Ord 104-33 AN EMERGENCY ORDINANCE AMENDING
: "AN ORDINANCE BY THE CITY COUNCIL
OF THE CITY OF DELRAY BEACH, FLORIDA,
/ PRESCRIBING THAT CERTAIN TAXES LEVIED
.. SHALL BE PAID IN CASE, AND PRESCRIBING
i ~ THAT CERTAIN OTHER TAXES CAN BE PAID
IN BONDS OF SAID CITY" AND FOR OTHER
PURP0 SE$. ~
WHEREAS, the above ordinance, sought to be amen~e~
hereby, was heretofore pas~ed by the authority aforesai~, and
WHEREAS, FURTHER, certain protests and objections have
been made to ~e aforesaid ordinance which has necessitated ar~X
caused the postponement and delaylof operation thereof; and
~ WHERF~AS, FURTHER, said delay in the operation of said
ordinance is now seriously impairing the collection of the past
due and current taxes of said City; and
.. WHEREAS, FURTHER, the immediate collection of the
· taxes of said municipality is necessary to the efficient operation
and maintenance of said City ami said postponement and ~elay in
the operation of said ordinance has cause& and created the
existence of an emergencY, which said emergency is declare~ to
exist by the authority aforesaid,
r NOW, THEREFORE, BE IT 0RD~AINED By the authority afore-
said that said ordinance be amended by striking all of the body
of said ordinance, leaving only the caption and ~ormal parts
thereto, and inserting in lieu thereof +..he following:
BE IT ORDAINED By +~e City Council of the City of
Delray Beach, Florida, in regular adjourned session sitting, that
on and after the passage of this ordinance the Tax Collector of
~ said City is authorized and directed to accept tax payments,as
f ollo wa:
The taxes levied for the fiscal year 1958- 19JJ shall
first be paid in lawful money of the United States and all other
delinquent taxes on property located in the former City of
~ Delray due and owing said municipality for the fiscal years
1931 and 1951 - 195£ may be paid in bonds issued by the former
City of ~elray; all of which bon~$ can be accepted only on a
flat basis with all past due coupons attached which have not
heretofore been paid in cash by said City. Provided always that
should the past due interest coupons, which have not been paid in
cash by said City, be not owned by the party or parties tendering
a bond or bonds for payment of delinquencies hereunder, then and
in that event, said party so tendering a bond or Oonds hereunder
may tender therewith other past due coupons or the principal of a
0end equal in amount to the past due and unpaid coupons on **he
respective bond or bonds so tendered on a flat oasis for payment
of taxes.
IT BEING THE PURPOSE AND INTENT Of this ordinance that
only the principal of bonds can be used for the payment of
delinquent taxes hereunder, and, further, that the past due an~
unpaid coupons on the respective bonds so tendered shall be turned
in to said City for cancellation, for which said amount of past
due interes*, coupons no credit whatsoever, in any manner, shall be
given. Or, in lieu thereof, for cancellation, other past due
coupons or bond principal in a like amou~,t shall '0e surrendered
cancelled without crc&it therefor.
BE IT FURTH.ZR 0RDAI~'~D That no bonds of the former City
of Delray c~n be accepted in payment for delinquent taxes due an~
owing on property in the former Town of Delray Beach.
ALL 0RD iNANCE$ or resolutions in conflict herewith are
hereby repealed.
PASSED By the City Council of the City of Delray Beach,
Florida, after declaring the existence of an emergency, as an
emergency amen~ent which shall oecome effective immediately
upon its adoption.
ADOPTE~ By the authority aforesaid on this the
day of December, A. D. 1930.
