A Special Meeting of the City Commission of the City of Delray Beach,
Florida, was called to order by Mayor Jay Alperin in the First Floor
Conference Boom at City Hall at 6:00 p.m. on Tuesday, September 10, 1996.
Roll call showed:
Present - Commissioner Kevin Egan
Commissioner Ken Ellingsworth
Commissioner David Randolph
Mayor Jay Alperin
Absent - Commissioner Karen Kiselewski
Also present were City Manager David T. Harden and City Attorney Susan
A. Ruby.
Mayor Alperin called the meeting to order and announced that it had
been called for the purpose of considering the following items:
(1) Grabow v. City of Delray Beach: Consider a proposed settlement of the
referenced matter.
The City Attorney explained that this case arises out of an incident
that occurred in 1990. There was a trial, and the officers that were named
were found not liable. However, the City was found liable for false
arrest. On appeal, the court remanded for a new trial on damages only.
The new trial on damages is scheduled for September 30, 1996. The other
side has offered to settle in the amount of $44,000.00, which includes all
attorneys fees and costs, and also the release of a cost judgment of
approximately $3,000.00 in favor of the City, for a total settlement of
$47,000.00. Ms. Ruby further stated this is a difficult case to assess
because of the uncertainty of how a jury may find ao~ what may be awarded
as a result of the findings.
After discussion, Mr. Egan moved to approve settlement in the amount
of $44,000.00 and the release of the cost judgment of approximately
$3,000.00 in favor of the City, seconded by Mr. Randolph. Upon roll call
the Commission voted as follows: Mr. Egan - Yes; Mr. Ellingsworth - Yes;
Mr. Randolph - Yes; Mayor Alperin - Yes. Said motion passed with a 4 to 0
vote.
(2) Agreement With The Palm Beach County School Board For Parks And
Recreation Department Staff Services: Consider an agreement with the Palm
Beach county School Board for provision of Parks and ~mcreation staff
services for the before and after school program at Carver Middle School.
The City Manager stated that the agreement is for our Parks and
Recreation Department to operate the before and after school program that
would be at the Carver Middle School site. Basically, the School Beard is
paying the City $10.00 per hour for Parks and Recreation staff services to
support the program. Approval is recommended.
Mr. Ellingsworth moved to approve the agreement with the School Board
for provision of Parks and Recreation staff services for the before and
after school program at Carver Middle School, seconded by Mr. Egan. Upon
roll call the Commission voted as follows: Mr. Ellingsworth - Yes; Mr.
Randolph - Yes; Mayor Alperin - Yes; Mr. Egan - Yes. Said motion passed
with a 4 to 0 vote.
There being no further business, Mayor Alperin declared the special
meeting adjourned at 6:08 p.m., at which time the Commission convened the
regularly scheduled workshop meeting.
