Ord 152-35 AN ORDINANCE REGUIA TING THE SALE AND DISTRIBUTION OF WATER FURNISE~D, PRO- VIDING FOR A MAINTENANCE AND SERVICE CHARGE FOR SERVICE RENDERED TO OWNERS AND CONSUMERS BY ~ CITY OF DELRAY BEACH, ~0RIDA; REGULATING THE RATES THEREFOR, AND REGULATING THE ~ANNER IN WHICE WATER CONNECTIONS AND METERS SEAId4 BE FURNISHED AND PROVIDING PENALTIES FOR VIOLATION THEREOF; CREATION OF LIENS FOR PAST AND UN2AID ACCOUNTS; AND ~EALING AT,T, ORDINANOES OR PARTS OF ORDINANCES IN CONFLICT HEREWITE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY 0F DELRAY BEACH, i~LORIDA: SECTIC~ le That, hereafter ~no water service will be furnished to any person, firm or corporation in said tow~ who does not agree to accept all of the provisions of the sections contained herein, and all of the reasonable rules and 'regulati cnn not inconsistent herewith promulgated by the City Council for the regulation of water service and the adoption of this ordinance shell be sufficient notice to all persons for the provisions hereof; amd the acceptance of water service from the torn from the date this ordinance becomes effective, shall be, in itself, the acceptanme of the provisions hereofe SECTION E. That tha~ following shall be the tapping char~ , to cover the cost of tap, and installation of service to the ~rop. erty line of the lot to be supplied with water service, including setting the meter, varying as follows, according to the size of the tap: A" Tap - 1~ Tap - 15.0G E ~ Tap - ~O.0O '., For the larger sized tap the charges shall be for all material ar~ la~or, including street and sidewalk repairs~ neces- sary to complete the work, and the Water Department shall make an estimate of all costs of said labor and material, and repairs for the ~ob, and 'shall require of the applicant, before the work is started, a deposit in that rum, plus 10% as a guarantee of payment, Tapping charges to contractors and other persons requir- ing water for temporary use only, shall be charged to cover labor in installing and removal and for equipment damaged while on the ~ob; and a reasonable deposit shall be made to cover such labor, and damage in addition to the deposit insurtmg payment for water consumed, as hereafter set forth. Fire H~rants shall not be used for obtaining water under any circumstances, except by consent of the Fire Chief, am[ under his regulation and control, or some employee of the Water Depart- ment under the direction of the Chief of Fire. SECTION 3. A monthly minimum charge will be made, payable monthly, varying according to the size of the meter; and allowing a fixed amount of water without excess, charged for the different sized meters, as set forth in the following schedule: NINIMUM CHARGE AMT. A guarantee of pay~.,ent deposit for all bill shall be ma~e by each consumer or owner, !varying according to the size of the meter in use, as follows: {" Meter . $ 5.00 1= " - 10.00 ,' ~e " - 30.00 3-' ~ - §0o00 4- -" - 100.00 ~egln~lng October lat, 1935, and calculated from and after that date interest at the rate of two per cent, (2~) per annum will be paid on water deposits, payable annually, October 1st, and credited on water bill, but no i~terest will be paid on deposits remaining with Water Department during the time water is turned off at the request of Consumer, Any Consumer, may, upon request, have the meter at his residence or place of business exchanged for one of less~r or larger size upon payment of Five Dollars ($5,00) and his deposit and minimum charge per month shall be adjusted as per amount set forth above, Whenever in any month the water bill of any consumer amounts to as great or greater sum than the amount of his al,pea, it he shall be required to. make a deposit in double the amount of such bill, · SECTION 5, Beginning October 1st, 1935, and each year hereafter on same date, there shall be an a~maal maintenance and service charge of '~Zim.~ Dollars ($$,00) for each tap now ir~t~lled or that m~y hereafter be installed, including private fire line taps, which shall be due and payable in monthly installments?of Fifty Cents ($,501 each, and no adjustment or refund shall be allowed during the ti,w water may be turned off or not being used, Any consumer or owner asking that water be turned on dur- ing the year at a tap not previously in use shall be required tanpal installments on maintenance charge then due, and continue to pay said maintenance charge at the rate of Fifty Cents ($.50) per imonth throughout the entire years When new taps are installed at any time during the year Cand for the purpose of this ordinance the year shall be and is lhere~ designated as fro.. October 1st up to and including September 20th ortho following year) maintenance charge shall be made for the proportionate balance of the year. ~ owner who gives notice on or before October first that he wishes water turned off permanently will not be required to pay maintenance charges for the coming year, but if he or any consumer wishes later to have water service maintenance charge must be paid for the entire year in which application is made, SECTION 6. Upon application for water service, and payment of deposit as required by this ordinance, water will be turned on as soon as practical. Ail bills for water shall become due and payable on the first day of each month, ami if paid in full by the 10th day of the month, the payment shall be for the exact amount of the water used and chs~rged for under this ordinance; hc~ever, if said bill is paid after the loth day of the month, there shall be a penalty of ten per cent., and if said bill is not paid on or before the E0th day of the month, the water shall be cut off with- out further notice. Water will be cut off at any time requested by consumer and guarantee of payment deposit refunded upon settle- ment of all back charges. Meter shall be removed by the Water Department without delay whenever water is cut off, either by request of the consumer or by the Water Department for non-payment of charges or for other reason, and a charge of One Dollar ($1.00) shall be paid before the meter shall be again installed. SECTION 7. That there shall be a separate meter anl water tap and service for each hOme, dwelling house, tmmant house, apartment house or building, store building and place of business for the furnishing of water anl water servise within the City on and after the date of the passage of this ordinance, he. ever, all water meters or water taps and water service that 'are now -4- in use, at the time of the passage of this ordinance, and furnish- · · · Xng water and .water service to more than one home, dwelling house, tenant house, apartment house or '§Utldlng, store building or place of ~usiness, the owner or the person £n whose name said water meter or water service tap is listed in the City Water Books. shall pay a minim ~onthly water charge of One and 50/100tbs Dollars ($1.50) per m~nth for each home, dwelling house, tenant house, apartment house or building, store building or place of business, connected with Said water meter or water tap service, provided the .~ter used through said meter or water tap does not exceed the minimum of 91.§0 per building as hereinabove desoribede SECTION 8.' It shal~ be unlawful for any person other tha a water works employee to tap any water main of the 01ty, or to connect water with property or premises with separate ownership, or for connecting water with City mains after same has been dis- connected by said ~ater Department. Any person found guilty of a~y of these acts shall be fined not less than Ten Dollars ($10.00) nor more than One Hundred ~ollars ($100,00), or lmpriso~me~,t of not more than thirty days, or both fined sn~d imprisoned. This ordinance shall take effect and be in full force from aM after the first day of October, A. D. 193§, and that the present water ordinance of the City of Delray Beach, Florida, shall remain in full force and effect, and shall not be rede sled by this ordinance until September 30th, ALL ORDINANCES ami parts ofc~dinances in conflict with the provisions hereof be and the same are hereby repealed, PASSED by the City Council of the City of Delr~y Beach, Florida, in regular adjourned session sitting this the joY,day of ~eptemher, ~.
