A Special Meeting of the City Commission of the City of Delray
Beach, Florida, was called to order by Mayor Thomas E. Lynch in the
First Floor Conference Room at City Hall at 6:05 p.m. on Tuesday,
January 16, 1996.
Roll call showed:
Present - Commissioner Jay Alperin
Commissioner Ken Ellingsworth
Commissioner David Randolph
Commissioner Barbara Smith
Mayor Thomas E. Lynch
Also present were City Manager David T. Harden and City Attorney
Susan A. Ruby.
Mayor Lynch called the meeting to order and announced that it
had been called for the purpose of considering the following item:
(1) SettlementfMandelkorn vs. City of Delray Beach. Consider
settlement of the referenced case as recommended by the City
Attorney.
City Attorney Susan A. Ruby recommended settlement in the amount
of 810,000.00, which includes all attorney fees and costs.
Commissioner Ellingsworth moved to approve settlement of
Mandelkorn vs. City of Delray Beach as recommended by the City
Attorney, seconded by Commissioner Smith. Upon roll call the
Commission voted as follows: Mrs. Smith - Yes; Dr. Alperin - Yes;
Mr. Ellingsworth - Yes; Mr. Randolph - Yes; Mayor Lynch - Yes. Said
motion passed by a 5 to 0 vote.
There being no further business, Mayor Lynch declared the
special meeting adjourned at 6:08 p.m., at which time the Commission
convened the regularly scheduled workshop meeting.
