09-17-90SpMtg SEPTEMBER 17, 1990 A Special Meeting of the City Commission of the City of Delray Beach, Florida, was called to order by Mayor Thomas E. Lynch in the Commission Chambers at City Hall at 6:01 P.M., Monday, September 17, 1990. Roll call showed: Present - Commissioner Jay Alperin Commissioner William Andrews Commissioner Mary McCarty Commissioner David Randolph Mayor Thomas E. Lynch Absent - None Also present were - City Manager David T. Harden and City Attorney Jeffrey S. Kurtz Mayor Lynch called the meeting to order and announced that this meeting has been called for the purpose of (1) Emergency Ordinance No. 46-90 enacting a new Section to provide for an interim Historic Preser- vation Board and (2) The Appointment of Seven Members to the Interim Historic Preservation Board. 1. Emergency Ordinance No. 46-90. Emergency Ordinance No. 46-90, amending the Code of Ordinances by repealing Sections 174.40 and 174.41 by enacting a new Section to provide for an interim Historic Preserva- tion Board, is before the Commission for consideration on First and FINAL Reading. Prior to consideration of passage of this ordinance on First and FINAL Reading, a public hearing has been scheduled to be held at this time. The City Manager presented Emergency Ordinance No. 46-90: AN EMERGENCY ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING TITLE XVII, "LAND USAGE", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY AMENDING CHAPTER 174, "HISTORIC PRESERVATION", "HISTORIC PRESERVATION BOARD", BY REPEALING SECTIONS 174.40, "CREATION; COMPOSITION", 174.41, "TERMS OF OFFICE", AND 174.42, "ORGANIZATION"; BY ENACTING A NEW SECTION 174.40, "INTERIM HISTORIC PRESERVATION BOARD", PROVIDING FOR THE CREATING OF AN INTERIM HISTORIC PRESERVATION BOARD HAVING ALL THE POWERS AND DUTIES OF THE HISTORIC PRESERVATION BOARD, PROVIDING FOR THE APPOINTMENT AND TERMS OF MEMBERS OF THE INTERIM HISTORIC PRESERVATION BOARD; PROVIDING A GENERAL REPEALER CLAUSE; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. (Copy of Emergency Ordinance No. 46-90 is on file in the official Ordinance Book) The City Attorney read the caption of the ordinance. A public hearing was held in compliance with the laws of the State of Florida and the Charter of the City of Delray Beach, Florida. The public hearing was closed. Ms. McCarty moved for approval of Emergency Ordinance No. 46-90 on First and FINAL Reading, seconded by Mr. Andrews. Upon roll call the Commission voted as follows: Ms. McCarty - Yes; Dr. Alperin - Yes; Mr. Andrews - Yes; Mr. Randolph - Yes; Mayor Lynch - Yes. Said motion passed with a 5 to 0 vote. 2. Appointment of Seven Members to the Interim Historic Preserva- tion Board. The Commission is to consider the appointment of seven members to the Interim Historic Preservation Board. Mr. Randolph moved to suspend the rules in order to appoint members to the Interim Historic Preservation Board, seconded by Mr. Andrews. Upon roll call the Commission voted as follows: Dr. Alperin - Yes; Mr. Andrews - Yes; Mr. Randolph - Yes; Mayor Lynch - Yes. Ms. McCarty - Yes. Said motion passed with a 5 to 0 vote. Mr. Andrews moved to appoint Rose Sloan, C. Spencer Pompey, Pat Healy-Golembe, K. Wayne Campbell, Daniel H. Carter, Christine B. Bull and William V. Ayers as members of the Historic Preservation Board, seconded by Mr. Randolph. Upon roll call the Commission voted as follows: Mr. Andrews - Yes; Mr. Randolph - Yes; Mayor Lynch - Yes; Ms. McCarty - Yes; Dr. Alperin - Yes. Said motion passed with a 5 to 0 vote. Mayor Lynch declared the meeting adjourned at 6:03 P.M.
