05-12-98SpMtg MAY 12, 1998 A Special Meeting of the City Commission of the City of Delray Beach, Florida, was called to order by Mayor Jay Alperin in the First Floor Conference Room at City Hall at 6:00 p.m. on Tuesday, May 12, 1998. Roll call showed: Present - Commissioner Kevin Egan Commissioner Ken Ellingsworth Commissioner David Schmidt Mayor Jay Alperin Absent - Commissioner David Randolph Also present were - City Manager David T. Harden and City Attorney Susan A. Ruby Mayor Alperin called the meeting to order and announced that it had been called for the purpose of considering the following items: (1) Request to ADpeal Order/Scheinberg, et al. v. City: Consider authorizing the City Attorney to file an appeal of the Order granting class certification in Scheinberg, et al. v. the City concerning the maintenance of canals in Tropic Isle. The City Attorney explained this is a lawsuit that has been set forth as a class action for over 300 property owners in the Tropic Isle area. The Judge denied the City's motion to decertify the class. However, the City has the appeal the Order even though the rest of the suit is ongoing. The City Attorney requested authorization from the City Commission to file the appeal. Mr. Schmidt moved to approve the appeal, seconded by Mr. Egan. Upon roll call the Commission voted as follows: Mr. Schmidt - Yes; Mr. Egan - Yes; Mr. Ellingsworth - Yes; Mayor Alperin - Yes. Said motion passed with a 4 to 0 vote. (2) Distribution of FY 1999 Anti-Dru~ Abuse Act Grant Funds: Consider approval of the distribution of FY 1999 Anti- Drug Abuse Act Grant funds in the amount of $719,952 as recom- mended by the Criminal Justice Commission, and authorize letter agreeing to the allocation of these funds. Mayor Alperin noted that three of the programs to be funded are countywide, while two are with the City of West Palm Beach which represent some 12% to 13% of the entire grant. He reiterated his concern that perhaps this is something that needs to be looked at more closely to make sure the south county area is getting its portion of available funds. Mr. Egan moved to approve the proposed distribution of FY 1999 Anti-Drug Abuse Act Grant funds based on the recommenda- tion of the Police Chief. The motion was seconded by Mr. Sch- midt. Upon roll call the Commission voted as follows: Mr. Egan - Yes; Mr. Ellingsworth - Yes; Mayor Alperin - Yes; Mr. Schmidt - Yes. Said motion passed with a 4 to 0 vote. There being no further business, Mayor Alperin declared the special meeting adjourned at 6:05 p.m., at which time the Commission convened the regularly scheduled workshop meeting.
