SPECIAL MEETING AGENDA
Pursuant to Section 3.07 of the Charter of the City of Delray Beach, Mayor David W. Schmidt, has
instructed me to announce a Special Meeting of the City Commission to be held for the following
purposes:
(1) RESOLUTION NO. 24-02/F.I.N.D GRANT; Consider approval of Resolution No. 24-02
seeking reimbursement from the Florida Inland Navigational District (FIND) in the amount of
$10,000 for the construction of a pocket park, located at the end of SE 3'd Street abutting the
Intracoastal Waterway, featuring a 50' seawall, signage, bench and garbage can along with
informal, non-boat access to the Intracoastal Waterway for area residents.
(2)
REQUEST FOR FUNDING/COMMUNITY NEIGHBORHOOD HELPING;
Consider approval of a request from Community Neighborhood Helping for financial support
in the amount of $2,500 for their Glory Awards Event that will take place at Atlantic High
School on May 11, 2002.
(3) BARWICK PROPERTIES; Direction concerning options on Barwick Road Properties which
expire on March 18, 2002 and March 23, 2002.

Funding Request from Community Neighbors Helping
We have received a funding request from Edith Thompson, founder of Community Neighborhood
Helping, for $2,500 in support an awards event, The Glory Awards. The event is scheduled for May
11 at Atlantic High School. The following pages describe plans for the event and include a budget.
As was reported to the Commission on February 12, we have $3,250 remaining in contingency funds
for Special Events.
RECOMMENDATION
This is a new event being planned by a very effective, grassroots local organization. I recommend that
we support this event with a grant of between $1,000 and $2,500, at the discretion of the Commission.

and appreciate the many unsung heroes who make Delray Beach, the best city in America.

An organizing committee has been formed to coordinate, publicize and raise funds for the event.
Community Neighbom Helping, founded by Edith Thompson, is a non-profit organization that feeds and
cams for elderly residents in Southwest Delmy. The project was one of the three programs that helped
Delmy win the coveted All America City Award for a second time in 2001.
I think it's important to recognize those special people who are making a difference in our community.
The Glory Awards will go a long ways toward saying thanks and raising awareness of how we can get

SUBJECT: Barwick Site Contracts
The City has contracts on the Barwick site properties, as shown in the attached
table. The contracts provide that the City may terminate the contracts for a
reason, or no reason by March 16, 2002 (March 23rd for the Jettinghoff land), and
receive a refund of the City's deposit.
The contracts also require a simultaneous closing on the adjoining properties
listed in the contracts and provides, if there is no simultaneous closing, the City
may terminate the contracts and receive a refund of the City's deposit. The
closing date contained in the contracts is April 1,2002.
The contracts have been previously approved by the Commission. The purpose of
this item is to obtain City Commission's direction on whether to proceed to acquire
any of the properties.

Recreational Uses for Barwick Rd. Properties
Attached are two proposals for using portions of the properties we have under option in the Barwick
Rd. area. The Glacier Ice and Snow Arena you are familiar with since it was approved for the SE
comer of Lake Ida Road and Congress. The project has not proceeded at that site due to a dispute
among the present owners over the sale of the land. The odginal proposal was privately financed, but
they are now looking for a public partner to acquire the land and build the building which they would
then operate.
The second proposal is for a soccer academy. We could either buy the land and sell it to them, or we
could own the land and lease it to them. If we consider this possibility, I would suggest the lease
approach. Then if the soccer academy is not successful, the City would receive the property for its
use. Of course, many details would need to be worked out.

Reference: West Delray Beach Land / Glacier Ice and Snow Arena
Gentlemen and Ms. Ruby,
For the past two years I have been attempting to construct a new 90,000 square foot building in
Delray Beach to become the home of the Glacier Ice and Snow Arena. During this time there
have been four separate sites that were considered for the project. All sites have now been
eliminated for a variety of reasons with the latest site on Congress Avenue and Lake Ida Road
being tangled in the courts due to a sellers dispute.
As a result of the call I received on Tuesday from Mr. Dorling, I have reviewed the proposed site
in west Delray on Military Trail. Although I understand there are 40+ acres of land available, our
project would only require between 7 and 10 acres depending whether the city decides to locate
the proposed recreational skate park adjacent to the ice arena.
I have enclosed a preliminary sketch of the site that would work well for the project and satisfy
parking and set back requirements. The location, although not adjacent to 1-95 interstate as the
Congress Avenue site was, should still fit our demographics and produce an industry leading
facility. We believe the Delray Beach area would draw our loyal customers from Broward and
Palm Beach Counties and be a significant national and international tourism facility. The Palm
Beach county economic development office estimates the Glacier facility will generate
$ 30,000,000 in related tourism revenues during the first year of operations.
The project has been previously approved for several public grants to upgrade the facility to a
hurricane shelter at the Congress Avenue location. Currently, we have requested a time extension
to commit to the grants and would have to immediately request a transfer of grant funds to this
proposed site. There is no guarantee the transfer of grants would be approved by the state
Division of Emergency Management to the Military Trail site however, with the critical shortage of
shelter spaces along with the city's influence, I believe there is a good chance of success. The
Palm Beach County Tourism grant does not require the building to be a shelter.
As a result of the proposed site being city owned land and many other economic factors, the
ownership of the real estate and building would need to be municipal; therefore, I am proposing
the following partnership for consideration.
The real estate ann building would be owned by The City of Delray
The ice arena business, operating the entire facility, would be a joint partnership between
the City of Delray and Sey Beacon Inc.
The city would be paid a preferred return from business operating revenues to cover debt
service with the remaining net revenues to be split between partners
As a result of the wide vadety of financing programs available to the City, the HUD section
108 Community facilities pro.qram could finance the entire proiect. Palm Beach County has
been fully informed of this project and has indicated strong support.
· Throughout North America, over 90% of all ice arena facilities are municipally owned and
operated
· Sey Beacon Inc. would assign all Federal and County grant money (as permitted), to the
City of Delray-

Palm Beach County Tourism grant $ 290,000

· Sey Beacon would assign all project development documents to the City Of Delray
including plan design and development of presentation drawings. All classified technical
and design specifications would become integrated into the construction of the facility
· Sey Beacon would provide all aspects of arena operations, scheduling, management,
engineering and refrigeration expertise, customer databases, 10 years of customer good
will from Goldcoast Ice Arena and a long-term management commitment to the project.
· During construction, Sey Beacon will provide project coordination and supervision with a
short-term agreement
· If the recreation department approves the site as the new location of a city skate park, Sey
Beacon will honor the operation agreement presented to Mr. Weldon last summer
· Sey Beacon will produce an annual operations budget and market the facility regionally
and nationally to host Figure skating and hockey events, which will develop significant
positive financial impact to local businesses.
· Sey Beacon will assemble all suppliers, vendors and inventory for operations of a first
class facility.
I believe this site is the last opportunity to locate this high profile community recreation facility in
Delray Beach. In light of the recent Olympics success, which achieved the highest television
audience of any sporting event ever broadcast, I believe this project will enjoy immediate success
the day the doors open.

Community and Educational Benefits
The Glacier Arena facility will consist of 90,000 square feet of space including three ice skating
surfaces, school facilities for up to 500 persons, first class hockey facilities, community center for indoor
and outdoor events for 3000 participants, fitness center, retail store, 1200-seat stadium for performing
arts presentations and a fully equipped ballet-training center.
The Glacier Arena will have a long-term positive impact on the quality of life for the families and children
of the region. All of the community benefits listed below currently do not exist in Palm Beach County.
They are endorsed by the City of Delray Beach and in alignment with the Palm Beach County Master

Per your request, I met with Sandy MacLean of Arvida Realty on the
afternoon of March 8th and visited the eleven (11) parcels off of Barwick
Road. Mr. MacLean represents Barriga Soccer Academy and is very
interested in purchasing or leasing land in this area (15-20 acres) for a
soccer academy.
Of the eleven parcels, parcels #1, 1, 9, 11, 10, and 18 are occupied by
landscape nurseries or have little in the way of standing trees. Parcels
#2, 3, 4, 8, and 17 are heavily treed with a mixture of both native and
exotic species (native pines, Australian Pines, and Melaleuca). Parcels
#2, 3, 4, and 8 seem to have a healthy stand of Native Pines mixed with
some exotic species. Parcel #17, the former Toad Suck Farm, again is
heavily wooded with a combination of both native and exotic species.
Attached please find a letter from the owner of parcel #17 concerning the
tree species.
At the time of our meeting, Mr. MacLean indicated parcel #5 was not part
of the sale, although it is included in other documentation.
It is my understanding that, besides the soccer academy, an ice arena is
proposing that they lease a portion of this land from the City for
recreation purposes.
THE EFFORT ALWAYS MATTERS

There are parcels in this area that would provide an opportunity for a
neighborhood park (8-10 acres). Our recently completed master plan calls
for a neighborhood park on Military Trail (south of Atlantic Avenue).
The downside is that this area is located less than one half mile south
of Barwick Park. Obviously, many details would have to be worked out.

Part of tM property has an organic hardpan runnln8 near the surface on the south end of the

Barwick Road Properties Under Option
The purpose of this memo is to briefly describe various altematives for exercising the options the City
holds for the 54.5 acres between Barwick Road and Military Trail north of Country Manors and the L-31
Canal. Keep in mind that we have a 12" water line through this area which serves the 40 acre tract at
the SE comer of Military Trail and the L-30 canal. This property is now undergoing development in the
County. If we annex this property while is it undergoing development, we would receive associated
development feed now being paid to the County. We have a water service agreement with the
property which requires annexation upon becoming contiguous with the City.
From our line of credit we currently have available between $4.5 and $5 million which could be use for
purchase of these lands. If necessary, we could go a little above that amount by borrowing internally.
Acquire none of the properties. ADVANTAGE The City would not tie up any money in this
property, DISADVANTAGES We may never again have the opportunity to annex all these
properties. We would also be giving up the opportunity to acquire future park land in the area for a
fairly reasonable price. There is a good chance these properties would develop in the county with
no control by the City. We would loose the opportunity to quickly annex the 40 acres SE of Military
Trail and the L-30 Canal.
Acquire parcels 1,2,3,4 and 8. Approximate cost: $3,218,000. We would envision bringing in a
road off Military Trail and selling off the remaining commercial frontage. The remainder of parcel 1
and parcel 2 could be developed for housing. Parcels 3 and 8 or 3 and 4 would make a good park
site. Parcel 8 is needed to make the 40 acre tract contiguous. ADVANTAGES The City would
reserve land for a future park site, and could facilitate some housing development. No one should
object to moderate income housing in this location. Some of the cost would be recovered by sale
of the frontage on Military. DISADVANTAGE County approval of annexation across the L-31
Canal is not assured.
Acquire parcels 8, 9, 10, 11, 17 and 18. Approximate cost: $4,676,000. Parcel 17 could be used
for a park site, or 17 and 18 could be sold or leased for the soccer academy, or the soccer
academy could go on 9, 10 and 17. Parcels 9, 10 and 11 could be used for housing with a
neighborhood park on 8 and the soccer academy on 17 and 18. ADVANTAGES The 40 acre
tract is easily made contiguous and annexed. There is sufficient room for 10 to 15 acres of
housing and a future park site. Parcels 1 through 4 appear to be well situated for pdvate
development. DISADVANTAGES Parcels 11 and 18 are two of the most expensive parcels while
parcel 3 is one of the least expensive. Residents in the 40 acre tract and Golf Club Estates may
object to moderate income housing being developed adjacent to them.
Acquire all of the parcels under option except 17 and 18. Approximate cost: $5,083,000. This
would give us the greatest flexibility while not stretching our budget too much. Other than the
added cost, this option has the advantages outlined for other options without the disadvantages.
Acquire all of the parcels under option. Cost: $7,320,824. This gives us the control over future
development of all the vacant land in this area, which is all designated as future annexation area.
The disadvantage is that it would create at least a temporary financial strain until we sold some of
these properties or transferred all or part of the new high school site to the School District.
Of course, there are numerous variations on these rrve scenarios. Another potential development is
that one of the owners on the new high school site may be interested in trading for parcel 4.
I suggest that the Commission first determine whether you wish to consider accommodating either the
soccer academy or the ice arena. Then you can decide which other parcels you would purchase, if
any.

The attached agenda item is for Commission approval for Change Order #3 to
Subaqueous Services, Inc. on the Tropic Isle Canal Dredging Project (Project Number
2000-011). This change order adds up to 4,000 cubic yards (cy) of dredged material,
plus an additional mobilization, to the Contract. The additional material as well as the
mobilization will be paid at the original Contract unit prices. This contract is paid on a
cubic yard of material removed.
As a requirement of the Tropic Isle Class Action Settlement Agreement, the canals
were to be dredged a width of 25 feet each side of the canal centerline and to a depth
of -5 feet Mean Low Water (MLW). An as-built survey, completed by Coastal Planning
and Engineering, Inc., indicated that certain canals did not meet this width and depth
requirement.
The amount of this Change Order is an add amount of $86,069.00.
Funding Source is 448-5461-538-65.54 (Tropic Isle Dredging).
The attached map indicates the location of this work.

With the above referenced contract still open with the City of Delray Beach, Subaqueous
Services, Inc. is able to extend those same prices to complete the project as detailed in the
plans received in today's meeting.
We anticipate a start date on or about March 18, 2002 with a completion date ninety (90) days
from the start date.

Attached for Commission approval is an agenda request for Change Order #3 to
Subaqueous Services, Inc. on the Tropic Isle Canal Dredging Project (PN 2000-011).
This change order adds up to 4,000 cubic yards (cy) of dredged material, plus an
additional mobilization, to the Contract. The additional material will be paid at the
original Contract unit price. The amount of this Change Order is an add amount of
$86,069.00. Funding Source is 448-~-538~:.54 (Tropic~le Dredging).
