordance with the charter of the Oity of Delray Beach,
Florida, and t~e laws of the State of Florida thereto appertaining.
SECTION 2. That the cost of filling and grading on the
East one-half (E.~) of Gleason Street extending from Atlantic ivenue
to a point one hundred sixty seven and seven-tenths (167 7/10)
feet south of Atlantic Avenue, be and tne.s~me is assessed against
the proper~y abutting t~ereon and the City of Delray Beach have
a lien against the following lots or parcels of land for the
filling and grading, as above described'
SECTION 3. That the following assessments be and the
same are hereby made and levied against eaca of the following
named lots or parcels of land abutting upon said street; said lots
or parcels being specifically benefitted by said improvement in
t~e amounts assessed and said description being with reference
to lots, tracts and blocks in the City of Delray Beach, Florida,
to-wit:

SECTION 4. That each of said assessments be payable in
ten equal annual installment, payable on the 15th day of March in
each and every year from the 15th day of March, 1939, to the 15th
day of March, 1~4~, the first payment installment being due March
15th, 1940 and the last installment being due March 15th, 1949,
together with inzerest at the rate of eight per cent (8%) per annum
from date, provided, however, that the owner of any property assessed
shall have the right to pay said assessment in full, together
with accrued inzerest, at any time.
SEOTION 5. That said special assessments shall be a
lien from the 15th day of March, A. D. 1939, the date of assess-
ment, Upon t~e respective lots and parcels o£ land described
herein and shall be of the same nature and to the same extent
as the lien for city taxes and shall be collected in the same
manner and with the same promptness and under the same provisions
as to sale and forfeiture as city taxes are collectible, provided
said assessments may be collected in any other marmer and by any
ot~er method as may be provided by the charter of the City of Del-
ray Beach, Florida.
SECTION 6. The City Council is hereby authorized to
issue certificates of indehzedness for the amounts so assessed
against the assessable property and separate certificates shall
be issued against each tract of land assessed containing a des-
cription of the land and the amount of the assessment, together
with 'the general nature of the improvement for which the assess-
ment is made.
SECTION 7. The City Council is hereby authorized to
deliver a sufficient number of said certificates of indebtedness
to the contractor performing said work in such amounts as to pay
said contractor for tae amount due him for said special improvements.

point one hundred sixty-seven and seven tenths feat
(167 7/10ft.) South of Atlantic Avenue.
The total cost of filling, which was Three
Hundred Four cubic yards (304 cu. yds.), was Eighty-two
and 8/100 Dollars ($82.08). The incidental expenses in-
cluding legs~l fees ~-nd advertising was One ~lundred Six
Dollars (~;~10o.00). Ail of this cost is to be charged
against Lot 3 of Block 4 of Ocean Park,
