OF WATER FURNISHED, AND SERVICE RENDERED TO OWNERS AND CON-
SUPERS BY THE CITY OF DELRAY BEACH, FLORIDA; REGUI~TING THE
RATES THEREFOR, PENALTIES FOR VIOLATION THEREOF; CREATION
OF LIENS FOR PAST AND UNPAID ACCOUNTS; AND REPEALING ALL
OFd~INANCES OR PARTS OF OFJ~INANCES IN CONFLICT HEREWI~I~.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DEL~AY BEACH,
FLORIDA.
SECTION ~. That the Tollowing shall be the tapping charges
to cover the cost of tap, and installation of service to the prop-
erty line of the lot to be supplied with water service, inclualng
setting the meter, varying as follows, according to the size of
the tap:

For the larger sized tap the charges shall belfor all material
and labor, including street and sidewalk repairs, necessary to
complete the work, and the ~,ater Department shall make an estimate
of all costs of said. labor and material, and repairs for t~e job,
and shall require of the applicant, before the work is started, a
deposit in that sum, plus lO~ as a guarantee of payment.
Tapping charges to contractors'and other persons requiring
water for temporary use only, shall be charged to cover labor in
installing an~ removal and for equipment damaged while on the
Job; and a reasonable del~oslt shall be made to cover such labor,
and damage in addition to the deposit insuring payment for water
consumec, as hereafter set forth.
Fire H~rants shall not be used for obtainin~ water under any
circumstances, except by consent of the Fire Chief, and under his
regulation and control, or ~ome employee of the ~ater Department
under the direction of ~he Chief of Fire.
SECTION 2. A m~nthly minimum charge will be made, payable
monthly, varying according to the size of the meter; and allowing
a fixed amount of water without excess~ charge'for the different
sized meters, as set forth in the following schedule:

Ail in excess of the minimum, 10 cents per thousand gallons.
SECTION 3. A guarantee of payment deposit for all bills,
shall be made by each consnm__er or o~er, varying according to
the size of the meter in use, as follows:

Beginning 0c~ober 1st, 1934, and calculated from and after
that date interest at the rate of two per cent. per annum will
be paid on wager deposits, payable annually, 0c~ober 1st, and
credited on water bill, but no interest will be paid on deposits
remaining with Water Depar~n~t d~ri~g the time water is turned
off at the request of Consumer.
Any Consumer, may, upon request, have the meter at his
residence or place of business exchanged for one of lesser or
larger size upon payment of Five DoLlars ($5.00) and his deposit
and minimum charge per month shall be adjusted as per amount set
forth abo~e.
Whenever in any month the water bill of any consumer amounts
to as great or greater sum than the amount of his deposi~ he shall
be required to make a deposit in double the amount of such bill.
SECTION 4. Upon application for water service, and
of deposit as required by this ordinance,water will be ~u~ne& on
as soon as practical. Ail bills lbr water shall become due and
payable on the 1st day of each ~Dn~b, and if paid in full by the
10th day of the month, the paymsnt shall be for the exact amount
of the water used and charged for under this ordinance; however,
if said bill is paid after the 10~h day of the month, there shall
be a penalty of ten per cent., and if said bill is not paid on or
before the 20~h day of the month, the water shall be cut off with
out further no, ice. Water will be cu$ off at any ~ime requested

by consumer and guarantee of payment deposit refunded upon
settlement of all back charges.
Meter shall be r~oved by the Water Department without delay
whenever water is cut off, either by request of the consumer or by
the Water Department for nonpayment of charges or for other reason,
and a charge of one Dollar ($1.0O) shall be paid before the meter
shall be again installed.
SECTION 5. It shall be unlawful for any person other than
a water works employee to tap any water main of the City, or to
contact water with property or premises with separate ownership,
or for reconnecting water with City wsins after same has been dis-
connected by said Water Department.
Any person found guilty of any of these acts shall be fined
not less than Ten Dollars ($10.00) or more than One Hundred
Dollars ($100.00), or imprisonment of not more than thirty (30)
days, or both fined end imprisoned.
This ordinance shall take effect and be in full force from
and after the first day of 0ctober, A. D. 1934, and that the
present water ordinance of the City of Delray Beach, Florida, shall
remain in full force and effect, and shall not be repealed by this
ordinance until September 30th, 1934.
