Ord 32-29 AN ORDINANCE OF THE OITY OF DELRAY BEACH, FLORIDA,
· TO REGULATE THE USE OF ~ARBON BISULPHIDE AND GASOLINE,
NAPHTHA, BENZOLE AND OTHER LIGHT PETROLEUM AND COAL
TAR PRODUCTS IN DRY CLEANING AND DRY DYEING ESTABLISH-
NENTS IN THE CITY OF DELRAY BEACH, FLORIDA.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BEAOH, FLORIDA:
Section 1. That it shall be unlawful for any person,
, firm or corporation to carry on the dry cleaning
dyeing business in the City of Delray Beach, Florida, 'With-
complyin~ with the regulations hereinbelow set forth.
Section 2.' No dry cleaning or dry dyeing business shall
operated or carried on in any building within the corporaSe
of said city unless said building is entirely of
construction, and located not less than ~0 feet from a~y
or property line except where said property line
street or alley. In no event shall said plant be
less than 20 feet of a building, except that all wall
~ be equipt with automatic steel doors o~ shutters.'
Section 3, No dry cleaning or dry dyeing business
operated or carried on where the process of dry cleaning
dry dyeing is done outside of a building erected for
, in accordance with the above requirements.
Section 4j For the purpose of this Ordinance a dry
or dry dyeing business is defined to be the
cleaning or dyeing cloth, clothing, feathers or any
of fabric by the use of Carbon bisulphide, Gasolir~
Benzole, Benzene, other light petroleum, or coal tar products,
or cleaning or dyeing by process known as dry cleaning or
dyeing, where inflamable, volatile substances are usedj
Section 5.~ No building to be used for the purpose of
dry cleaning or dry dyeing as above described, or for the
storage of volatile substances for use in the business, shall
be located, constructed or maintained until an application
for permission to do so accompanied by full plans and spec-
ifications of the structure and its location, shall have been
filed, with an approval by the Chief of the Fire Department.'
Section 8. All buildings used for the purpose of the
business of dry cleaning or dry dyeing as above defined must
not be in excess of 2,500 square feet of ground area, and not to
exceed one story in height, snd be without basement, cellar or
open space below the grade floor, and shall have no other
occupancy.
Section 7. All walls of such structure within the limits
of said City shall be of brick, laid in ~ement mortar, or of
steel frame and terra cotta construction, or of stone laid in
cement mortar not less than eight (8) inches thick. The doors
shall be of fire proof materials,and windows of reinforced
wire glass and steel frames. The roof supports and roof deck
of such structure shall also be of fire proof construction, with
a removable cap of sufficient size as to properly vent the
building in case of fire.~ There shall be no sewer connections
from such structure and the floors shall be of concrete con-
struction, laid on a level with the surface of the earth 'surround-
ing the walls, and be pitched, at such grade from all its walls as
to secure perfect drainage flow of all liquids to the center
of such rood.
Section $.~ Ventilating apertures of size not less than
l0 by 6 inches shall be placed in the wallsof such structure at
or near the level of its floor, and be spaced not over six feet
apart from center to center, and be properly screened by wire
mesh window.~
Section 9.! For the purpose of extinguishing fires, there
shall be locateA at convenient points in the room, where they
shall be readily accessible, fire extinguishers and buckets of
sand approved in type and quantity by the Chief 6f Fire, warning
signs shall be displayed where directed by the Chief of Fire.~
Section lO.~ No heat generating device, nor any electric
generator or dynamo, shall be located, maintained or used inside
of, or within a distance of l0 feet of any structure used for
the purpose of dry cleaning or dry dyeing as above defined.
Section ll. The lighting of such structures shall be
cured only by keyless socket incandescent electric light, with
globes or bulbs enclosed in vapor-proof receptacles , and all
switches, cut-outs or fuses used in the installation of operat-
ion of such lights shall be located and operated from the outside
of such structure.~ The entire electrical equipment must conform
to the most advanced stage of the art at the time of installation,
Section 12.~ The heating of such structure shall be secured
only to the use of steam or hot water circulating systems*
~' Section lSj.~ ~. volatile substances in excess of five ($)
gallons received for use in the business of dry cleaning or dry
dyeing as above defined, shall be stored in steel tanks, the
shell of which shall not be less than three-sixteenths ($/18)
inch thick the interior of such tank to be coated with approved
rust-resistive, and all joints in same shall be calked in an
approved manner.~
Section 14. No storage tank shall be placed, constructed
or maintained under a public sidewalk, street or alley, or any
other public way.
.~ Section 15. No tank shall exceed in capacity ~00 gallons,
and each shall be buried under~round to such depth as to secure
a covering of earth at least ~ ~ feet from the top of the
tank at the surface of the ground; or, much tank may be inclosed
in a cement lined under-ground pit, having an arched roof, at the
level of the surrounding ground surface.~
%~. Section 16.' All tanks shall be provided with a vent pipe
not less than~t~ ~ inches in diameter extending from the t~p
of the tank to the outer air, and discharging at a point .not less
than two (2) feet above the roof of the building; said vent shall
be provided with brass wire screen of SO mesh at a point near the
junction of the pipe with the shell of the tank, and also be pro-
vided at its discharge end with an inverted "U" cap or goose-neck.'
~ Section 17. (All such tanks shall be provided with a filling
pipe of not less than two (2) inches in diameter, extending from
the top of the bank shell to within one (1) inch of the bottom of
the tank; each such feed pipe shall be provided with two brass
wire screens of not larger than 30 mesh, one of such screens to
be placed in the pipe at, or near its junction with said tank and
the other immediately above the controlling cock or valve at
intake end; said filling pipe must be laid with inclination
toward the tank to secure proper drainage; the intake end to
feed pipe shall be fitted with a controlling feed cock or valve,
~ which shall be kept closed, except while in use, end the intake
· end of the pipe above such cock or valve shall be provided with a
screw cap, such screw cap to be securely screwed on the feed pipe
inlet when same is not in use.~ (Both the controlling cock or
valve and feed pipe inle~ must~be enclosed in a box, or hood, set
on a level with the surface of the ground, and be kept securely
locked when not in use;) (such feed inlet and controlling cock
valve shall in no case be located inside of any building.)
~' Section 18. (All pipes connected to such storage tanks
must enter or be attached to same at the top; service pipes
used to draw volatile substance from storage tank shall extend
from the top of the tank shell to within two (2) inches of its
bottom and be provided with brass wire screens of not less tha~
30 inch mesh at or near its junction with the shell of tha
tank and also below the controlling cock or valve at its delive=y
end inside of the cleaning and dyeing structure; such controlling
cock or valve shall be kept closed when not in use.~)
~ Section 19.~ No volatile substance shall be drawn from the
storage tank except through service pipes as above described;
movement or transmission of such volatile through said service
pipe shall be sacured by pump or siphon only.! o
Section 20.' No more than ten (10) gallons of volatile
substances shall be kept inside of a building used for dry
cleaning or dry dyeing purposes and such volatile substances
shall be kept in self-closing, safety, metal cans, approved and
labeled by the National Board of Fire Underwriters.
Section 21.~ The use, or handling of more than two (2)
gallons of such volatile substance in vessels, vats, pans or
· devices of any kind which are open to the air is absolutely
prohibited.~
Section 22.~ No greater quantity than five hundred (500)
gallons of any volatile substances ahall be stored or kept on
hand at any one time at or near the location of any dry cleaning
or dry dyeing eEtablishment,~
Section 2~.~ Any person, persons, firm or corporation
violating or failing to comply with any provision of this
ordinance shall be fined not to exceed one hundred ($100j$0)
Dollars or imprisoned in the City Prison or at hard labor on the'
~. street or other public works of said City, for a period not to
exceed thirty days, or both said fine and lmprlsonmmnt.!
Section 24.t All ordinances or parts of ordinances in
conflict herewith are hereby repealed.~
