P.O. Box 2133 Delray Beach, Florida 33444 Dear Edith: I heartily endorse the Glory Awards to be sponsored by Community Neighborhood Helping, Inc. Your organization certainly stands at the forefront of neighborhood, grassroots organizations that help many people and receive little credit. People in organizations that devote their time and money in helping their neighbors often receive little credit for the work they do. Local govemments rarely have the funds available to p.articipate in such programs, and organizations such as yours fill the gap t~hat state and federal funding can- not fill. Your program was an integral part of Delray Beach's 2001 All America Cir~¢ application and award. We look forward to our continued relationship with your organization as we work together to revitalize our community. Sincerely yours, David W. The first annual 'Glory Awards' sponsored by Community Neighbors Helping will be held at Atlantic High School. This black tie gala will celebrate and appreciate the many unsung heroes who make Delray Beach, the best city in America. The everifwill feature entertainment, dinher and an awards ceremony in the Atlantic High auditorium. An organizing committee has been formed to coordinate, publicize and raise funds for the event. Community Neighbom Helping, founded by Edith Thompson, is a non-profit organization that feeds and cams for elderly residents in Southwest Delmy. The project was one of the three programs that helped Delmy win the coveted All America City Award for a second time in 2001. I think it's important to recognize those special people who are making a difference in our community. The Glory Awards will go a long ways toward saying thanks and raising awareness of how we can get Involved in our community. Please consider sending a check or in-kind contribution to support this worthy cause. Don~ions are tax-deductible and can be sent to Community Neighbors Helping Inc., P.O. Harden, City Manager March 8, 2002 Recreational Uses for Barwick Rd. Properties Attached are two proposals for using portions of the properties we have under option in the Barwick Rd. area. The Glacier Ice and Snow Arena you are familiar with since it was approved for the SE comer of Lake Ida Road and Congress. The project has not proceeded at that site due to a dispute among the present owners over the sale of the land. The odginal proposal was privately financed, but they are now looking for a public partner to acquire the land and build the building which they would then operate. The second proposal is for a soccer academy. We could either buy the land and sell it to them, or we could own the land and lease it to them. If we consider this possibility, I would suggest the lease approach. Then if the soccer academy is not successful, the City would receive the property for its use. Of course, many details would need to be worked out. acie t City of Delray Beach March 1, 2002 Meeting with city officials: Mr. David Harden-City Manager · Mr. Paul Dorling- Planning/Zoning Director · City Attorney-Ms. Ruby Reference: West Delray Beach Land / Glacier Ice and Snow Arena Gentlemen and Ms. Ruby, For the past two years I have been attempting to construct a new 90,000 square foot building in Delray Beach to become the home of the Glacier Ice and Snow Arena. During this time there have been four separate sites that were considered for the project. All sites have now been eliminated for a variety of reasons with the latest site on Congress Avenue and Lake Ida Road being tangled in the courts due to a sellers dispute. As a result of the call I received on Tuesday from Mr. Dorling, I have reviewed the proposed site in west Delray on Military Trail. Although I understand there are 40+ acres of land available, our project would only require between 7 and 10 acres depending whether the city decides to locate the proposed recreational skate park adjacent to the ice arena. I have enclosed a preliminary sketch of the site that would work well for the project and satisfy parking and set back requirements. The location, although not adjacent to 1-95 interstate as the Congress Avenue site was, should still fit our demographics and produce an industry leading facility. We believe the Delray Beach area would draw our loyal customers from Broward and Palm Beach Counties and be a significant national and international tourism facility. The Palm Beach county economic development office estimates the Glacier facility will generate $ 30,000,000 in related tourism revenues during the first year of operations. The project has been previously approved for several public grants to upgrade the facility to a hurricane shelter at the Congress Avenue location. Currently, we have requested a time extension to commit to the grants and would have to immediately request a transfer of grant funds to this proposed site. There is no guarantee the transfer of grants would be approved by the state Division of Emergency Management to the Military Trail site however, with the critical shortage of shelter spaces along with the city's influence, I believe there is a good chance of success. The Palm Beach County Tourism grant does not require the building to be a shelter. As a result of the proposed site being city owned land and many other economic factors, the ownership of the real estate and building would need to be municipal; therefore, I am proposing the following partnership for consideration. The real estate ann building would be owned by The City of Delray The ice arena business, operating the entire facility, would be a joint partnership between the City of Delray and Sey Beacon Inc. The city would be paid a preferred return from business operating revenues to cover debt service with the remaining net revenues to be split between partners As a result of the wide vadety of financing programs available to the City, the HUD section 108 Community facilities pro.qram could finance the entire proiect. Palm Beach County has been fully informed of this project and has indicated strong support. · Throughout North America, over 90% of all ice arena facilities are municipally owned and operated · Sey Beacon Inc. would assign all Federal and County grant money (as permitted), to the City of Delray- FEMA- hurricane shelter grant $ 873,000 Palm Beach County Tourism grant $ 290,000 Palm Beach County EMPA .qrant for .qenerator (to be applied for)-$125,000 Total: $1,288,000 · Sey Beacon would assign all project development documents to the City Of Delray including plan design and development of presentation drawings. All classified technical and design specifications would become integrated into the construction of the facility · Sey Beacon would provide all aspects of arena operations, scheduling, management, engineering and refrigeration expertise, customer databases, 10 years of customer good will from Goldcoast Ice Arena and a long-term management commitment to the project. · During construction, Sey Beacon will provide project coordination and supervision with a short-term agreement · If the recreation department approves the site as the new location of a city skate park, Sey Beacon will honor the operation agreement presented to Mr. Weldon last summer · Sey Beacon will produce an annual operations budget and market the facility regionally and nationally to host Figure skating and hockey events, which will develop significant positive financial impact to local businesses. · Sey Beacon will assemble all suppliers, vendors and inventory for operations of a first class facility. I believe this site is the last opportunity to locate this high profile community recreation facility in Delray Beach. In light of the recent Olympics success, which achieved the highest television audience of any sporting event ever broadcast, I believe this project will enjoy immediate success the day the doors open. Please contact me with any questions. Sincerely, Flal Oacovitz. MEMORANDUM TO: FROM: SUBJECT: DATE: MAYOR AND CITY COMMISSIONERS CITY MANAGER AGENDA ITEMS-/R,~- SPECIAL MEETING OF MARCH 13, 2002 BARWICK PROPERTIES MARCH 13, 2002 Per City Manager, this is additional information for the Barwick Properties. He will e-mail other information tonight. [IT¥ JIF DELRR¥ BER£H NI-AmedcaCity 1993 2001 RECEIVED ! 2 2002 CiTY MANAGER 100 NW. lstAVENUE DELRAYBEACH, FLORIDA 33444-561/243-7000 MEMORANDUM TO: David Harden City Manager FROM: Joe Weldon Director of Parks and Recreation SUBJECT: Neighborhood Park DATE: March 11, 2002 Per your request, I met with Sandy MacLean of Arvida Realty on the afternoon of March 8th and visited the eleven (11) parcels off of Barwick Road. Mr. MacLean represents Barriga Soccer Academy and is very interested in purchasing or leasing land in this area (15-20 acres) for a soccer academy. Of the eleven parcels, parcels #1, 1, 9, 11, 10, and 18 are occupied by landscape nurseries or have little in the way of standing trees. Parcels #2, 3, 4, 8, and 17 are heavily treed with a mixture of both native and exotic species (native pines, Australian Pines, and Melaleuca). Parcels #2, 3, 4, and 8 seem to have a healthy stand of Native Pines mixed with some exotic species. Parcel #17, the former Toad Suck Farm, again is heavily wooded with a combination of both native and exotic species. Attached please find a letter from the owner of parcel #17 concerning the tree species. At the time of our meeting, Mr. MacLean indicated parcel #5 was not part of the sale, although it is included in other documentation. It is my understanding that, besides the soccer academy, an ice arena is proposing that they lease a portion of this land from the City for recreation purposes. THE EFFORT ALWAYS MATTERS 2 There are parcels in this area that would provide an opportunity for a neighborhood park (8-10 acres). Our recently completed master plan calls for a neighborhood park on Military Trail (south of Atlantic Avenue). The downside is that this area is located less than one half mile south of Barwick Park. Obviously, many details would have to be worked out. DJ~drO~f Parks and Recreation Attachment JW: cp Ref:dhneighpk 17:11 FAX WILLIAM M. MORTON, Ph.D. P.O. C-lades Rd, Suite #A Boca P,a~n, FL 33434-4111 Dear Mr. lviac~ As per the real property disclosure form you presented to mc on May 1, 2001, I ~m herewith ptesenri~ag Real Property Disclosures about LATEb~ DBFECTS pert~uing to the property that might "materially affect the value, ns= or desirability of the propartT," My property (Folio # 00 42. 46 12 00 000 3026) consists of 8.27 +- acres of land covered with native upland pine forest where I have lived since 1969, and wMch I hhve owned since 1975, it being the site of my home for 32 ye~s. The forest trees shed pine needles ' which along with other under-story vegetation form a layer of nmuxal organic mulch on the sm-face of the ground. As in ali upland pine forest maintained in an "a~ natural ~s possible" state while using the land for agricultural purposee, the fore, st in times of drought is suscepU"ole forest fires. This forest borders some housing developments in the area, and a forest fire might be a h~rd tn houses located hearst this land. Currem owner sells the land as it stands now, and does not warrant the land agsinst fire hazards, nor agah~t actual forest fires. The buyer a~sumes all frre risks upon purchase of the l~roperty. It is mstm~ for South Florida's nal~ve pin= tr~s, "Phaus ]~liotii,': to break limbs t-r6m thelz lower truttk a~ thc tree grow~ in height, whi~ in tm'n makes the tree l~ttks long and straight and yields high quality "Dade County" pine. Limbs on our native flora often break-off during storms, and crash to the ground. Thinning of the canopyin thi.~ manner ~llows the tree to retain it's trunk, and helps save it duri~ storms. Australian Pines (thr~ species ofCasurina sp. common in South Florida) do not enjoy this survival mechanism, and tend to blow over durhlg s~et~ storms. Both native Florida pine and Australian pines are found grov, ing on this property. The owner of'this offering sells the land in it's curtcn~ condition, and without any warranty or responsibility of any kind for any fallen, blowing or ballistic limbs, tree parts, or Vees, or uprooted, over-turned or broken oitor blown dorm trees, This property contains Canarina equistifolia (Australian Pin~) as wind breaks on the east, west and south side and Melaluccs leueodendton (Punk Trees) planted by me in a small men in the North West comer of the property near Lake Worth Drairmgc District 0g,'08/~002 FRI 17:12 FaX (L.W.D,D,) Drainage Can~ I.-30. Al&ough &ese ~'~es were perf~tly Ieg~l at the time of plaating, by Palm Beach County ortli-~nc~aw the trees have been outlaw~d~ a~d will l~ave m be removed from t/~ property by 2005, Owner tramf~,r~ the removal of any trees required by ordinauce to the new owners, as the land is sold in its currant condition. o There are exotic trees and plants on the prol~rty that have beta outlawed as invasive and noxious by pslm Beach County. One tlmt occt~ here, and wh/ch we have unsuccessfully been able to control is Air Potato, a member of the edible troplcpJ Yam Family, Dioscor~a Sp. We have engaged in wlmt we call our "Air Potato Wars"' hem at this property for ma~y years. Wc dig out the large un~und tuber of cntrcnchcd Air Potato planis, and crawl around on our hands and knees gathering thc young Ak Potatoes that fall each year from vines 8~owin~ in the forest area. We take such old tubers and new young tubers into the kitchen and boil them until dead, thai dump them into our organic tempos piles to rot. So for we have lost *.hL~ war. Thc spatial complexity oft. he forested land leaves too maisy secret places for thc young ~ to Mdc and so each sprlng new ~owth of Ak Potatoes be~,,.~. Please be infonned that Air Potato, an outlawed invasive and noxlo~ plant exists on this ln,~d. With the sale of this property, control of this and other perhaps unobserv~l and ullknown outlawed plants will become thc responsibility of the new owners. Tho current owner does not assume any further responsibility for undesirabl~ and/or invasivc and/or noxious plants grov~ing wild and/or found on the property. Tlmt responsibility transfers to thc new owner upon pumhn_~e of the property. , The prolm't7 cont~ some native and exotic Ficu~ sp. trees deemed nexioudiavasivo by Palm Beach County, and such tre~ may have to be d~g-oycd or re, moved at some apparently unspecified fimrm date. Thc list of illegal, undcairaMe, invasive and/or noxious native and ~otic plants is mntinually undcr~ing changes arid trlxta~. The curing owner does no~ assume any furth~ mspomtbtli? for any ill~gal, and/or undesirable and/or invasive and/or noxious plants growing wild a~or found on the property. That rvsponsibility tmmfors to tho new owngr upon purchase of the pro~. Part of tM property has an organic hardpan runnln8 near the surface on the south end of the property, but omvl~g up to seven or so feet towards the north end. The land consisted of two five acre plots. Tho west original five acres had tho h~rd pan broken up ~ery 25 to 30 feet by having backhoe ditch~ dug though it to ~elicve lhv "perched mater table" that arose when the property, was overhead irrlgatat for container nursery plant production. The original cast five acres were used for in-ground nursery crop plmti~g~, and was in,equally irrigated. Because the perched wat,r table mounted to ideal subsurface irrigation for those pl~nt~, tho hard pan was rclained on the cast five acres. $eller does not know what the requirements are for every land use. but it is possible that percolation and drainage standards of r,,ln water on any portion ofthe property will be imposed depending u?n use, and that the furore owner will have to provide for such requirements. For current owner's use, the percolation aud drainage ~ been ideal. ielTIO To~ CC: Date:. Re: City Commission David T. Harden, City Manager March 12, 2002 Barwick Road Properties Under Option The purpose of this memo is to briefly describe various altematives for exercising the options the City holds for the 54.5 acres between Barwick Road and Military Trail north of Country Manors and the L-31 Canal. Keep in mind that we have a 12" water line through this area which serves the 40 acre tract at the SE comer of Military Trail and the L-30 canal. This property is now undergoing development in the County. If we annex this property while is it undergoing development, we would receive associated development feed now being paid to the County. We have a water service agreement with the property which requires annexation upon becoming contiguous with the City. From our line of credit we currently have available between $4.5 and $5 million which could be use for purchase of these lands. If necessary, we could go a little above that amount by borrowing internally. Acquire none of the properties. ADVANTAGE The City would not tie up any money in this property, DISADVANTAGES We may never again have the opportunity to annex all these properties. We would also be giving up the opportunity to acquire future park land in the area for a fairly reasonable price. There is a good chance these properties would develop in the county with no control by the City. We would loose the opportunity to quickly annex the 40 acres SE of Military Trail and the L-30 Canal. Acquire parcels 1,2,3,4 and 8. Approximate cost: $3,218,000. We would envision bringing in a road off Military Trail and selling off the remaining commercial frontage. The remainder of parcel 1 and parcel 2 could be developed for housing. Parcels 3 and 8 or 3 and 4 would make a good park site. Parcel 8 is needed to make the 40 acre tract contiguous. ADVANTAGES The City would reserve land for a future park site, and could facilitate some housing development. No one should object to moderate income housing in this location. Some of the cost would be recovered by sale of the frontage on Military. DISADVANTAGE County approval of annexation across the L-31 Canal is not assured. Acquire parcels 8, 9, 10, 11, 17 and 18. Approximate cost: $4,676,000. Parcel 17 could be used for a park site, or 17 and 18 could be sold or leased for the soccer academy, or the soccer academy could go on 9, 10 and 17. Parcels 9, 10 and 11 could be used for housing with a neighborhood park on 8 and the soccer academy on 17 and 18. ADVANTAGES The 40 acre tract is easily made contiguous and annexed. There is sufficient room for 10 to 15 acres of housing and a future park site. Parcels 1 through 4 appear to be well situated for pdvate development. DISADVANTAGES Parcels 11 and 18 are two of the most expensive parcels while parcel 3 is one of the least expensive. Residents in the 40 acre tract and Golf Club Estates may object to moderate income housing being developed adjacent to them. Acquire all of the parcels under option except 17 and 18. Approximate cost: $5,083,000. This would give us the greatest flexibility while not stretching our budget too much. Other than the added cost, this option has the advantages outlined for other options without the disadvantages. Acquire all of the parcels under option. Cost: $7,320,824. This gives us the control over future development of all the vacant land in this area, which is all designated as future annexation area. The disadvantage is that it would create at least a temporary financial strain until we sold some of these properties or transferred all or part of the new high school site to the School District. Of course, there are numerous variations on these rrve scenarios. Another potential development is that one of the owners on the new high school site may be interested in trading for parcel 4. I suggest that the Commission first determine whether you wish to consider accommodating either the soccer academy or the ice arena. Then you can decide which other parcels you would purchase, if any. · Page 2 (~ITY COMMISSION CITY OF DELRAY BEACH, FLORIDA SPE~IAL/WOKSHOP - WEDNESDAY, MARCH 13, 2002 6:00 P.M.
