02-15-94SpMtg FEBRUARY 15. 1994 A Special Meeting of the City. Commission of the City of Delray Beach, Florida, was called to order by Mayor Thomas E. Lynch in the Commission Chambers at City Hall at 6:15 P.M., Tuesday, February 15, 1994. Roll call showed: Present - Commissioner Jay Alperin Commissioner Ken Ellingsworth Commissioner David Randolph Commissioner Barbara Smith Mayor Thomas E. Lynch Absent - None Also present were - City Manager David T. Harden and City Attorney Susan A. Ruby Mayor. Lynch called the meeting to order and announced that this meeting has been called for the purpose of considering the following: 1. Request for Con~ribu~ion/A~!an~ic High School Eagle~te~: Consider a contribution in the amount of $2,500 in support of the Atlantic High School Eaglettes to participate in upcoming national competitions and championships. Funding is available from General Fund Contingency (Account No. 001-6111-519-99.00. The City Manager advised that, due to the fact that it was not necessary for the City to hold an election, it was possi- ble to release sufficient funding to meet the request of Atlantic High School. Mrs. Smith moved approval of a contribution in the amount of $2500 to the Atlantic High School Eaglettes in support of their upcoming National competition, seconded by Mr. Randolph. Upon roll call the Commission voted as follows: Mrs. Smith - Yes; Dr. Alperin - Yes; Mr. Ellingsworth - Yes; Mr. Randolph - Yes; Mayor Lynch - Yes. Said motion passed with a 5 to 0 vote. 2, Change Order No. 6/Chaz Equipment Co., Inc.: Consider Change Order No. 6 in the amount of $111,371.50 and a time exten- sion of thirty (30) calendar days to the contract with Chaz Equipment Co., Inc., for the installation of a new 8" C-900 water main and individual services on Vista Del Mar, with funding from Renewal and Replacement - Water Mains (Account No. 442-5178-536-63.50), pending transfer. The City Manager stated the amount should be $94,038 instead of $111,371. This came about due to a review of the change order when he saw some items that he felt were unneces- .sary. He~then met with the engineering staff, who also reviewed ~the change order, ~and as a result .they were able to reduce.the ~total cost. Mayor Lynch commented that this will result in a cut- back of repairs in one of the northwest projects so that the entire Vista Del Mar project can be completed at this time. The City Manager explained that the work in Vista Del Mar will include the installation of individual taps so that the hookup to each home can be done whenever they are needed, with the cost being paid by each individual homeowner at the time of hookup. Mr. Ellingsworth moved approval of Change Order No. 6 with Chaz Equipment Co., Inc., seconded by Mrs. Smith. Upon roll call the Commission voted as follows: Dr. Alperin - Yes; Mr. Ellingsworth - Yes; Mr. Randolph - Yes; Mayor Lynch - Yes; Mrs. Smith - Yes. Said motion passed with a 5 to 0 vote. ~3. .i ..... Se~lemen~ Offer/Bothe v, City Qf Delray Beach: The City Attorney .stated this is an Offer of Judgement in the amount of $39,999.99. The City made a counter-offer of $19,999.99 and has since received an offer of $28,500. It is her recommendation that the City Commission accept this settlement offer which would include all the attorneys' fees and costs, in addition to the other conditions as outlined in the memorandum. Mr. Ellingsworth moved approval of the settlement offer with Bothe v. City of Delray Beach, seconded by Mr. Randolph. Upon roll call the Commission voted as follows: Mr. Ellingsworth - Yes; Mr. Randolph - Yes; Mayor Lynch - Yes; Mrs. Smith - Yes; Dr. Alperin - Yes. Said motion passed with a 5 to 0 vote.
