Ord 213-38 ORDINANCE NO. , AN ORDINANCE OF THE CITY OF DELRAY BEACH, FLORIDA, CLOSING, VACATING M~D DISCONTINUING GARDNER AVENUE AS THE SAME WAS PLATTED ON THE PLAT OF ASBURY PARK ADDITION ON FEBRU~LRY 19, 1915. WHEREAS, it has been requested that Gardner Avenue as shown on the plat of Asbury Park Heights, a subdivision of the City of Delray Beach, Palm Beach County, Florida, according to plat thereof recorded in Plat Book 6, page 2, of the Palm Beach County records, be closed, vacated and discontinued; and WHEREAS, a street known as Jo-Jo Avenue, as sho~m by the plat of Nassau Park, being a revised plat of Asbury Park Heights, recorded in Plat Book 16, page 67, of the Palm Beach County records, nas been established in lieu of said Gardner Avenue as shown on the plat of Zsbury Park Heights; and WHEREAS, it appears that it is to the best interests of the City of Delray Beach, Florida, that said Gardner Avenue, as shown on the plat of Asbury Park Heights, be closed, vacated and discontinued: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA: SECTION lo That pursuant to the authority vested in it by the City Charter of the City of Delray Beach, Florida, and the general laws of the state of Florida, that Gardner Avenue, a street located in the City of Delray Beach, Florida, as show~,~ by the plat of ~sbury Park Heights, Delray, Florida, filed February 19, 1915, and recorded in Plat Book 6 at page 2 of the Palm Beac~ County, Florida records, be, and the same is hereby closed, vacated and discontinued.
