A Special Meeting of the City Commission of the City of
Delray Beach, Florida, was called to order by Mayor Thomas E.
Lynch in the Commission Chambers at City Hall at 6:35 P.M.,
Tuesday, March 30, 1993.
1. Roll call showed:
Present - Commissioner Jay Alperin
Commissioner Ken Ellingsworth
Commissioner David Randolph
Commissioner Barbara Smith
Mayor Thomas E. Lynch
Absent - None
Also present were - City Manager David T. Harden and
City Attorney Jeffrey S. Kurtz
Mayor Lynch called the meeting to order and announced
that the meeting had been called for the purpose of considering
the following:
1. Proclamation - Sun~et Limited Day - April 4, 1993,
Mayor Lynch presented a proclamation for "Sunset
Limited Day" on April 4, 1993, in recognition of AMTRAK's
establishment of transcontinental train service from Miami to Los
Angeles, with a stop in Delray Beach. The Mayor advised he would
coordinate with the Vice-Mayor or the Deputy Vice-Mayor to ensure
appropriate presentation of the proclamation during the
"whistle-stop" at Delray Beach on Sunday, April 4, 1993.
2. Ratification of Collective Bargaining Agreement with
Police Benevolent Association.
The City Attorney stated that a memorandum had been
provided to the Commission in the agenda packet outlining the
material provisions of the contract. The City Attorney and the
City Manager recommend that the contract between the City and the
Police Benevolent Association be approved.
Dr. Alperin moved for approval of the contract between
the City and the Police Benevolent Association; seconded by Mrs.
Smith. Upon roll call the Commission voted as follows: Mrs.
Smith - Yes; Dr. Alperin - Yes; Mr. Ellingsworth - Yes; Mr.
Randolph - Yes; Mayor Lynch - Yes. Said motion passed with a 5-0
vote.
3. City Attorney'S Resignation,
The City Attorney stated that he had sent the
memorandum in order to make his resignation official, but was not
sure why it had been placed on the agenda. The effective date of
the resignation is April 12, 1993, at 5:00 p.m.
Mayor Lynch noted that Dr. Alperin had been designated
to negotiate with Assistant City Attorney Susan Ruby. Dr.
Alperin advised that he had a meeting scheduled with Ms. Ruby for
Wednesday, March 31, 1993. He will report the results of the
negotiations to the City Manager who will then contact the rest
of the Commission to let them know the outcome.
Mr. Randolph moved to accept the resignation letter
from City Attorney Jeffrey S. Kurtz, effective April 12, 1993, at
5:00 p.m.; seconded by Mr. Ellingsworth.
Prior to roll call the following discussion was held:
Mayor Lynch, on behalf of the City Commission, thanked
Mr. Kurtz for his service to the City.
At this point the roll was called to the motion. Upon
roll call the Commission voted as follows: Dr. Alperin - Yes;
Mr. Ellingsworth - Yes; Mr. Randolph - Yes; Mayor Lynch - Yes;
Mrs. Smith - Yes. Said motion passed with a 5-0 vote.
3.A. Request ~o Hold Plant Sale - Pro~ect Graduation.
Consider a request to hold a plant sale from March 31, 1993
through April 30, 1993 at the Delray Mall for the purpose of
raising funds for Atlantic High School's Project Graduation.
Chapter 110.15 of the Code of Ordinances which governs
occupational licenses provides for Commission approval on
temporary licenses for special events that are held annually and
in excess of three (3) days.
Mr. Randolph moved for approval of the request to hold
a plant sale from March 31, 1993 to April 30, 1993 at the Delray
Mall for the purpose of raising funds for Atlantic High School's
Project Graduation; seconded by Dr. Alperin. Upon roll call the
Commission voted as follows: Mr. Ellingsworth - Yes; Mr.
Randolph - Yes; Mayor Lynch - Yes; Mrs. Smith - Yes; Dr. Alperin
- Yes. Said motion passed with a 5-0 vote.
4. CQmmission Comments,
There were no comments from the Commission.
The City Manager stated the Commission had asked for as
much advance notice as possible for board appointments. He
distributed information regarding upcoming appointments to the
Civil Service Board and the Police and Fire Board of

Trustees. These appointments should be on the City Commission
agenda for April 13, 1993, if the Commission chooses to go ahead
with them at that time.
Mayor Lynch declared the meeting adjourned at 6:38 P.M.
