A Special Meeting of the City Commission of the City of Delray
Beach, Florida, was called to order by Mayor Thomas E. Lynch in the
Commission Chambers at City Hall at 6:02 P.M., Tuesday, July 7, 1992.
Roll call showed:
Present - Commissioner Jay Alperin
Commissioner William Andrews
Commissioner Armand Mouw
Commissioner David Randolph
Mayor Thomas E. Lynch
Absent - None
Also present were - City Manager David T. Harden and City Attorney Jeffrey S. Kurtz
Mayor Lynch called the meeting to order and announced that this
meeting has been called for the purpose of considering the following:
1. Bid Award/Housing Rehab. The Commission is to consider a Bid
Award/Housing Rehab (Police Substation Property at 141 S.W. 12th Avenue)
to Intercontinental Construction Company in the amount of $36,430, with
funding from Community Development/Capital Outlay - Neighborhood Im-
provement (Account No. 118-1974-554-61.72) and CDBG Housing Rehabilita-
tion (Account No. 118-1963-554-60.23).
Lula Butler, Director of Community Improvement, stated the
proposed bid award is based on the Standard Housing Rehabilitation work
writeup and construction contracts. The proposal is to renovate this
building to Police specifications to be used as a Police substation;
however, when the building is vacated, it will be converted to a duplex
and probably sold to a low-income tenant.
Upon question by Mayor Lynch if this money could come from the
Police Drug Fund (Law Enforcement Trust Fund), the City Manager respond-
ed that the fund is nearly depleted.
Mr. Mouw moved for approval of the Bid Award to Intercontinen-
tal Construction Company, seconded by Mr. Andrews. Upon roll call the
Commission voted as follows: Mr. Mouw - Yes; Dr. Alperin - Yes; Mr.
Andrews - Yes; Mr. Randolph - Yes; Mayor Lynch - Yes. Said motion
passed with a 5 to 0 vote.
2. Presentations by Architectural Firms with Respect to the Tennis
~'enter/Stadium Project.
2.a. Fullerton Diaz & Partners, Inc.
David Harum, representing Fullerton Diaz & Partners, Coral
Gables, gave a slide presentation showing some of the tennis stadiums
and facilities constructed by their firm over the past twenty five years
and the existing conditions. His aim was to present a brief insight
into the forces that influence the design of a tennis stadium and the
effecting results.
John Fullerton, Fullerton Diaz & Partners, stated their prime
objective is to give the City of Delray Beach the best design for the
community in a tennis complex and they are prepared to accomplish this
project under the conditions specified, including the budget restraints
that have been assigned to the project.
A brief question and answer period followed the presentation.
2.b. Browning Day Mullins Dierdorf, Inc.
Craig Mullins, President, introduced Jeff Schnars, a represen-
tative of the firm who will handle the Civil Engineering aspect of the
project; Hanscomb & Associates will be included as a part of the team
because costs and scheduling are a major part of this project; a repre-
sentative of Bliss & Nyitray, who will monitor the structural engineer-
ing; Sheldon Westervelt, an experienced contractor of tennis facilities;
John Vaughn, who will be responsible for the permitting process, as well
as some construction administration, if necessary, and Robert Gooden,
who will be involved with the mechanical and electrical portion of the
project.
Mr. Mullins gave a presentation explaining and describing the
brochure showing the various sports and athletic facilities they have
designed and built, or are currently building. He spoke briefly with
regard to the present, but also cautioned the Commission to keep in mind
the possibility of the future expansion of the tennis facility for the
Delray Beach community. He mentioned that there will probably be other
important events that will take place at this stadium and he feels his
firm has the expertise to show not only what those events might be, but
to present designs showing how various events may be accommodated. He
suggested that the City further maximize the site potential by develop-
ing a personality for the tournament; for example, select a specific
type of food native to the area or adopt a regional design aesthetic,
but, by all means, allow the personality of the tournament to show
through.
A question and answer period followed the presentation.
2.c. Spillas Candela & Partners, Inc. in Association with Rossetti
Associates Architects.
A representative of the firm stated this type of project can be
very complex if it is a first time effort. Their firm has constructed
many sports facilities, but not a tennis center, so they contacted the
Rossetti firm in Detroit, Michigan, and requested the assistance of Don
Laudermill, who has designed the last two major professional tennis
facilities in the United States, the Lipton and the US Open in New York.
He has agreed to be the consultant for this project in Delray.

A representative from Rossetti Associates gave a brief slide
presentation showing some of their tennis projects in various locales.
He feels some of the key issues to be considered by the Commission
regarding this project are cost and time; i.e., the amount of money
required for construction, exactly what can be obtained with the avail-
able budget and the amount of time it will take to reach that goal.
Another key issue before the Commission for consideration is a temporary
facility as opposed to a permanent site and how that can be incorporated
without throwing money away.
A brief question and answer period followed.
2.d. Digby Bridges, Marsh and Associates, P.A..
Digby Bridges, Architect, named the individuals that will be a
part of the team for construction of the tennis complex, all of whom
have worked on previous projects for the City, so they are familiar with
how the City operates, in addition to Glen McNalt, consultant and
stadium expert from Southern Bleachers, who construct and design bleach-
ers and stadiums only. Mr. Bridges gave a slide presentation showing
some of the projects that have been completed by Southern Bleachers. He
defined alternate approaches that the City might consider using at the
downtown site.
Brahm Dubin, President of Dubin Associates and President of
Dubin & Evert Management, Inc., a member of the team, stated that either
site that is selected by the City Commission can become a fine facility
for a tournament. With safety and noise being the major concerns with
the selection of the downtown site, the clubhouse has been located at a
safe distance from the street in order to provide for a quiet environ-
ment. He continued with a slide presentation, showing a design that
addressed many of the key issues such as VIP parking, the press, player
locker rooms and lounge area, the food court, restroom facilities and
the security system.
Upon the completion of viewing a short video, there was a brief
question and answer period.
2.e. Swanke Hayden Connell Architects.
A representative from Swanke Hayden Connell Architects, identi-
fied the members and firms that will be assisting with the design and
construction. A slide presentation was given by a representative of
Heery International, Sports Design consultants, showing some of the
projects now under construction and others that have been completed.
A representative from SWA Group, Landscape Architects, gave a
brief slide presentation, showing the infrastructural systems along with
aesthetic elements from various completed projects.
Additional slide presentations were given by some of the sub
consultants with regard to their particular relationship in this
project.

Lee Kendrick, representing Gee and Jenson, who were selected as
the Civil Engineering, Mechanical, Electrical and Plumbing consultants~
for this project, stated their firm is very familiar with Delray Beach.
He added that their firm maintains a waste water management group that
is familiar with the procedure required in obtaining permits from the
South Florida Water Management District and he feels that, at any site,
that may be a problem.
A brief question and answer period followed.
3. Selection of an Architectural Firm for the Tennis Center. The
C'ommission is to consider ranking the architectural firms and authoriz-
ing staff to enter into contract negotiations with the top-ranked firm.
Upon question by Mayor Lynch, the City Attorney advised that
the Commission can conduct a straw vote, so long as it is signed.
Mr. Andrews questioned the status of plans for a clubhouse that
are currently shelved in Roy Simon's office. He feels there should be
some savings realized through encompassing plans readily available that
have previously been paid for. Mayor Lynch suggested that the phasing
of the second part be kept on hold for the time being. The City Manager
stated there may be some work product that could be used.
The consensus of the Commission was to have a straw vote
listing the top three and then hold a discussion.
The result of that vote was as follows: No. of votes

The City Attorney stated the result of the straw vote was as
follows: Digby Bridges, Marsh and Associates, P.A. ranked first,
Browning Day Mullins Dierdorf, Inc. ranked second and Spillis Candela &
Partners, Inc. and Swanke Hayden Connell Architects tied for fourth
place with Fullerton Diaz & Partners, Inc. as fifth. There was one 'no
vote' for the number three choice.
Mr. Mouw commented that he feels the first choice is very
clear, but he feels another straw vote should be taken to determine the
number two and number three choices.
Rick Macy, President, Rick Macy International Tennis Academy,
stated he received a call from the closing agent today and the closing
on the Laver's property will take place on Thursday, July 9th, 1992. He
would like to see the tennis facility, the City of Delray, and Liddun
International be partners in this project. The land will be deeded to
the City to build a stadium at the Layer's facility and the entire
facility will be made available for the tournament, at no charge. If

additional seating or courts need to be built, they will take over the
cost. Four times a year, the tennis academy will work hand in hand with
Mr. Foster, the tennis pro for Parks and Recreation, and use the stadium
to hold clinics for the City of Delray Beach.
Mr. Mouw requested a list of facilities listed by Mr. Macy, in
order that a check can be made against the costs the City will need to
expend downtown in order to duplicate or eliminate those facilities.
The City Attorney advised the order of ranking the second and
third choices resulted in Swanke Hayden Connell Architects being number
two, Browning Day Mullins Dierdorf, Inc., third place and Spillis
Candela & Partners, Inc., placing number three. The total votes were
eleven for number one, nine for number two and one Commissioner who
voted for the second choice only.
Mayor Lynch stated the firms will be ranked as follows: Digby
Bridges, Marsh and Associates, P.A., number one; Swanke Hayden Connell
Architects, number two and Browning Day Mullins Dierdorf, Inc., as third
choice.
Mr. Mouw moved approval of the order of ranking in the straw
vote, seconded by Mr. Randolph. Upon roll call the Commission voted as
follows: Dr. Alperin - Yes; Mr. Andrews - Yes; Mr. Randolph - Yes;
Mayor Lynch - Yes; Mr. Mouw - Yes. Said motion passed with a 5 to 0
vote.
4. Site Selection for the 1993 Tennis Tournament.
Dr. Alperin expressed the feeling that he has no confidence
with Laver's and that the project should be located in downtown Delray.
Mayor Lynch invited comments from the floor at this time.
The City Attorney advised that the choice before the Commission
tonight, pursuant to the contract, is for the site of the 1993 tourna-
ment.
Mayor Lynch stated he feels the downtown site should be chosen
as the number one site, retaining Layer's as a second alternative and
allowing staff to evaluate the issue.
Alfred Str.aghn, 26 S.W. 5th Avenue, expressed concern regarding
the community that will be most affected and requested that the commis-
sion ensure that the options available to those property owners that
will be affected by land purchase by the City is explained in detail.
Mayor Lynch responded that there are three homes that are involved and
that decision is not definite at this time.
Elmer Bregman, 4680 Cherry Laurel Lane, stated it is his
understanding that the status of the Laver's contract has been signed
and all that is pending is the receipt of title insurance that is due to
arrive within the next two days. He feels this is an excellent oppor-
tunity and possibly could save the City a great deal of money.

Jerry Marshall, Woodlake, commented that Laver's would be a
fine location, but he is curious as to the area of control the City
would have over those courts for the residents of Delray.
Michael Listick, Vice-Chairman, Downtown Development Authority,
stated he was requested to speak before the Commission expressing a
desire to locate this tournament downtown, not for the 1993 tournament
only, but for a permanent facility.
Dr. Alperin moved to select the downtown site as permanent,
seconded by Mr. Andrews. Upon roll call the Commission voted as fol-
lows: Mr. Andrews - Yes; Mr. Randolph - Yes; Mayor Lynch - Yes; Mr.
Mouw - Yes; Dr. Alperin - Yes. Said motion passed with a 5 to 0 vote.
Before roll call, the following discussion was had:
The City Attorney advised the City is under contract and it
might be prudent to allow Mr. Liddy to speak prior to roll call.
George Liddy, representing Liddun International, stated that
the enthusiasm for the downtown location is very infectious.
At this point the roll was called to the order.
Mayor Lynch declared the meeting adjourned at 8:45 P.M.
