A Special Meeting of the City Commission of the City of
Delray Beach, Florida, was called to order by Mayor Jay Alperin
in the City Manager's Conference Room at City Hall at 5:15 p.m.
on Thursday, September 11, 1997.
Roll call showed:
Present - Commissioner Kevin Egan
Commissioner David Schmidt
Mayor Jay Alperin
Absent - Commissioner Ken Ellingsworth Commissioner David Randolph
Also present were City Manager David T. Harden and City
Attorney Susan A. Ruby.
Mayor Alperin called the meeting to order and announced that
it had been called for the purpose of considering the following
item:
(1) Settlement/Canavan v. the City, et al: Consider settlement
of the referenced matter.
The City Attorney introduced Fred Gelston, Esq., who is
representing the City, and Kent Pratt, Esq., who represents
Officers Galyon and Young, with respect to Canavan v. the City,
et al. She stated that the trial in this case is underway,
although some settlement discussions have occurred. As a result,
the amount of $295,000.00 has been negotiated as settlement,
including all attorney's fees and costs. Further, the settlement
would include all releases and charges against the Police
officers would be dismissed. Ms. Ruby stated that she
recommended the Commission's favorable consideration of the
settlement.
Mr. Schmidt moved to approve settlement of Canavan v. the
City, et al, as outlined and recommended by the City Attorney.
The motion was seconded by Mr. Egan. Upon roll call the City
Commission voted as follows: Mr. Schmidt - Yes; Mr. Egan - Yes;
Mayor Alperin - Yes. Said motion passed with a 3 to 0 vote.
(2) Commission comments.
There were no Commission comments.
There being no further business, Mayor Alperin declared the
special meeting adjourned at 5:25 p.m.
