Pursuant to Section 3.07 of the Charter of the City of Delray Beach, Mayor David W. Schmidt has
instructed me to announce a Special Meeting of the City Commission to be held for the following
purposes:
REOUEST FOR FI. JNDING/SISTER CITIES COMMITTEE: Consider approval of a
request from the Sister Cities Committee for financial support in the amount of $2700.00 to help
offset costs for the visit of the delegates from Moshi, Tanzania and Miyazu, Japan.
WORKSHOP AGENDA
1. Review Ordinance 57-01 - An ordinance amending Chapter 101 (Municipal Parks, Beach and
Other Recreational Sites), by amending Section 101.27 (Animal Regulations) to allow for animals
on the sidewalk and grassy area west of the dune line on the east-side of A-1-A.
2. Review performance measures for Golf Course.
3. Discussion regarding the Arvida Property between Mih'tary Trail and Barwick Road.
4. Goal Setting Session - Lyle Sumek.
5. Commission Comments

Request for Funding/Sister Cities Committee
City Commission is requested to consider a request from the Sister Cities Committee in
the amount of $2,700 to help offset costs for the visit of delegates from Moshi, Tanzania
and Miyazu, Japan. Funding would be utilized to help offset costs for a welcoming
luncheon for our Moshi delegates, a formal dinner for both our Moshi and Miyazu guests
and for gifts.

Sixteen visitors from Moshi will be here April 21 throuF~ the 29 and twelve (12)
guests from Miyazu will be in Delray Beach from the 27th through the 30th with the
Mayor of Miyazu and one of his staff arriving the 25th.
Attached is the letter request we received from Charlotte Durante the chair of our Sister
Cities Committee.
Approximately $6,000 is available in the grants budget in the General Fund.
City Commission is requested to consider this funding request.

Re: Sister Cities Delegation Visit and State Conference
Dear Mayor Schmidt:
As you are aware we will be hosting a sixteen (16) number delegation from our Sister City in

Moshi, Tanzania from April 21 through the 29 . Also the Mayor of Miyazu and one of his staff
members will be arriving on April 25th and an additional ten (10) guests from Miyazu will arrive
on the 27th. All of our guests from Miyazu will be leaving on the 30th.
In addition our Sister Cities Committee will be host to this years State Conference which will be
held at the Marriott from April 26th through the 28th.
The Sister Cities Committee will incur various costs associated with the visit of our guests as well
as the State Conference. I have attached copies of our budgets for these two (2) events as well as
an up to date list our guests and itineraries for our guest visit as well as the conference.
The Sister Cities Committee is seeking donations to help offset our costs. We are asking the City
to consider a grant donation in the amount of $2,700 to specifically help offset the costs of our
guest visit. The funds would be utilized to help offset costs for the following: · Welcome lunch on 04/22/02 for our Moshi guests
· End of week dinner for both our Moshi and Miyazu quests
· Gifts for our Moshi and Miyazu guests

all DBSC Board and Committee members, City Commissioners, City manager and staff who
have in some way been involved with Sister Cities, the delegation who went to Moshi last year,
the 3 ladies who just climbi:d Mt. Kilimanjaro, the exchange students, select business executives,
other recommended names who have been involved with Sister Cities. DBSC pays costs for all.

reports and conduct association official business.
GUESTS' CHOICE - For our Moshi & Miyazu guests, the Sunday agenda for the State
Convention may not be very meaningful to them, therefore, the following activities are available
and a choice of these could be coordinated into their itinerary and could be done with guests
chosing separate things instead of all together for the same things. Guests will be asked If they
wish to make a choice for Sunday's activlttes~ Since our guests may be individually at d/fferent
places with different people, DBSC will have no plans for lunch for today. Indiv/dual
arrangements will need to be made by whomever is escorting them. All guests should return
from where ever at least in time for the OFFICIAL DINNER ON SUNDAY EVENING.

At Commission's regular meeting on October 16, 2001, the above subject ordinance was
amended to allow animals to be walked east of the curb on A-1-A to the dune line. At
the time the ordinance was passed City Commission requested a review of the ordinance
in six (6) months.
At this time we have received no complaints or concerns about the expanded area at our
office. I have also discussed this item with Rich Connell, Chief Schroeder, and Mr.
Dahlem the President of the Beach Property Homeowners Association.
Mr. Connell has indicated the Parks Maintenance crews have noticed a decrease in the
amount of animal waste they have found in the grass area. The lifeguards have only one
compliant and that is people who bring their animals on the beach and claim they didn't
know where the dune line was. Chief Schroeder has indicated that the Police
Department has received no complaints concerning this ordinance.
Mr. Dahlem reviewed this item with his Board on 04/04/02. From a health stand point
the BPOA felt that the area that animals could walk in east of the curb line on A-1-A
should be restricted to the grass area on the north end of the beach where we have the
wall and double sidewalk only.
Staff is seeking direction from City Commission concerning the ordinance change based
on the above input.

ALLOWED IN THAT GRASSY AREA OF THE MUNICIPAL
BEACH BETWEEN THE EASTERN CURB OF A-1-A AND THE
WESTERN BASE OF THE DUNE; PROVIDING A GENERAL
REPEALER CLAUSE, A SAVING CLAUSE, AND AN EFFECTIVE
DATE.
WHEREAS, the City Commission has determined that by allowing dogs in the area described
below is in the public interest of the residents of Delray Beach; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Chapter 101, "Municipal Parks, Beach and other Recreational Sites", Section
101.27, "Animal Regulations", of the Code of Ordinances of the City of Delray Beach, Florida, be and
the same is hereby amended to read as follows:
Section 101.27
ANIMAL REGULATIONS.
(A) No person shall herd, graze or permit to nm at large within any park any cattle,
horse, mule, donkey, goat, swine, sheep or other animal, or any poultry or other fowl.
(B) No person shall bring into, have or keep in any park, recreation or municipal
beach site, any cat, dog or other animal without a specific permit fi.om the Parks and
Recreation Department. However, any cat, dog or other animal shall be allowed on the
~idewalk and grassy area of the municipal beach between the eastern curb 0fA-1-A and
western base of the dune, for the entire length of the municipal beach. For purposes of
this ordinance, the western base of the dune encompasses all vegetative growth that is
found on the dune. All animal owners shall be responsible for the cleanup and disposal
of their animal waste in this area.
lSecti.on 2. That should any section or provision of this ordinance or any portion thereof, any
paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part
declared to be invalid.
Section 3.
hereby repealed.
That all ordinances or parts of ordinances in conflict herewith be and the same are
of
Section 4. That this ordinance shall become effective November 15, 2001.

"This may not be the total number of liens and this must be verified through the lien records at
the County".
Mr. Perlman moved to waive the lien interest request in the amount of $258.70 on
the property located at 338 N.W. 4th Avenue, seconded by Ms. McCarthy. Upon roll call the
Commission voted as follows: Mayor Schmidt - Yes; Mr. Perlman - Yes; Mrs. Archer - Yes;
Mr. Levinson - Yes; Ms. McCarthy- Yes. Said motion passed with a 5 to 0 vote.
Prior to the vote, Ms. McCarthy stated some sales are happening without the
traditional title search. Ms. McCarthy suggested that if this is a concern, the Commission might
need to discuss this further. Ms. McCarthy stated that the Commission would probably see more
of this in the next five years.
At this point, the time being 7:00 p.m., the Commission moved to the duly
advertised Public Hearings portion of the agenda.

Robert A. Barcinski, Assistant City Manager, stated at its meeting of October 2,
2001, the City Commission voiced concerns about enforcement, signage, pedestrian safety and
clean up after pets. Mr. Barcinski stated a memo fi:om Police Chief Schroeder is included in the
agenda backup outlining the enforcement measures. Public Works staff will make and install
new signs along A-l-A, which would include clean up after pet requirements.
Mr. Levinson inquired about Mayor Schmidt's suggestion with regard to the
plastic bags and asked Mr. Barcinski if he was able to obtain any information? In response, Mr.
Barcinski stated he needs to call the County to obtain information about the plastic bags.
Mayor Schmidt declared the public hearing open.
Charlene Henning, 1102 Waterway Way~ distributed a letter to Mayor Schmidt
fi:om one of thc homeowners and stated she fully supports this ordinance. In addition, Ms.
Henning reassured thc Commission that she and her neighbors would clean up after their dogs.
Louis Feldgoise~ 1026 Coralina Lane~ stated he is a dog owner and expressed
his support for the amendment to the ordinance. Mr. Feldgoise stated that he uses Gleason Street
to walk his dog and emphasized that the street is extremely dark and not safe. Mr. Feldgoise
stated if the proper enforcement is put into place and thc community is notified of a significant
finding imposed and should people not respect this, Mr. Feldgoise feels it would be adequate to
encourage people to follow the regulations.
Alice Finst~ 707 Place Tavant, suggested that the Commission review this
ordinance and have a restricted area. For example, Ms. Finst suggested that the restricted area be
at the north end of the beach with access to the water. Ms. Finst suggested that there be a "dog
beach". Ms. Finst stated she would also like to see additional language in the ordinance
regarding a review in six months to see how it is working.
Emily Stol.man, 1015 Vista Del Mar~ stated she recently moved to Delray Beach
fi:om New York where you can basically walk your dog anywhere. Ms. Stolman fully supports
the amendments to the ordinance.
Leslie Hening~ 1102 Waterway Lane, stated he is in favor of the expansion to
the west side of the dune. Mr. Hening stated if there was a sidewalk on the west side of A-1-A
then there would be no problem. However, currently to adhere to the rules of Delray Beach Mr.
Hening stated someone walking their dog must walk in the road and he feels this is very
dangerous.
John Bennett~ 137 Seabreeze Avenue~ supports this ordinance and suggested
that there be more signs warning people to "do it right or loose it" in addition to the other signs
that will be posted to make it clear to people who are not as motivated to pickup after their pets.
With regard to the way the ordinance is written, Mr. Bennett explained two suggestions, which
he feels the ordinance should reflect. One, Mr. Bennett suggested that the animals being walked
in this area be on a leash. Secondly, Mr. Bennett made reference to the last sentence in the
ordinance that reads: "All animal owners shall be responsible for the cleanup and disposal of

any animal waste in this area." Mr. Bennett suggested that the wording be changed to add the
following language at the end of the sentence "caused by their animals".
Mary Ann Monnin, 130 Andrews Avenue~ stated there are no sidewalks in the
area and no neighborhood protection for dogs. Ms. Monnin inquired about why the sidewalk on
the west side of A-1-A was never extended from Seagate to George Bush Boulevard. She feels
the two sidewalks that are available north of Atlantic Avenue should be shared and people need
to be responsible for picking up after their animals. Ms. Monnin stated walking on the west side
is very dangerous and urged the Commission to take this very seriously.
There being no else who wished to address the Commission, the public hearing
was closed.
Mr. Perlman commented that he has a dog and remembers that one of the
frustrations he recalls is when the dog was younger is that there was no place to take him except
for a County park. Mr. Perlman feels this ordinance is reasonable and he will support it.
Ms. McCarthy stated her concern is the people who walk in the early morning that
will be confronted with those people walking their dogs. Ms. McCarthy supports this ordinance
but stated she would like to see a six-month review perio~l,
Mrs. Archer stated she feels it is important to support the ordinance with the
understanding that this be reviewed in approximately six months to a year. In addition, she feels
the dogs should be on a leash.
The City Attorney stated that the intent of the ordinance is that the dogs have a
leash and that they not be allowed to just mn free.
Mr. Levinson stated he agrees with the leash and the review provision. In
addition, although he feels it is important for responsible dog owners to pickup after their dogs,
Mr. Levinson feels the language in the last sentence of the ordinance which states: "...any
animal waste in this area." should be changed because he feels that it is unreasonable. Mayor
Schmidt suggested changing the word "any" to "their". Mr. Levinson concurred with Mayor
Schmidt about the wording change.
The City Attorney gave direction to the City Clerk to place this in her tickler file
for April 8, 2002.
Mr. Levinson moved to adopt Ordinance No. 57-01 on second and FINAL
Reading as mended, seconded by Mrs. Archer. Upon roll call the Commission voted as
follows: Mr. Perlman - Yes; Mrs. Archer - Yes; Mr. Levinson - Yes; Ms. McCarthy - Yes;
Mayor Schmidt - Yes. Said motion passed with a 5 to 0 vote.

Attached are revised proposed performance measures for the Municipal Golf Course, Lakeview Golf
Course and Tennis Facilities for the fiscal year October 1, 2001 through September 30, 2002.
I have attempted to develop revised performance measures based on City Commission comments and
direction provided at your February 12~ workshop meeting. Various measures previously proposed have
been eliminated, standards have been set indicating minimum and maximum levels and a sliding point scale
is being proposed based on these ranges upon which a score for each measure is determined.
For example for the golf club a minimum of 83,000 rounds and maximum of 88,000 rounds is proposed
with an assignment of 1 point for every 500 rounds played above the minimum for a total of 10 points. We
feel that if we play less than 83,000 rounds we would experience a negative financial impact and when we
go over 88,000 rounds we think we would start experiencing a negative customer satisfaction impact.
I have reviewed all of the proposed performance measures with Mr. Dubin and we agree on the proposed
performance measures as presented to Commission for consideration.
This item is before Commission for review and further direction. Mr. Dubin is available to answer any
questions concerning the proposals.

City Commission Discussion and Direction to Staff
ITEM BEFORE THE COMMISSION:
Staff is recommending that the City advertise for a Request for Proposal to Master Plan the
Arvida Property, which includes 54.5 acres of land. Through discussions leading up to the
purchase of the property, the following components of the Master Plan should be
considered:
Commercial Development: All of or a portion of Parcel 1 (see attached map), which
contains 6.63 acres could be designated for a commercial development given its Military
Trail frontage. Consideration should be given to provide a right-of-way or easement along
the south property line to provide access to the properties to the east, depending on their
ultimate use. This parcel would also appear to be the most marketable and desirable for
future re-sale value to off-set some of the costs associated with the land deal.
City Park: Approximately 10-15 acres is needed to accommodate a neighborhood park. On
a preliminary basis, it appears that at least five (5) of the parcels have been identified by the
Parks and Recreation Department Director as being the most desirable given the heavy
concentration of trees. Thus, the park could be planned in a couple of ways.
Moderate Income Housing: The balance of the property, which contains approximately 33-
38.5 acres, could be designated for a single family development (maximum 5 du/ac) for
moderate-income housing to be sold in a price range of $125,000 to $175,000. The City
may wish to reserve 8-10 of the homes for Breezy Ridge Residents. Consideration may
need to be given to subsidize the cost of land to make them affordable.
If the Commission decides to authorize staff to advertise for a Request for Proposal, we
believe the process could be reasonably completed within a 120-day time period.
